OnSeptember22,1993,Petitionerpledguiltytoseven(7)countsofaggravatedrobbery,one(1)countofaggravatedkidnapping,andone(1)countofattemptedespeciallyaggravatedrobberyintheCriminalCourtofShelbyCounty.Thesewereenteredpursuanttoanegotiatedpleaagreementwhereinhereceivedaneight(8)yearsentenceforeachconviction,alltorunconcurrentlywitheachother,exceptfortheespeciallyaggravatedrobberyconvictionwhichwasorderedtobeservedconsecutively.Hereceivedaneffectivesentenceofsixteen(16)years.Approximatelytwo(2)yearslater,Petitionerfiledhispetitionforpostconvictionrelief. TheonlytestimonyattheevidentiaryhearingwasfromthePetitionerandhistrialcounsel.Thetrialcourtenteredanorderdenyingthepetitionforpostconvictionreliefaftertheevidentiaryhearing.Attheevidentiaryhearing,Petitionertestifiedthathistrialcounselfailedtoobtaindiscovery,failedtofilemotions,failedtoproperlyinvestigatethecase,failedtoadequatelyconferwithhim,andfailedtoproperlyadvisehimastothenatureoftheguiltypleasthatheultimatelyentered.ThetrialcourtspecificallyfoundinitsorderthatneartheendofPetitionerstestimony,Petitionerconcededthattheonlymattersthatactuallyconcernedhimwerethathewasinnocentofthekidnappingchargeandshouldnothavebeenallowedtopleadguiltytothatoffense,andthathedidnotfullyunderstandthenatureofconsecutivesentencing.  TrialcounselstestimonycontradictedthePetitionerstestimonyinvirtuallyeveryaspect.Thetrialcourtspecificallyfoundfromtheentirerecord,thetranscriptsoftheguiltypleahearing,andallotherrelevantexhibitsandinformation,thattrialcounseldidanoutstandingjobinrepresentingthePetitioner.ThetrialcourtalsofoundthatPetitionerwasfullyawarethathewouldreceiveconsecutivesentencingforaneffectivesentenceofsixteen(16)years,andthattheonlywaytoreceivetheofferofsixteen(16)yearswouldbeforhimtopleadguiltytothekidnappingcharge.ThetrialcourtalsofoundthatatthetimePetitionerenteredhisguiltypleasthathehadbeenfullyinformedofhisrights,thenatureofhispleas,andtheconsequencesthereof.ThecourtspecificallymadeafindingoffactthattrialcounselhadprovidedexcellentrepresentationfullywithinthescopeofBaxterv.Rose,523S.W.2d930(Tenn.1975). Thefindingsoffactmadebyatrialjudgeinpostconvictionhearingsareconclusiveonappealunlesstheappellatecourtfindsthattheevidencepreponderatesagainstthejudgment.Butlerv.State,789S.W.2d898,899(Tenn.1990).ThisCourtissatisfiedthatPetitionerwasfullyawareoftheconsecutivesentencing,andthatinordertoreceivethesixteen(16)yearofferextendedbytheStatethathewouldpleadguiltytoallofthechargespendingagainsthim,includingthekidnappingcharge.TherecordclearlyshowsthatPetitionerenteredtheseguiltypleasafterhavingbeenfullyinformedofhisrights,thenatureofhispleas,andtheconsequencesthereof.TherecordalsoclearlyshowsthatPetitionerdidreceivetheeffectiveassistanceofcounsel.
