Ðemotionless,€he€had€been€followed€by€a€vocal€crowd€without€seemingÐ $X" Ðto€notice,€and€he€laughed€and€smiled€inappropriately€during€theÐ ô$D # Ðbooking€procedure.Ðà%0!$` x` x Ðà8  àà8` Ð Ð à€€ÐÌ&"%` x` x Ðà8  àà8` Ð Ð àDr.€David€Ciraulo,€a€trauma€critical€care€surgeon€at€Erlanger€MedicalÐ ¸'#& ÐCenter,€treated€Newman€following€the€assault.€€He€reported€thatÐ ¤(ô#' ÐNewman€was€€hospitalized€for€three€to€four€days€following€hisÐ )à$( Ðinjuries.€€As€a€result€of€the€injuries,€including€a€closed€head€injury,Ð |*Ì%) ÐNewman€suffered€extreme€pain€and€extensive€blood€loss.€€At€the€timeÐ h+¸&* Ðof€discharge,€Newman€had€problems€maintaining€his€gait€and€wasÐ ° Ðsent€home€with€a€walker.€€Newman€also€complained€of€headaches€andÐ œì Ðmemory€problems.€€Dr.€Ciraulo€opined€that€such€an€injury€poses€aÐ ˆØ Ðsubstantial€risk€of€death.ÐtÄ` x` x ÐÌà8  àà8` Ð Ð àAfter€presenting€the€foregoing€proof,€the€State€rested.€€The€defenseÐ L œ Ðmoved€for€judgments€of€acquittal,€which€motions€were€denied.€Ð 8 ˆ ÐThereafter,€the€defense€presented€the€testimony€of€two€mental€healthÐ $ t Ðprofessionals,€Dr.€Bob€Brown€and€Dr.€Madhusudham€Mudiam.Ð `` x` x ÐÌà8  àà8` Ð Ð àDr.€Brown€testified€that€he€is€a€psychologist€and€is€employed€by€theÐ è 8  ÐState€of€Tennessee€at€Moccasin€Bend€Mental€Health€InstituteÐ Ô$  Ð(MBMHI).€€In€1998,€in€response€to€a€request€by€the€trial€court,€anÐ À  Ðevaluation€team€at€MBMHI€performed€a€forensic€evaluation€of€theÐ ¬ü  Ðappellant€for€the€court.€€Dr.€Brown,€a€member€of€the€team,€explainedÐ ˜è  Ðthat,€when€the€court€requests€a€forensic€evaluation,€typically€theÐ „Ô  Ðquestions€to€be€answered€are:€€whether€the€individual€is€competent€toÐ pÀ Ðstand€trial,€whether€the€individual€can€defend€himself€against€theÐ \¬ Ðcharges€in€a€court€of€law,€and€whether€there€is€support€for€the€insanityÐ H˜ Ðdefense.€€€Accordingly,€the€evaluator€must€determine€the€mental€stateÐ 4„ Ðof€the€individual€at€the€time€of€the€crime€as€well€as€at€the€time€of€trial.€Ð  p ÐDr.€Brown€stated€that,€of€all€cases€referred€by€the€courts€in€a€givenÐ  \ Ðyear,€only€four€percent€(4%)€to€six€percent€(6%)€can€support€anÐ øH Ðinsanity€defense.€€Dr.€Brown€stated€that€a€finding€of€incompetency€toÐ ä4 Ðstand€trial€is€also€rare.à8À` x` xàÐÐ ÀÀ Ðà8  àÐ Ð Ð  Ðà8  àà8` Ð Ð àIn€October€1998,€following€the€forensic€evaluation€at€MBMHI,€theÐ ¨ø Ðevaluation€team€deemed€the€appellant€incompetent€to€stand€trial€dueÐ ”ä Ðto€his€confusion€and€paranoia.€€Dr.€Brown€explained€that€the€appellantÐ €Ð Ðwas€unable€to€understand€the€charges€against€him,€was€unable€toÐ l¼ Ðcooperate€with€his€attorney,€did€not€understand€a€court€proceeding,Ð X ¨ Ðand€ð ðcould€not€even€manage€his€behavior€appropriately€in€aÐ D!” Ðcourtroom€setting.ðð€€Notably,€during€a€meeting€with€the€evaluationÐ 0"€  Ðteam,€the€appellant€claimed€that€ð ðDr.