Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourtpursuanttoCourtofCriminalAppealsRule20. HamiltonCountylawenforcementarrestedAppellantonNovember4,1995,fordrivingundertheinfluence,possessionofmarijuana,andforpossessionofdrugparaphernalia.AppellantrefusedtosubmittoabreathalcoholtestandwasincarceratedintheHamiltonCountyjail.Appellantwasheldincustodyfornineandonehalfhoursbeforebeingreleasedonbailintohisfatherscustody. TheHamiltonCountyjailhasapolicyrequiringthatanyonearrestedforDrivingUndertheInfluencemustbedetainedinthatfacilityforatleastsixhours.Thecountysherifftestifiedthatthispolicyisbaseduponpublicsafetyconsiderations.InAppellantscase,AppellantsfatherpostedbondforAppellantapproximatelyfivehoursbeforeAppellantwasreleased.AfterthedenialofAppellantsmotiontodismiss,Appellantpledguiltywhilereservingthisquestionoflaw.   X   Ӝ WithrespecttoAppellantsdoublejeopardyissue,AppellantreliesuponthisCourtsdecisioninStatev.Pennington,C.C.A.No.0101937PB00219,DavidsonCounty(Tenn.Crim.App.,Nashville,Feb.1,1996)tosupporthiscontentionthatdetentionpursuanttoapolicyofdetainingarresteesafterarrestforD.U.I.makessubsequentprosecutionforD.U.I.violativeofdoublejeopardy.However,theSupremeCourtrecentlyreleasedStatev.Pennington,S.Ct.No.01S019607PB00133,DavidsonCounty(Tenn.,Sept.8,1997)overturningthisCourtsdecisioninthatmatter.Inthatopinion,theSupremeCourtspecificallyheldthatdetentionpoliciessuchastheoneatissueinthiscasedonotinvoketheprotectionsofdoublejeopardy.  ӜӜ8 8 Inthiscase,thepartiesstipulatedthatoneofthepurposesofthedetentionpolicywastokeepsuspecteddrunkdriversofftheroadforaperiodoftimeaftertheirarrest.Inotherwords,thepolicywasintended,atleastinpart,toprotectthepublicfromindividualswhohadbeenarrestedonsuspicionofdrivingundertheinfluence.Thisisaremedialpurpose,notapunitiveone,andtherefore,thedefendantsinitialappearancebeforethejudicialcommissionerdoesnotconstituteanessentiallycriminalproceedingbroughtto vindicatepublicjustice.
