H Waddellalsoheardthefurnacedooropenandclosewhenthedefendantwentdownstairs. . ~   WaddellandthedefendantpassedbyMyrtsPackageStoreaftertheylefttheresidence.  J WhenWaddellsawthepolicecarsandaskedwhatwasgoingon,thedefendantsaid, Ithink  0 IvehurtJ.D.(Chapman).MeandJ.D.gotinafight.WhenWaddellstoppedforgaslater,the    defendantsaidhewouldpayandpulledoutseveralbills,including5s,10s,and20s.When    askedwherehehadgottenthemoney,thedefendantreplied, Darrell,IthinkIvekilledMyrt.   Hethensaid, Sheseenmegettingintohermoneybag.ThedefendanttoldWaddellthatMyrt x  hithimontheheadwithastick.Aftertheyattendedanauctionthatevening,thedefendant ^  askedWaddellnotto tellonme8Ifyoudonttellnobody,nobodywontknow. D    Waddellthenrelatedthatahandheldhatchetkeptatawoodpilenearthefurniturestore ` haddisappearedbetweenSunday,March24th,andMonday,March25th.Hetestifiedthathehad F lookedforthehatchetsincethenbuthadneverfoundit. ,   Herrellsaidthathenoticedaknotonthedefendantsheadwhenhearrivedatthe  furniturestoreontheafternoonofMarch25th.AfterHerrellgavethedefendantaride,the  defendantpaidforhisgas.Hesawthedefendantthrowthevestjackethecarriedunderneathhis t armintoadumpster.Herrellsaidthathedetectedthebrownsplotchesonthedefendantspants. Z Afterhethrewthejacketintothetrash,thedefendanttoldHerrellhethoughthehadkilled @ someone.AlterHerrelldroppedthedefendantoff,henoticedaoneandonehalffootlong &v hatchetleftonthefloorboardofhiscar.Itwasstainedbythesamebrowncoloronthe  \ defendantspants.Herrellthrewthehatchetintoalakebutnevertoldanyoneaboutituntilthe B dayofthetrial.Herrelladmittedtoadrugaddictionandsoughttreatmentseveralmonthsafter ( theincident.    DetectiveMikeLett,afterconductinginterviewsofcertainwitnesses,foundthe   defendantsshirtandvestinthetrashdumpster.Afteracquiringasearchwarrantforthe p!  defendantsresidence,hesearchedtheashesofthedefendantsfurnace.Hefoundseveralmetal V"! pieceswhichcouldhavecomefromburnedjeans. <#"   Aserologistwhomadeananalysisoftheshirtandvestfoundbloodstainsconsistent %X $ withthatofboththedefendantandthevictim.Hefoundbloodonthevictimsglasseswhich %>!% wasconsistentwiththatofboththevictimandthedefendant. &$"&   Ametallurgisttestifiedthatthemetalpiecesfromtheasheswererivetsandfastners (#( similartothoseusedinthegarmentindustrytomakejeans. )$)   l*%*   Defensepresentedthreewitnesses.CharlesCoxtestifiedhesawabluetruckparkedat  MyrtsPackagestoreonMarch25th.Thetimewasestablishedat6:00to6:15P.M.byBernice  Nance. |    Thedefendantsmothertestifiedthatsheusuallyobtainedtheclothessheworeatyard H salesorfromdonations.Shesaidshecommonlyburnedanyclothesthatshecouldnotuseinher . ~ basementfurnace.  d     Inthispostconvictioncase,thePetitioneroriginallyassignedseveralissues,butpriorto  0 thepostconvictionhearinginthetrialCourt,thePetitionerconcededthattheonlyissuefor    considerationwaswhetherthePetitionerwasdeniedtheeffectiveassistanceofcounselondirect    appealduetothefailureofhisattorneystoraisetheissueofwhetherthetrialcourterredby   failingtoinstructthejuryastotheoffenseofseconddegreemurder.Therecordrevealsthat x  trialCounselrequestedthetrialCourttochargethejuryastoseconddegreemurderwhichwas ^  declinedbythetrialCourt.CounselforthePetitionerdidnotraisethisasanissueondirect D  appeal.ThePostConvictionCourtfoundthatunderthelawineffectatthetimeofthetrial, *z  therewasnolegalbasisuponwhichtomandateachargeofseconddegreemurderasalesser ` includedoffenseoffelonymurderandthatthereforecounselwasnotdeficientforfailingtoraise F theissueondirectappealfromhisconvictionforfelonymurder. ,   Atthepostconvictionhearing,theattorneysfortheDefendantattrialandonappealboth  testified.Therecordrevealsthattheyarewellqualifiedandexperiencedcriminallawyers,  specificallytheyhaveextensiveexperienceinhomicidecases.Mostoftheirtestimonywastheir t recollectionoftheevidenceattrial.However,wegrantedthePetitionersmotiontotakejudicial Z noticeofthetrialrecordandwehavereviewedthetrialrecordwhichiscomprisedof @ approximatelytwelve(12)volumes.Defenseattorneystestifiedthattheypresentedsix(6) &v issuestothiscourtondirectappealandfour(4)oftheissueswerefoundtohavemerit,butthat  \ theerrorscommittedattrialwereharmless.Counseltestifiedthattheydidnotwanttoclutter B theirappealwithfrivolousissuesandtheydidnotthinkthatachargeofseconddegreemurder ( wasappropriatebecauseofthelackofproofofseconddegreemurder.TheAssistantDistrict  AttorneyGeneralthatprosecutedthiscasestatedthatheconsideredaskingforthedeathpenalty,  butdidnotseekthedeathpenaltybecauseofthedefensecounselssuccessingettinga   confessionmadebythePetitionersurpressed. p!    Tosustainapetitionforpostconvictionrelieffiledpriorto1995,adefendantmustprove <#" hisorherfactualallegationsbyapreponderanceoftheevidenceatanevidentiaryhearing.See "$r# Davisvs.State,912S.W.2d694,697(Tenn.1995).Uponreview,thiscourtwillnotreweighor %X $ reevaluatetheevidencebelow;allquestionsconcerningthecreditabilityofwitnesses,the %>!% weightandvaluetobegiventheirtestimony,andthefactualissuesraisedbytheevidenceareto &$"& beresolvedbythetrialjudge,nottheappellatecourts.Momenvs.State,18S.W.3d152,156 ' #' (Tenn.1999).Theissueofineffectiveassistanceofcounselpresentsmixedquestionsoflawand (#( fact,wereviewedthisissuedenovo,withapresumptionofcorrectnessgivenonlytothepost )$) convictioncourtsfindingoffact.Fieldsvs.State,40S.W.3d450,458(Tenn.2001).Boththe l*%* SixthAmendmenttotheUnitedStatesConstitutionandArticleI9oftheTennessee R+&+ ConstitutionguaranteetheDefendanttherighttorepresentationbycounsel.Statevs.Burns,6 8,', S.W.3d453,461(Tenn.1999).Todeterminewhethercounselprovidedeffectiveassistanceat  trial,thecourtmustdecidewhethercounselsperformancewaswithintherangeofcompetence  demandedofattorneysincriminalcases.Baxtervs.Rose,523S.W.2d930,936(Tenn.1975). | Whenreviewingaclaimthatcounselsfailuretoraiseanissueonappealamountedtoadeficit b performanceorresultinprejudicetotheDefendant,adeterminationastothesubstanceofa H claimisessential.SeeKimmelmanvs.Morrison,477U.S.365,375,106S.Ct.2574,2583,91 . ~ L.ed.2d305(1986)(Toprevailonineffectivenessofaclaiminvolvingcounselsfailuretoraise  d legalissueonappeal,Defendantmustshowthatissuehasmerit).SincethePetitionerclaims  J thathiscounselwasineffectivebyfailingtoraisetheissueofalesserincludedinstructionon  0 directappeal,wemustconsiderthemeritsoftheissuetodeterminewhethertheissuewould    havewarrantedreliefifbroughtondirectappeal,andthereforewhetherhiscounselsfailureto    raisethisissueresultedinprejudicetothePetitioner.     