Inhispostconvictionpetition,thepetitionerallegesthathistrialcounselwasineffectiveandthathisguiltypleawasnotenteredfreelyandvoluntarily.Heallegedinhispetitionthathiscounseltoldhimhewouldbeoutofprisoninsixyearswheninactuality,hewouldhavetoserveseventeenyearsbeforebecomingeligibleforparole.Hefurtherallegedthatbecauseheonlyhasaseventhgradeeducation,hewasunawarethathehadtobringthesecomplaintsbeforethecourtwithinthreeyearsofhisconvictionbecomingfinal.Thus,hearguesthathispetitionshouldnotbebarredforfallingoutsidethestatuteoflimitations.  Atthetimethepetitionerwasconvicted,hehadthreeyearsfromthedatehisconvictionbecamefinaltofilehispostconvictionpetition.T.C.A.4030102(1990). )   כHispetitionwasfilednearlyfiveyearsafterhepledguilty;thusheisclearlyoutsidethelimitationsperiod.However,thepetitionerurgesthisCourttodispensewiththetimingrequirementbecausethepetitionerwasilleducatedandwasunabletohireanattorneytohelphimunderstandthelegalprocess.ThisCourthaspreviouslyheldthatignoranceofthestatuteoflimitationsisnotanexcuseforfailingtotimelyfileapostconvictionpetition.Brownv.State,928S.W.2d453,456(Tenn.Crim.App.1996).Wehavealsoheldthatthestatuteoflimitationsisnotaffectedbywhenapetitioner learnsthathisconstitutionalrightsmighthavebeenviolated.Passarellav.State,891S.W.2d619,625(Tenn.Crim.App.1994).AsthisCourthaspreviouslystated,   \ ӜThePostConvictionProcedureActisnotaconstitutionallymandatedprocedureandthisCourthasrepeatedlyheldthatthelegislaturecouldproperlyimposelimitationsuponthetimeinwhichthecauseofactionarisingundertheactmustbebrought.Thereisnothingintheacttoindicatethatthelegislatureintendedforthisprovisiontoapplyonlytocertainpetitioners.ForthisCourttonowattempttocarveexceptionswoulddefeatthepurposeoftheact.Wearenotpreparedtoholdthatthefactsallegedbythepetitionertolledtherunningofthethreeyearlimitation.
