TheappellantisservingtwoconcurrentlifesentencesintheColdCreekCorrectionalFacilityinLauderdaleCountybasedonguiltypleastoarmedrobberyinJeffersonandSevierCounties.ThisCourtaffirmedthedismissaloftheappellantsmultiplepostconvictionpetitionsinApril1988,June1992,February1994,andMay1994. InSeptember1997,theappellantfiledthepresentpetitionforhabeascorpusrelief.Heallegedthathisconvictionswerenullandvoidbecausehisguiltypleaswerenotvoluntarilyandintelligentlymade.Heaverredthathisrightstodueprocessandequalprotectionwereviolatedbecauseofthecourtsfailuretoadvisetheappellantthatanotherdefendantsconvictionswerebeingusedtoenhancehissentence.Thetrialcourtdismissedthepetition,holdingthattheappellantfailedtoallegeaclaimforhabeascorpusrelief. HabeascorpusreliefisavailableinTennesseeonlywhenitappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendant'ssentenceofimprisonmentorotherrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993);seeTenn.CodeAnn.2921101(1980).Ifacourtiswithoutjurisdictionorauthoritytosentenceadefendant,thenthejudgmentisvoid.Passarellav.State,891S.W.2d619,626(Tenn.Crim.App.1994).Otherwise,thejudgmentisvoidableandsubjecttoreviewbyapetitionforpostconvictionrelief.Id. Theappellantarguesthatthecourtlackedjurisdictiontoenhancehissentencebaseduponsomeoneelsesconvictions.Inhisbrief,theappellantexplainsthatheisCaucasian,andthattheFayetteCountyrecordofLarryϜLaverneCatron,anAfricanAmerican,wasusedtodeterminehissentenceatthehearingonhisguiltyplea.HecontendsthathedidnotfindoutaboutthemistakeuntiltheappealofhispostconvictionpetitionfromtheJeffersonCountyCriminalCourt.SeeCatronv.State,No.03C019112CR394(Tenn.Crim.͜App.,filedatKnoxvilleJune24,1992).Theissueinthatpostconvictionpetitionwaswhethertheappellantvoluntarilyandknowinglyenteredhisguiltypleawhenthetrialcourtallegedlyfailedtoadvisehimofhisrightagainstselfincrimination.Inthatappeal,theassistantattorneygeneralreferredtoLarryLaverneCatroninthestatesbrief.Inthestatementofthefacts,thestatewrotethatduringtheJeffersonCountypleahearing,thetrialcourtreferredtotheappellantsothercasesinFayetteCountyandothercounties.Theassistantattorneygeneralalsowrotethat[t]hetrialjudgewasfamiliarwithtwoofthepetitionersotherhearingsandbeforehediscussedapleafortheinstantoffenses,heaskedthedefendantabouthisothercases.Thetrialjudgerememberedthatthepetitionerhadpledguiltytosimilarcharges(armedrobberyandburglary)inSevierCounty....Thetrialjudgeknewthat,inanothercase,thedefendanthadbeenconvictedinajurytrial.Statev.LarryLaverneCatron,FayetteCounty,CCANo.4,opinionfiledMarch6,1985.WefailtoseeanyreferencetoLarryLaverneCatronasanAfricanAmericanintherecordbeforeus.Furthermore,assumingthattheappellantssentencewasimproperlydetermined,itappearsthatthetrialjudgereferredtotheFayetteCountyconvictionsattheJeffersonCountyguiltypleahearinginfrontoftheappellant.TheappellantapparentlyhasnoFayetteCountyconvictions. Theappellantdoesnotarguethathissentencewasunauthorizedbylaw,onlythathissentencewasimproperlydetermined.Thisisnotacognizablegroundforhabeascorpusrelief.Theappellantcouldhavecorrectedthetrialcourtatthepleahearing,discusseditwithhisattorneyafterthehearing,orfiledapetitionforpostconvictionrelief.Theappellantdidnotraisetheissueinhispreviousmultiplepostconvictionpetitions.Hislasttwopetitionsweredismissedasbarredbythestatuteoflimitations.Itappearsthattheappellantshouldhaveknownofamistake,iftherewasamistake,attheguiltypleahearing,notatthetimeoftheappealofhissecondpostconvictionpetition,asheclaims.Fromtherecordbeforeus,wefailtoseehowhisSevierCountyguiltypleaandlifesentencearevoid. Appellanthasfailedtostateacognizablegroundforhabeascorpusrelief.Itwouldbeimproperforthetrialcourttotreatthepetitionasoneforpostconvictionrelief.Thepetitionwasfiledinthewrongcounty,andtheoneyearstatuteoflimitationshasrun.
