Inhispetitionforwritofhabeascorpusrelief,thepetitionerassertedthathewasbeingillegallyrestrainedbecausethepreliminaryhearingonhispendingchargeswasconductedbeyondthe10daytimeperiodprescribedbyTenn.R.Crim.P.5(d).ItappearsthatwhilethepetitionerwasarrestedonJanuary31,1997,hispreliminaryhearingwasnothelduntilFebruary28,1997.Subsequently,thepetitionerwasindictedbythegrandjuryofCoffeeCountyonMarch4,1997,andarraignedonMarch11,1997.  Indenyingrelief,thetrialcourtstated:8 ComestheDistrictAttorneyGeneralandmovestheCourtforleavetoenteraDismissalinthiscause,anditappearingtotheCourtthatsaidmotioniswelltaken,andshouldbegranted,becausethepaperwritingfailstoallegeillegalrestraintanduponbeingquestionedinopencourtifhewasclaimingillegalrestraintthedefendantreplied, No.TheCourtfindsthatthepaperwritingfailes[sic]tocomplywiththemandatoryprovisionsofT.C.A.2921107.
