OnAugust21,2000,officerswiththeCrossvillePoliceDepartmentwenttotheDefendants ` residencetoservehimwithadomesticassaultwarrant.NeithertheDefendantnorhiswifewasat L  theresidence.However,thepolicedidfindamannamedBryanElmoreatthehouse.Elmores 8  truckwasparkedoutsidethehouse,andinthetruckthepolicefounda hotplateandabagfullof $ t chemicalsthatareassociatedwiththeproductionofmethamphetamine.Baseduponwhattheyfound  ` inElmorestruck,thepolicelocatedSherriConnerandreceivedconsenttosearchtheresidencethat  L  shesharedwiththeDefendant.Insidethehouse,theofficersfoundcansofcarburetorcleaner,abag  8  containingseveralpackagesofantihistaminetabletsandmatches,andabowlcontainingawhite $  waxysubstance.Theofficersalsosearchedashedbehindthehouse.Theretheyfoundfourteenbags   ofgarbage,threefiftyfivegallondrumsfullofmatchbooksmissingtheirstrikerplates,cansof   chemicals,includingliquidheat,carburetorcleaner,muriaticacid,acetone,andaerosolcanswith   tubingattached.Whentheofficersopenedoneofthegarbagebags,ayellowcloudemergedfrom   thebag. p   DetectiveMarkRosserwascalledtothesceneduetohistrainingregardingtheseizureof H methamphetaminelaboratories.HetestifiedthathefoundseveralburnpilesintheDefendantsyard 4 thatcontainedaerosolcans,glassbottles,andplastictubing.Aburnedglasscoffeepotwasinone  p oftheburnpiles.  \   BillyJoeMundy,Jr.,anagentwiththeFederalDrugEnforcementAdministration,described 4 howmethamphetamineismanufactured.Thebasicingredientsneededtomakemethamphetamine   usingthe ephedrinereductionmethodareephedrine,redphosphorous,andiodinecrystals.   Ephedrinemaybeextractedfromantihistaminetabletsbymixingthetabletsintoasolvent,suchas  acetoneorether.Productssuchascarburetorcleanerorfuellineantifreezecontainthesekindsof  solvents.Redphosphorousisfoundinthestrikerplatesofmatchbooks.AgentMundyexplained  thatseveralproductswillbepresentatamethamphetaminelaboratory,includingbottlesofsome l productcontainingacetone,thousandsofmatches,someformofiodine,hydrogenperoxide,muriatic X  acid,andsomesortofa gasser,whichisusedtoconvertthemethamphetamineoilintopowder. Whendescribingthetypesofgassersthatpeopleuse,Mundysaid, Alotofpeopleinthisareawere 0"  taughttomanufactureinawhistlercoffeepot...itsatelltalesigninthisareathattheyactually #l! manufactureinawhistlercoffeepot.AgentMundyalsostatedthatburnpilesarecommoninareas $X" nearmethamphetaminelabs,asthemanufacturersmustdisposeoflargeamountsofwaste. $D #   TheDefendantswife,SherriConner,testifiedthatshemovedoutoftheirresidenceon &"% August18,2000,becauseofanargumentshehadwiththeDefendant.Hermother,Gloria '#& Whitehead,testifiedthatMs.ConnercametolivewithherafewdaysbeforeAugust21,2000.Ms. (#' ConnerreturnedtothehouseshesharedwiththeDefendantonAugust19and20,2000,tofindthe )$( Defendantandretrievesomeofherbelongings.Shetestifiedthat,onthosedates,noneofthe  chemicalsorotheritemsthatthepolicefoundinthehouseorshedonAugust21werepresent.She  explainedtheburnpilesintheyardbysayingthatwhensheandtheDefendantmovedintothehouse,  theyardwasfullofdebris.ThereforetheDefendantgatheredupallthetrashintheyard,which t consistedofspraycansandbottles,andburnedit.Ms.Connertestifiedthataboutaweekafterthe ` policediscoveredthemethamphetaminelabatherhouse,sheandtheDefendantandherdaughter L  leftTennesseeduetoproblemswiththeirextendedfamiliesandwenttoMississippiandArkansas. 