€Nickerson€is€the€judicial€judge.ðð€Ð #l! ÐDr.€Brown€concluded€that€the€appellant€was€in€need€of€ð ðextensive,Ð $X" Ðintensive,€inpatient€psychiatric€services.ðð€Ðô$D #` x` x ÐÌà8  àà8` Ð Ð àDr.€Brown€further€related€that€the€appellant€has€a€history€of€treatmentÐ Ì&"% Ðfor€mental€illness,€which€history€began€in€April€1980€when€theÐ ¸'#& Ðappellant€was€admitted€to€MBMHI€and€was€diagnosed€with€paranoidÐ ¤(ô#' Ðschizophrenia,€a€diagnosis€that€was€reiterated€in€later€years.€€Dr.Ð )à$( ÐBrown€explained€that€schizophrenia€is,€ð ðin€the€opinion€of€mostÐ |*Ì%) Ðmental€health€clinicians,€probably€the€most€severe€form€of€mentalÐ h+¸&* Ðillness.ðð€€Specifically€addressing€the€appellantððs€mental€condition€inÐ ° Ð1998,€Dr.€€Brown€noted€that€ð ð[he]€had€the€disorganized€behavior,Ð œì Ðwhich€is€one€of€the€prominent€features€[of€paranoid€schizophrenia].€Ð ˆØ ÐHe€could€not€adequately€monitor€his€behavior,€behave€himselfÐ tÄ Ðadequately€the€first€time€we€wanted€to€meet€with€him€and€the€secondÐ `° Ðtime,€we€had€to€terminate€because€he€was€so€agitated,€and€we€felt€thatÐ L œ Ðthe€[evaluation]€team€was€at€risk€of€being€harmed€by€his€behavior.ðð€Ð 8 ˆ ÐDr.€Brown€observed,€however,€that€someone€suffering€from€paranoidÐ $ t Ðschizophrenia€could€also€appear€superficially€normal.€Ð `` x` x Ѐ€€€Ð ü L  Ðà8  àà8` Ð Ð àDr.€Brown€additionally€recalled€that,€during€an€interview€onÐ è 8  ÐNovember€3,€1998,€the€appellant€told€the€evaluation€team€that€heÐ Ô$  Ðattacked€Newman€because€he€was€chosen€by€the€Lord€to€intervene€inÐ À  ÐNewmanððs€life.€€Additionally,€the€appellant€stated€that€ð ðSatan€savedÐ ¬ü  Ðmy€life.€€I€read€the€Bible€through€twice,€took€three€years.€€God€askedÐ ˜è  Ðme€to€rule€the€world.ðð€€Dr.€Brown€reported€that€the€appellant€thenÐ „Ô  Ðbegan€to€stare€at€the€members€of€the€team€and€laugh€inappropriately.€Ð pÀ ÐIt€was€on€this€occasion€that€the€interview€was€terminated€due€toÐ \¬ Ðconcern€that€the€team€was€at€ð ðrisk€of€harmðð€from€the€appellant.€€Dr.Ð H˜ ÐBrown€reported€that,€following€this€interview,€the€appellantÐ 4„ Ðresponded€well€to€antipsychotic€medication,€and,€on€November€12,Ð  p Ð1998,€he€was€discharged.€€At€that€time,€the€appellant€was€deemedÐ  \ Ðcompetent€to€stand€trial.€€However,€Dr.€Brown€asserted€that€theÐ øH Ðforensic€team€unanimously€concluded€that€an€insanity€defense€couldÐ ä4 Ðbe€supported.€€Following€his€discharge,€the€appellant€was€returned€toÐ Ð  Ðjail,€and€his€treatment€was€monitored€through€the€SheriffððsÐ ¼  ÐDepartment€by€Johnson€Mental€Health€Center.€Ð¨ø` x` x Ðà8  àà8` Ð Ð à€€€€Ð”ä` x` x Ðà8  àà8` Ð Ð àIn€early€2000,€the€trial€court€ordered€a€reevaluation€of€the€appellant.€Ð €Ð ÐThe€appellant€was€readmitted€to€MBMHI€on€February€16,€2000,€andÐ l¼ Ðan€evaluation€team€was€again€assembled€to€assess€the€appellant.