Theappellant,MichaelA.ChaneyappealsasofrighttheorderoftheCircuitCourtofDicksonCourtrevokinghisprobation.OnMay13,1996,thetrialcourtenteredajudgmentofconvictionpursuanttotheappellantspleaofguilttoonecountofvehicularhomicide,aClassCfelony.ThetrialcourtsentencedtheappellanttothreeyearsincarcerationintheTennesseeDepartmentofCorrection,butsuspendedtheappellantssentenceandplacedhimonsupervisedprobation.Specialconditionsoftheappellantsprobationincludedpayingcourtcostsandcompletingtwohundredhoursofcommunityservice.OnDecember4,1997,thetrialcourtrevokedtheappellantsprobationandorderedthattheappellantservehissentenceintheTennesseeDepartmentofCorrection.Followingareviewoftherecordinthiscase,wereversethejudgmentofthetrialcourt. ThetrialcourtissuedtheprobationrevocationwarrantonNovember7,1997,pursuanttotheprobationofficersaffidavit.Theprobationofficerallegedinhisaffidavitthattheappellanthadbeenarrestedandchargedwithseveraldrugrelatedoffenses,hadfailedtoperformanycommunityservice,andowed$1624.00incourtcosts.̛̜  )      ThetrialcourtissuedtheprobationrevocationhearingonNovember25,1997.Atthehearing,thatStatepresentedthetestimonyofCliffSlayton,theϜappellantsprobationofficer.Mr.SlaytontestifiedthattheappellantwasassignedtohimonMay13,1996.Hefurtherstatedthathehadreviewedtheconditionsoftheappellantsprobationwiththeappellantandthattheappellanthadaffirmedthatheunderstoodthoseconditions.Mr.Slaytonconfirmedthattheappellanthadbeenarrestedandchargedwithseveraldrugrelatedoffensesandthatthosecaseswere 815 stillpending.Additionally,heconfirmedthattheappellanthadnotperformedanycommunityserviceduringthealmosteighteenmonthsofhisprobation."(D   1      ׀Finally,he  testifiedthattheappellantcurrentlyowed$1,624.00infinesandcourtcosts.However,heconcededthattheappellanthadoriginallyowed$3,289.00andwasmoreorlessonschedulewithrespecttothepaymentofthesefinesandcosts.Heconcludedthathehadprimarilyissuedthewarrantduetotheappellantsrecentarrest.̛̜ Inrevokingtheappellantsprobation,thetrialcourtdeclinedtoconsiderthechargespendingagainsttheappellant.MGA   2      כThetrialcourtrevokedtheappellants  probationduetohisfailuretoperformanycommunityservice.Onappeal,theappellantarguesthat,becauseMr.SlaytondidnottestifyconcerningtheappellantsscheduleforcompletingcommunityserviceandbecausethePublicServiceWorkCoordinatordidnottestifyattheprobationrevocationhearing,therecorddoesnotsupportthetrialcourtsexerciseofdiscretion.( +( J    3      ׀Essentially,theappellantargues H!@ thateighteenmonthsofhisprobationaryperiodremainedinwhichhecouldcompletethetwohundredhoursofcommunityserviceorderedbythetrialcourt. Atrialcourtmayrevokeadefendantsprobationwhenitfindsthattheprobationerhasviolatedtheconditionsofprobation.SeeTenn.CodeAnn.4035 *#& 310(1997).Indeterminedwhetherornottoorderrevocation,thetrialjudgeneednotfindbeyondareasonabledoubtthataviolationoftheconditionsofprobationhasoccurred.Theexistenceofaviolationneedonlybesupportedbyapreponderanceoftheevidence.Tenn.CodeAnn.4035311(d)(1996).Onappeal,therecordmustdemonstratethatthetrialjudgehasnotactedarbitrarily,andhasexercisedconscientiousjudgment.Statev.Harkins,811S.W.2d79,82 h`  (Tenn.1991):Statev.Gregory,946S.W.2d829,832(Tenn.Crim.App.1997).In H@  otherwords,thiscourtwillnotreversethejudgmentofthetrialcourtabsentanabuseofdiscretion,reflectedintherecordbyanabsenceofsubstantialevidencetosupportthetrialjudgesfindings.Id.byanabsenceofsubstantialevidencetosupportthetrialjudgesfindings.Id.   Wemustagreewiththeappellantthatthereisanabsenceofsubstantialevidenceintherecordtosupportthejudgmentofthetrialcourt.Asnoteabove,whiletheStateneednotestablishaviolationofprobationbeyondareasonabledoubt,theStatemustpresentsufficientevidencetopermitaconscientiousjudgmentbythetrialcourt.Intheinstantcase,therecordreflectsonlythattheappellantwasonscheduleinpayingcourtcostsorderedbythecourtandhadsufficienttimeremainingonprobationinwhichtocompletehiscommunityservice.Theorderofprobationdoesnotreflecttheimpositionofanyscheduleaccordingtowhichtheappellantwastocompletehiscommunityservice.TheStatedeclinedtopresenttestimonybyeitherMr.SlaytonorMr.Deavorsconcerningascheduleofcommunityservice.Indeed,Mr.Slaytonstestimonysuggestedthathewouldnothaveissuedtheprobationviolationwarrantsolelyonthebasisoftheappellantsfailuretocompleteanyportionofhiscommunityservice.