Aspreviouslystated,thetrialcourtdeniedarequestbythedefensetochargethejuryon ^  seconddegreemurderasalesserincludedoffensetofirstdegreemurder.Trialcounseldidnot D  presentthisasanissueondirectappeal.ThePetitionerinsistthatthisisreversibleerrorashe *z  wasentitledtoaninstructiononseconddegreemurderasalesserincludedoffensetofirstdegree ` murderunderT.C.A.402518(nowrepealed,)andreplacedbyT.C.A.4018110(a).The F statuteplacesadutyontrialjudgesincriminalprosecutionsofanyfelonywhereintwoormore , gradesareincludedintheindictment,tochargethejuryastoallofthelawofeachincluded  offenseintheindictment.      InStatevs.Atkins,681S.W.2d571(Tenn.Crim.App.1984),certioraridenied105S. t Ct.1395,84L.ed.2d784,itwasheld:Ifthereisevidencereasonablemindscouldacceptasto Z anysuchlesseroffenses,theaccusedisentitledtoappropriateinstructionsregardingthelesser @ offenses.Johnsonvs.State,531S.W.2d558(Tenn.1975);T.C.A.4018110(a).However, &v thepracticeofcharginglesserincludedoffenseswherethereisnoevidencetosupportthem,is  \ notfavored.Statevs.Mellons,557S.W.2d497(Tenn.1977);Whitwellvs.State,520S.W.2d B 338(Tenn.1975). (   TheaboverulewasappliedinStatevs.King,718S.W.2d241,245(Tenn.1986),  whereinadefendantwasindictedforbothpremeditatedmurderandfelonymurder.Thejury   convictedoffelonymurderonly.Thetrialjudgedidnotchargethejurywithrespecttosecond p!  degreemurder,butchargedonlyfirstdegreepremeditatedmurderandfelonymurder.Similarly, V"! theaboverulewasappliedinStatevs.Vann,976S.W.2d93,100101(Tenn.1998).The <#" defendantwaschargedwithbothfirstdegreepremeditatedmurderandfelonymurder,butthe "$r# trialjudgegavenoinstructionsonthelesseroffenseofseconddegreemurder.Thedefendant %X $ wasconvictedoffelonymurderonly.TheSupremeCourtheldthatthetrialcourtdidnoterrin %>!% failingtochangeseconddegreemurderastherewasnoevidenceofseconddegreemurder. &$"&   TheDefendantdidnottestifyinthiscaseandofferednoevidencecontradictingthe (#( statesevidence,includingthetestimonyofthewitnessesHarrellandWaddell. )$)   ThePetitionerarguesthathisconvictionforthekillingcommittedintheperpetrationof R+&+ robberyandhisacquittalofthecountcharginghimwithrobberyisinconsistent.However,the 8,', verdictonamultiplecountindictmentdoesnothavetobeconsistentastoeachcount.Statevs.  Allen,692S.W.2d651(Tenn.Crim.App.1985).Moreover,theverdictacquittingthe  Petitionerofrobberyisnotincontemplationoflawinconsistentwiththefindingofguiltasto | thefelonymurdercount.TheConstitutionalprovisionsprohibitingdoublejeopardywould b prohibitaconvictionofbothrobberyandmurderintheperpetrationofrobbery.Statevs.Norris, H 684S.W.2d650(Tenn.Crim.App.1984). . ~   ThePetitionerfurtherpointsoutthattherewasconsiderableevidenceattrialimpeaching  J thetestimonyofthewitnessesHerrellandWaddell.Wemustobservehowever,thattherewas  0 abundantuncontradictedevidencesupportingthetestimonyofthesewitnessesandnone    contradictingit.Inanyevent,thecreditabilityofwitnessesisdeterminedbythejuryandnot    appellatecourts.