8  TheyreturnedinJanuary2001becauseherexhusbandhadfiledfortemporaryemergencycustody $ t ofherdaughter.  `   TheDefendanttestifiedthathelefthishomeonAugust18,2000,asaresultofanargument  8  withhiswife.Onthatdate,noneofthematerialsthatthepolicefoundonAugust21werethere. $  Heexplainedthattherewereburnpilesintheyardwherehehadbeengatheringanddisposingof   trash.TheDefendantdeniedmanufacturingmethamphetamineorgivinganyonepermissionto   manufacturemethamphetamineinhishome. However,theevidenceshowsthatmanyitemsthatarecommoninthemanufactureof  methamphetaminewerefoundinandaroundtheDefendantsresidence.Afewitemswerelocated  inthehouse,butmostoftheitems,includingcansofchemicals,numerousbagsofgarbage t containing chemicals,threedrumsfilledwithmatchbooks,andplastictubingwerefoundinthe ` shedbehindtheDefendantshouse.Furthermore,severalburnpileswerelocatedontheDefendants L  propertythatcontainedaerosolcansandglassjars.AgentMundytestifiedthatalloftheseitemsare 8  consistentwithmethamphetaminelaboratories.Fromthisevidence,arationaltrieroffactcould $ t haveconcludedbeyondareasonabledoubtthattheDefendantwasguiltyofattemptingto  ` manufacturemethamphetamine.Thisissueiswithoutmerit.  L    Next,theDefendantarguesthatthetrialcourterredbydenyinghismotionstoexcludethe $  testimonyofwitnessesSherriConnerandGloriaWhitehead.Hecontendsthatbecauseneither   witnesswaslistedontheindictmentorprovidedthroughdiscovery,thetrialcourtshouldnothave   allowedtheirtestimony.Furthermore,theDefendantassertsthatthecourtshouldhaveexcludedthe   testimonyofSherriConnerbecausetheStateimproperlyseveredthecaseagainstheronthemorning   oftrial. p   TennesseeCodeAnnotatedsection4017106states: H 8   ` Itisthedutyofthedistrictattorneygeneraltoendorseoneachindictmentor 4 presentment,atthetermatwhichthesameisfound,thenamesofsuchwitnessesas  p thedistrictattorneygeneralintendsshallbesummonedinthecause,andsignsuch  \ indictmentorpresentmentnamethereto.H    Thepurposeofthisstatuteistopreventsurprisetothedefendantattrialandtopermitthe SӀdefendant   topreparehisorherdefensetotheStatesproof.Statev.Kendricks,947S.W.2d875,883(Tenn. Defendantshouse.Photographsoftheseitemsthatwerefoundatadefendantsresidenceandare " peculiartothemanufactureofmethamphetaminearecertainlyrelevanttoaprosecutionforattempt |#  tomanufacturemethamphetamine. Thedecisiontoadmitthephotographsliesinthediscretionof h$! thetrialcourtandwillnotbereversedabsentaclearshowingofanabuseofthatdiscretion.Harris, T% " 839S.W.2dat73.Weconcludethattherulingofthetrialcourtwasnotanabuseofdiscretionand @&!# thephotographswereproperlyadmitted.Therecordisinadequatewithrespecttothebalanceofthe ,'|"$ photographsthattheDefendantrequestedbeadmitted.Apparently,thesearephotographsthatthe (h#% DefendantreceivedfromtheStateduringdiscovery.Inhisbrief,theDefendantstatesthat some )T$& of[thephotographs]provedtobeofsitesotherthanthoseofthisoccurrenceandothersboreadate )@%' stampthreeweekspriortoAugust21,2000.TheDefendantisarguingthatthereliabilityofthe *,&( sixteenphotographsiscalledintoquestionbytheother,unrelatedphotographsthattheDefendant +') receivedalongwiththesixteen.However,intheabsenceofacompleterecord,whichwouldinclude  thephotographsinquestion,wemustpresumethatthetrialcourtwascorrectinitsruling.