׃ ×Ý ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€TheÐ X ¨ Ðteam€once€again€concluded€that€the€appellant€was€competent€to€standÐ D!” Ðtrial€but€noted€that€ð ð[i]t€has€been€determined€that€a€defense€of€insanityÐ 0"€  Ðon€the€charges€of€aggravated€assault€and€aggravated€robbery€can€beÐ #l! Ðsupported€on€the€basis€of€a€severe€mental€illness€as€a€result€of€aÐ $X" Ðpsychotic€spectrum€disorder,€in€[the€appellantððs]€case,€schizoaffectiveÐ ô$D # Ðdisorder.ððÐà%0!$` x` x Ðâ âÐ Ì&"% Ðà8  àà8` Ð Ð àSpecifically,€Dr.€Brown€explained€that€ð ð[t]he€conclusion€in€ðð98€andÐ ° Ðâ âin€2000€are€the€same.€€And€in€probably€the€most€basic€terms,€theÐ œì Ð[appellant]€could€not€appreciate€the€rightfulness€or€the€wrongfulnessÐ ˆØ Ðof€his€conductðð€because€ð ð[all]€the€data€that€we€have€availableÐ tÄ Ðindicates€that€he€was€suffering€from€the€acute€phase€of€schizophreniaÐ `° Ðat€the€time€of€the€alleged€offenses.ððÐL œ` x` x Ѐ€€Ð 8 ˆ Ðà8  àà8` Ð Ð àOn€cross„examination,€Dr.€Brown€conceded€that€there€were€someÐ $ t Ðinconsistencies€in€the€appellantððs€version€of€events.€€Dr.€Brown€alsoÐ  ` Ðacknowledged€that,€on€the€day€of€the€offenses,€the€appellant€was€inÐ ü L  Ðsufficient€control€of€his€behavior€to€go€into€the€bank€where€he€had€anÐ è 8  Ðaccount,€withdraw€funds€from€his€account,€and,€after€the€offenses,Ð Ô$  Ðsubmit€to€an€armed,€uniformed€police€officer.€€Finally,€Dr.€BrownÐ À  Ðadmitted€that,€during€the€2000€evaluation,€two€tests€showed€that€theÐ ¬ü  Ðappellant€was€malingering€to€gain€support€for€his€insanity€defense€andÐ ˜è  Ðto€show€his€innocence€of€the€crimes€charged.€€Nevertheless,€Dr.Ð „Ô  ÐBrown€maintained€that€the€malingering€was€taken€into€account€by€theÐ pÀ Ðteam€in€their€evaluation,€and€Dr.€Brown€unwaveringly€asserted€thatÐ \¬ Ðan€insanity€defense€could€be€supported.€€€ÐH˜` x` x Ðà  àà ` àÌà8  àà8` Ð Ð àThe€second€witness€to€testify€for€the€defense€was€Dr.€Mudiam,€aÐ  p Ðpsychiatrist€who€worked€at€MBMHI€and€was€a€member€of€theÐ  \ Ðforensic€team€that€evaluated€the€appellant€in€2000.€€At€the€time€of€Dr.Ð øH ÐMudiamððs€evaluation,€the€appellant€was€receiving€antipsychoticÐ ä4 Ðmedication.€€Dr.€Mudiam€testified€that€the€appellant€was€diagnosedÐ Ð  Ðwith€ð ðSchizoaffective€Disorder€and€what€that€means€is€a€personÐ ¼  Ðsometimes€in€the€course€of€the€mental€illness,€in€addition€to€theÐ ¨ø Ðsymptoms€that€are€primarily€associated€with€schizophrenia,€which€areÐ ”ä Ðlike€hearing€the€voices€that€are€not€there€or€feeling€like€people€are€outÐ €Ð Ðto€get€them.€The€patients€also€suffer€from€associated€symptoms€ofÐ l¼ Ðwhat€we€call€as€either€mania€or€depression.ððÐX ¨` x` x ÐÌà8  àà8` Ð Ð àAccording€to€Dr.€Mudiam,€the€appellant€exhibited€the€features€ofÐ 0"€  Ðmania,€namely€elation€and€excess€energy.€€He€opined€that€theÐ #l!
