AccordingtoDefendantspetition,onJanuary3,1990,hepleadednolocontenderetoandwasconvictedoftwocountsofarmedrobbery,twocountsofaggravatedkidnappingandonecountofaggravatedassault.Hereceivedaneffectivesentenceoftwenty(20)years.Thetrialcourtsummarizedhisnumerouscomplaintsinhispetitionas(1)illegal,multiplicitouschargesand(2)ineffectiveassistanceofcounsel.Thetrialcourtdeterminedthattheissuespresenteddidnotmerithabeascorpusrelief. HabeascorpusreliefisavailableunderTennesseelawonlywhenaconvictingcourtiswithoutjurisdictionorauthoritytosentenceadefendantorwhenthatdefendantstermofimprisonmentorrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993).ThereisnothinginthisrecordthatdemonstratesthattheconvictingcourtwaswithoutjurisdictionorauthoritytosentencetheDefendanttotheeffectivesentenceoftwentyyearsinconfinementfortheconvictionswhichhereceivedonJanuary3,1990.Thesufficiencyofanindictmentcannotbetestedinahabeascorpusproceeding.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971).Becausethetrialcourthadjurisdictioninthecasesubjudice,Defendantsotherallegations,ifmeritorious,wouldrenderhisconvictionsvoidableratherthanvoid,thusmakingtheissuesinappropriateforhabeascorpusrelief.SeePassarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994).Furthermore,thereisnothingcontainedinthisrecordwhichdemonstratesthattheDefendantstermofimprisonmentorrestrainthasexpired.Therefore,wecannotconcludethatthetrialcourterredbydismissingtheDefendantspetitionanddenyingtheDefendanthabeascorpusrelief.
