Thedefendantwasoriginallychargedwiththeaggravatedsexualbatteryofhisstepdaughter.Thepresentencereportreflectsthatthevictimstatedthatthedefendantrequiredhertomasturbatehimandthatithadhappenedbefore.Italsoreflectsthatthedefendantdeniedthatithappened,evenafterhisguiltyplea. Thegistofthedefendantsconcernrelatestothefactthataspartofthepleaagreement,heagreedtoattendaprogramwithCounselingandConsultationServices,Inc.,inordertoevaluatehissuitabilityfortreatmentinthecommunity.Thestatehadagreedthatifheweresuitableforsuchtreatment,heshouldbeplacedonintensiveprobation.However,thedefendantdidnotattendanysessions. Atthesentencinghearing,thedefendantandhisliveingirlfriendtestifiedthathewasgoingtothefirstevaluationmeetingonApril23,1997,whenthecarbrokedown.ThedefendantsaidthathecalledandobtainedanotherappointmentforMay6,1997.However,whenhearrived,hewastoldthathewouldhavetopaytheonehundredfiftydollarsforthefirstmissedsessionbeforehehadanothersession.Hetestifiedthathedidnothavethemoney.   4,2  Thedefendanttestifiedthatheworkedasarooferandthatbusinesshad beenslow.Hesaidthatthemoneyhemadewentforrent,electricityandthelikeand&&&&thathejustdidnothavethemoneytopayforthesessions.ThepresentencereportreflectsthatthedefendanttelephonedthepresentenceofficeronAugust14,1997,andtoldherthathewasnotgoingtocounselingbecausehewasnotguiltyandhecouldnotaffordit.Thedefendantessentiallyconfirmedthisconversationinhistestimony. Inconsideringthesentence,thetrialcourtnotedthatthedefendanthadalengthymisdemeanorrecord,includingconvictionsfordrivingundertheinfluence,drivingonasuspendedlicense,theft,andobtainingmoneybyfraud.Itstatedthatthepresentencereportreflectsthatthedefendantwaslessthancandidabouthisemploymentstatusatthetimeofhisinterview.Also,Inthisrespect,thetrialcourtdoubtedthedefendantssincerityrelativetohisclaimofinabilitytoattendtheevaluationsessionsthatwererequired.Thetrialcourtconcludedthatthedefendanthadfailedtoprovethathewasaworthycandidateforprobation.
