OnAugust14,1996,theappellantpledguiltytopossessionofcocainewiththeintenttosell,aClassCfelony;deliveryofcocaine,aClassCfelony;contributingtothedelinquencyofaminor,aClassAmisdemeanor;andsellingover.5gramsofcocaine,aClassBfelony.Thetrialcourtsentencedtheappellanttoconcurrenttermsofthree(3)yearsforthepossessionanddeliveryofcocaine,eleven(11)monthsand(29)daysforcontributingtothedelinquencyofaminor,andeight(8)yearsforthesellingofover.5gramsofcocaine.Theeffectiveeight(8)yearsentencewastobesuspendedupontheserviceof120daysinthecountyjail. OnAugust15,1996,onedayfollowingappellantspleahearing,theappellantwasarrestedforcriminaltrespassandthepossessionofcrackcocaine.ThosechargesarosefromhisactivitiesattheColumbiaHousingAuthority(C.H.A.)inMauryCounty,Tennessee.Afterhisarrest,aprobationviolationwarrantwasissuedandthetrialcourtconductedanevidentiaryhearing. )   ׀ OfficerChristopherMunz,withtheColumbiaPoliceDepartment,testifiedthathefirstobservedtheappellantintheC.H.A.onthedayofappellantspleahearing.Theappellantwasstandinginagrassyyardat1219McBrideCircle.OfficerMunztoldtheappellantthatduetohiscriminalhistory,hispresenceintheC.H.A.constitutedcriminaltrespass. +   ׀ TheC.H.A.hasapolicythatanynonresidentwithacriminalhistoryinvolvingdrugrelatedorviolentoffensesisconsideredathreattothehousingresidents.Assuch,nonresidentswithcriminalrecordsareprohibitedfromenteringontoprivatepropertywithintheC.H.A..OfficerMunzexplainedtheC.H.A.policytoappellantandtoldhimthathemustleavethehousingareaandnotreturn.AppellantcompliedwithOfficersMunzswarningonAugust14;however,hereturnedtothesamepropertyonthefollowingday. OnAugust15,whileexecutingasearchwarrantintheC.H.A.,OfficerMunzandofficerswiththeMauryCountyDrugTaskForceobservedappellantat1219McBrideCircle.Theappellantwasstandinginthefrontyardwithanotherman,ϜDarnellMoore,whenpoliceofficersapproachedthetwomenandorderedthemtolayontheground.OfficersTommyGoatsandLonnieLyleswiththeDrugTaskForcetestifiedthattheynoticedtheappellantholdingsomethinginhishandbeforehewasapprehended.OfficerGoatsstatedthatheobservedtheappellantmakeathrowinggestureasifhewerediscardingtheobjectthatwasinhishand. Althoughofficerssuspectedthattheappellantpossessedillegalcontraband,nodrugswerefoundonhispersonatthescene.AnemptymedicinebottlewasdiscoverednearbyunderaparkedcarandDarnellMoorehadcrackcocaineinhispossession.Theappellantwasarrestedforcriminaltrespassandpossessionofcocaine. Appellantsmother,LoveyFayeCecil,testifiedforthedefensethattheappellanthadbeenhelpingheronthedayofhisarrest.Ms.CecillivedinColumbiaat1515RyanPlace,approximatelytwoblocksfromtheC.H.A..Shestatedthatshehadnotransportationofherownandthattheappellanthadassistedherinpickinguphisyoungerbrotherandthebrothersmedicationearlierintheday. ThetrialcourtdeterminedthattherewassufficientevidencethattheappellantcommittedcriminaltrespasswhenheenteredtheresidentialpropertyonMcBrideCircle. ,   ׀Thecourt,therefore,revokedappellantsprobationandorderedhimtoservehiseight(8)yearsentenceintheDepartmentofCorrection. Onappeal,theappellantcontendsthatthetrialcourtabuseditsdiscretioninfindingthatheviolatedthetermsofhisprobation.Wedisagree. Theappellantconcedesthatthetrialcourtwasempoweredtorevokehisprobationandordertheexecutionoftheoriginaljudgmentuponfindingbyapreponderanceoftheevidencethatappellantviolatedtheconditionsofhisprobation.Tenn.CodeAnn.4035311(d)(Supp.1996).Moreover,therevocationofaprobationarysentenceiscommittedtothesounddiscretionofthetrialjudgeandwillbesustainedonappealiftheevidenceissufficienttoallowthetrialjudgetorenderaconscientiousandintelligentdecision.SeeStatev.Harkins,811S.W.2d79,82(Tenn.1991);Statev.Milton,673S.W.2d555,557(Tenn.Crim.App.1984).
