Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourtpursuanttoCourtofCriminalAppealsRule20. TheDavidsonCountygrandjuryindictedAppellantontwocountsofaggravatedrape.Accordingtothepetition,thefirstindictmentcomplainedofreadsasfollows:8 0 ThatGeorgeWilliam"Sonny"Carroll...onthe11th8 0 dayofJuly,1987,...intheCountyaforesaid,8 0 unlawfullyandfeloniouslydidengageinsexual8 0 penetrationof[nameomitted],achildlessthan8 0 thirteen(13)yearsofage,contrarytoTennesseeCode8 0 Annotated,Section392603,andagainstthepeace8 0 anddignityoftheStateofTennessee. 7 5 XXdXXd7 BoththeSixthAmendmenttotheUnitedStatesConstitutionandArticleI,9oftheTennesseeConstitutionaffordtheaccusedtherighttobeinformedofthe"natureandcauseoftheaccusation."Moreover,ourlegislaturehasprescribedthecontentsofindictments.Tenn.CodeAnn.4013202provides:8 0 Theindictmentmuststatethefactsconstitutingtheoffenseinordinaryandconciselanguage,withoutprolixityorrepetition,insuchamannerastoenableapersonofcommonunderstandingtoknowwhatisintended,andwiththatdegreeofcertaintywhichwillenablethecourt,onconviction,topronouncetheproperjudgment;andinnocasearesuchwordsas"forceandarms"or"contrarytotheformofthestatute"necessary.Tenn.CodeAnn.4013202. TheTennesseeSupremeCourt'sdecisioninStatev.Hillgovernsthedispositionofthecasesubjudice.954S.W.2d725(Tenn.1997).TheHillcourtheldthat:8 0 [F]oroffenseswhichneitherexpresslyrequirenorplainlydispensewiththerequirementforaculpablementalstate,anindictmentwhichfailstoallegesuchmentalstatewillbesufficienttosupportprosecutionandconvictionforthatoffensesolongas(1)thelanguageoftheindictmentissufficienttomeettheconstitutionalrequirementsofnoticetotheaccusedofthechargeagainstwhichtheaccusedmustdefend,adequatebasisforentryofaproperjudgment,andprotectionfromdoublejeopardy;(2)theformoftheindictmentmeetstherequirementsofTenn.CodeAnn.4013202;and(3)thementalstatecanbelogicallyinferredfromtheconductalleged.Id.at72627.
