DistrictAttorneyGeneral       DEREKK.SMITH        AssistantDistrictAttorneyGeneral       Courthouse,Ste.G6       P.O.Box937       Franklin,TN370650937 OPINIONFILED:򀀀 AFFIRMEDJOEG.RILEY,JUDGE 7\XXdXXd7@ OPINION  Petitioner,CharlesRayClem,appealsthedismissalofhispetitionforpostconvictionreliefbytheCircuitCourtofWilliamsonCounty.Petitionerpresentsthefollowingissuesforourreview:(1)whethermedicaltestimonywasimproperlyadmittedathisoriginaltrialunderthefreshcomplaintdoctrine;and(2)whethertheindictmentwasfatallydeficientforfailuretoproperlyallegethemensreaelementsofaggravatedrapeandrape.Weaffirmthejudgmentofthetrialcourt.@ PROCEDURALHISTORY  Petitionerwasconvictedoften(10)countsofaggravatedrapeandthree(3)countsofrapeandreceivedanaggregatesentenceofeighty(80)years.Theconvictionsandsentenceswereaffirmedbythiscourt.SeeStatev.CharlesRayClem,C.C.A.No.01C019207CC00207,WilliamsonCounty(Tenn.Crim.App.filedMarch18,1993,atNashville).ApplicationforpermissiontoappealtotheTennesseeSupremeCourtwassubsequentlydenied.Petitionertimelyfiledapetitionforpostconvictionrelief.Thepetitionwasdismissedafteranevidentiaryhearing.Itisfromthatdismissalthatpetitionerseeksthisappeal.0 @ FRESHCOMPLAINTTESTIMONY  Petitionercontendshisconstitutionalrighttodueprocesswasviolatedbytheadmissionattrialoftestimonyofaphysician.Thephysiciantestifiedthat [he]wasawareofanallegationoracomplaintofcontinuinganalsexandthathismedicalexaminationwasnotinconsistentwithsuchcomplaints. Dr.JoeMoss,apediatrician,testifiedattrialconcerninghisexaminationoftheminorvictimsattherequestofauthorities.Petitionernowattackstheadmissibilityofthefollowingtestimony: Q.8 Wereyouawareofanallegationoracomplaintofcontinuinganalsex? A.8 Thatscorrect. Q.8 Thatthesechildrenhadbeenanaly[sic]penetratedonnumerousoccasions? A. Yes.  Q.8 Doctor,isthatclaimorthatallegationinconsistentwithyourfindings,yourphysicalexamfindings? A. No. Q. Whynot? A.8 Becauseavasta[sic]majorityofsexuallyabusedchildrenhaveanormalphysicalexam.Andthevastmajoritybeingprobablysixtytoeightypercentonmostof themedicalstudieswedo.Therewasnoobjectionattrialtothistestimony. Atthetimeoftrialthefreshcomplaintdoctrinewasviable.Underthatdoctrinestatementsmadebychildvictimsaftersexualabusewereadmissibleasconfirmationoftheircredibility.SeeStatev.Brown,871S.W.2d492,493(Tenn.Crim.App.1993).Thefreshcomplaintdoctrinewassubsequentlyabolishedinitsentiretyandheldnottoapplytocasesinvolvingchildvictims.SeeStatev.Livingston,907S.W.2d392(Tenn.1995).Nevertheless,thecourtnotedthatevidenceinthenatureoffreshcomplaintmaybeadmissibleas(1)substantiveevidenceifitsatisfiessomehearsayexception,or(2)corroborativeevidenceifitsatisfiesthepriorconsistentstatementrule.Id.at395.  ThequestionedtestimonyisnotaviolationofLivingston.Firstly,thetestimonywasnotadmittedforthetruthoftheallegation,butratherwasadmittedtoestablishwhytheexaminationwasbeingconducted.SeeTenn.R.Evid.801(c).Obviously,thewholepurposeoftheexaminationrelatedtotheallegationsofsexualabuse.Secondly,petitionerwasnotprejudicedsimplybecausethephysiciantestifiedhewasexaminingthechildrenwithregardtoallegationsofsexualabuse.Thirdly,thedoctorstestimonydoesnotstatethatthechildvictimsmadetheseallegationstohim. Mostimportantly,thereisnoshowingofanyviolationofconstitutionaldimensions.Suchashowingisnecessarytosecurepostconvictionrelief.SeeTenn.CodeAnn.4030203. Sincethequestionedtestimonywasadmissibleanddidnotprejudicepetitioner,weneednotreachtheissueastowhetherLivingstonshouldbeappliedretroactively. Thisissueiswithoutmerit.@ MENSREAREQUIREMENT  Petitionerallegestheindictmentcharginghimwithaggravatedrapeandrapewasfatallydeficientduetothefailuretoallegetherequisitemensreaelementoftheoffenses.Thecountschargingaggravatedrapeallegedthatthedefendant unlawfullyandfeloniouslysexuallypenetratedachildunderthirteen(13)yearsofage, (   ׀andthecountschargingrapeallegedthatthedefendant unlawfullyandfeloniouslyandwithforceandcoercionsexuallypenetratedthevictim. Sincethestatutesunderwhichthepetitionerwasprosecuteddoesnotcontainaspecificmensrea,failuretoallegeaculpablementalstateintheindictmentdoesnotinvalidatetheindictmentsolongas(1)theindictmentlanguagesufficientlymeetstheconstitutionalrequirementsofnotice,adequatebasisforentryofaproperjudgment,andprotectionfromdoublejeopardy;(2)theindictmentformsatisfiesTenn.CodeAnn.4013202;and(3)thementalstatecanbelogicallyinferred.Statev.Hill,___S.W.2d___(Tenn.1997).ThevariouscountsclearlymeettheHillrequirements.
