DISSENTINGOPINION  z   Idissentfromthemajoritysfindingthattheevidencewassufficienttosustaintheconvictionoffelonymurder.Otherwise,Iconcurwiththemajoritysdecision.  ThedefendantwasindictedandconvictedforunlawfullyandrecklesslykillingBenjaminSmithduringtheperpetrationofespeciallyaggravatedrobbery.Inmyopinion,theStatehasfailedtoprovebeyondareasonabledoubtthatthevictimwaskilledduringtheperpetrationofthisfelony.Ibelievethattherecordsupportsconvictionsforthecrimesofseconddegreemurderandtheft.  ThecaseofStatev.Dunn,(No.03S019211CR00104,S.Ct.1993) ; whichisrelieduponbythedefendantanddiscussedinthemajorityopinion,offersrationalewhichisinstructiveinthiscase.InDunn,therewas / circumstantialevidenceofsexualactivitywiththedecedent,buttheCourtheldthattheevidencewasnotsufficienttoestablishthatthevictimwasrapedbeforeherdeath.Thus,theSupremeCourtdismissedthefelonymurderconviction.Similarly,inthecaseatbar,itwasnecessarythattheStateestablishthekillingwasdoneinpursuanceofthefelonyandnotmerelycollateraltoit.Theevidencedoesnotsupporttheconclusionthatthedefendantkilledthevictimwhilerobbinghim.  Accordingtothemajority,thefollowingevidencesupportsthefelonymurderconviction.ThevictimandthedefendantlefttheMousesEaranddrovearound.Thevictimwithdrew$200.00fromtheATMmachinewhichthedefendantlaterstole.Thedefendantshotthevictimintheheadwithapistolwhichshehadinherpossessionpriortothehomicide.ThehomicideoccurredinaremotelocationinMcMinnCountywhichiswherethedefendantlived.Thepantspocketsofthevictimwereturnedoutandafewcoinswerefoundnearhisbody.Hiswalletandcheckbookweretaken.ThevictimspickuptruckwaslaterfoundatamotelparkinglotandthekeystohisvehiclewerelocatedattheMousesEar.Thedefendantdeniedanyknowledgeofthevictimsdeath.Idonotagreewiththemajoritythattheelementsofespeciallyaggravatedrobberyareestablishedbythesefacts.  TheStatesstrongestevidenceofthecrimeisthepretrialstatementofthedefendant.Themajoritycorrectlystatesthatajuryisentitledtoacceptpartofadefendantspretrialstatementanddisregardthatwhichitdoesnotbelieve. #=9N Unquestionably,thepretrialstatementofthedefendantcontainsadmissionsof /VX   /VX   /VX   /VX   /VX   /VX   /VX   /V X   homicideandtheft.However,Ifindnoadmissionofrobbery.Relevantpartsofthedefendantsstatementaresummarizedasfollows.AfterleavingtheMousesEar,thedefendantandthevictimdrovearoundinhistruckandlaterinhertruck.ThevictimtalkedtoherabouthavingsexwithhimandobtainedmoneyfromtheATMmachine.ThevictimtoldhertodrivetoherhouseinMcMinnCounty.Shetoldhimthatshedidnothaveaboyfriendbutlivedalone.Hetouchedherandrubbedherlegsandbreastsandtoldhershelookedgood.AfterarrivinginMcMinnCounty,shethedefendanttoldthevictimshehadaliveinboyfriend,andhegotmad.Thevictimtoldhertopullovertothesideoftheroadwhichshedid.Theythenwentintothewoodsatwhichpointthedefendantkilledhim.Sheleftbutcamebackandtookhiswalletandcheckbook.ThemoneythevictimobtainedfromtheATMhadbeenleftinhertruck.  Otherfactscastdoubtuponthestatestheory.ThedefendantsuggestsinherstatementthatsheandthevictimwereinthisremoteareainMcMinnCountybecauseofthevictimsdesiretohavesexwithherandnotbecauseofherdesiretorobhim.Thenatureofthedefendantsoccupation,thetimeandplaceatwhichthedefendantandthevictimbecameacquainted,andthevictimsaffinityfornudebarsgivescredibilitytothedefendantsstorythatsexwasthereasontheywenttothisremotearea.Thesesamecircumstancesalsosuggestthatifitwasthedefendantsintenttotakethevictimsmoney,thatshecouldhaveaccomplishedthisresultbymeansshortofahomicide.  Thereisonefinalreasonwhichsupportsmyconclusionthatthefelonymurderconvictionshouldbedismissed.̀  Thejuryverdictsinthiscasewereinconsistent.InCount2,thejuryfoundthedefendantguiltyoffirstdegreemurderduringtheperpetrationofespeciallyaggravatedrobbery.InCount3oftheindictment,thedefendantwasindictedforespeciallyaggravatedrobbery;however,thejuryfoundthedefendantguiltyofthelesserincludedoffenseoftheftunder$500.00,amisdemeanor.TheverdictinCount3suggeststhatthejurybelievedthedefendantsstatementthatshedidnotkillthevictimforthemoneyandthatthethefttookplaceafterthemurder.
