TheTBIsubpoenaissuedforthedefendantcommandedhimtoappearforquestioningattheGrundyCountyJail.Thelanguageofthesubpoena,quotedsupraatnote27,iscompulsory.Thereisnoindicationonthesubpoenathatthedefendanthadtheoptionofrefusingtoappearattheappointedtimeandplace.Thereisnothingindicatingthat,unlikeothersubpoenas,thisonewasnotenforceablethroughthecontemptpowersofthecourt.Apersonuntrainedinthelawcouldreasonablybelievehehadnochoicewhethertocomplywiththissubpoena.Ifarecordreflectsthattheaccusedwasinfactcoercedthroughtheuseofsuchasubpoenainacriminalinvestigation,theuseofthesubpoenawouldraise)7"<XXdXXd7    substantialquestionsundertheFourthAmendmenttotheUnitedStatesConstitutionandArticleI,section7oftheTennesseeConstitution.TheuseofaninvestigativesubpoenabytheTBIinthecourseofacriminalinvestigationcannotcircumventFourthAmendmentprotectionsbycausinganunlawfulseizureoftheperson.Cf.Statev.Moore,722S.W.2d367,373(Tenn.1986)(inthecontextofacivilinvestigativesummonsissuedbytheDepartmentofRevenuerelativetobankrecordspertainingtoanindividual'staxliability,"civilinvestigativeauthoritywillnotpermitthegovernmenttoexpanditscriminaldiscoverypowers").SeeTerryv.Ohio,392U.S.1,19,88S.Ct.1868,1879(1968).  Thatsaid,acitizenmaycertainlyagreetocooperatewithlawenforcement.Whencompliancewithaninvestigationisvoluntary,constitutionalconcernsofunreasonablesearchandseizureevaporate.SeeSchnecklothv.Bustamonte,412U.S.218,219,93S.Ct.2041,204344(1973)(citationsomitted);Statev.Bartram,925S.W.2d227,230(Tenn.1996)(citationsomitted).Inthiscase,alloftheevidencedemonstratesthedefendantcooperatedwiththeinvestigationpriortotheissuanceofthesubpoena.Moreover,heappearedatthetimeandplacedesignatedinthesubpoenaandnevervoicedanyobjectiontocontinuedparticipationintheinvestigativeprocess.Hegavefurtherconsentforbloodsamplestobedrawnfromhisperson.Thedefendantdidnottestifynoristhereanyotherevidencetoindicatethathiscompliancewiththesubpoenawasinvoluntary.Inthetotalabsenceofevidencedemonstratingnonconsensualbehaviorbythedefendant,Iagreewiththemajoritythattheevidencesupportsthetrialcourt'sdenialofthemotiontosuppress.      _______________________________      CURWOODWITT,JUDGE
