Ðaccident.€€Vananda€described€the€defendant€as€a€ð ðwonderful€motherðð€and€said€she€had€ð ðstraightenedÐ à%0!$ Ðup€a€lotðð€and€was€ð ðdoing€better€for€herself.ðð€€Cooper,€who€said€she€had€no€father,€testified€that€theÐ Ì&"% Ðdefendant€was€spending€time€with€her€and€was€ð ðjust€a€lot€better€now.ðð€€Finally,€the€defendantððsÐ ¸'#& Ðpastor,€Kenny€Walker,€testified€that€the€defendant€had€begun€attending€his€church€regularly€after€theÐ ¤(ô#' Ðaccident€and€that€he€believed€her€remorse€and€ð ðchange€and€commitment€to€Christðð€were€genuine.Ð )à$( Ðâ âÐ |*Ì%) Ðà  àAt€the€conclusion€of€the€hearing,€the€trial€court€imposed€a€sentence€of€split€confinement,Ð ° Ðâ âordering€that€the€defendant€serve€forty„seven€days€in€the€county€jail€and€the€balance€of€her€eight„yearÐ œì Ðsentence€in€a€community€corrections€program.€€Among€other€factors€the€trial€court€considered€andÐ ˆØ Ðbalanced€to€arrive€at€its€sentencing€determinations€were€the€seriousness€of€the€defendantððs€crime,€herÐ tÄ Ðð ðalmost€non„existentðð€criminal€history,€the€fact€that€rehabilitation€efforts€had€never€previously€beenÐ `° Ðunsuccessfully€attempted€with€her,€and€her€emotional€and€substance€abuse€problems,€which€the€trialÐ L œ Ðcourt€found€were€treatable€in€the€community.€€Ð 8 ˆ ÐÌà  àOn€April€22,€2003,€approximately€five€years€into€her€sentence,€the€defendant€was€arrestedÐ  ` Ðfor€driving€under€the€influence,€and€a€community€corrections€violation€warrant€was€subsequentlyÐ ü L  Ðissued.€€At€the€June€4,€2003,€revocation€and€sentencing€hearing,€the€defendantððs€communityÐ è 8  Ðcorrections€officer,€Patricia€Ballard,€testified€that€the€defendant€informed€her€office€of€her€arrest.€€SheÐ Ô$  Ðsaid€she€was€aware€the€defendant€was€taking€ð ðmood„altering€substancesðð€for€pain€and€knew,€as€didÐ À  Ðthe€defendant,€that€the€medications€should€not€be€combined€with€driving.€€However,€the€defendantÐ ¬ü  Ðhad€met€all€the€conditions€of€her€community€corrections€sentence€prior€to€her€DUI€arrest,€and€BallardÐ ˜è  Ðtherefore€recommended€leniency,€suggesting€that€the€defendant€be€placed€on€some€sort€of€houseÐ „Ô  Ðarrest€or€electronic€monitoring€for€a€period€of€ninety€days,€while€her€medications€were€reevaluatedÐ pÀ Ðin€order€to€remove€her€from€as€many€mood„altering€substances€as€possible.€€€€€€€Ð \¬ ÐÌà  àAlcoa€Police€Officer€Rodney€Wilson,€who€made€the€DUI€arrest,€testified€he€was€working€asÐ 4„ Ða€field€training€officer€on€the€Alcoa€Highway€at€approximately€5:20€p.m.€when€several€callersÐ  p Ðreported€the€defendantððs€reckless€driving€to€dispatch.€€The€traffic€was€very€heavy,€and€by€the€timeÐ  \ Ðhe€reached€the€defendant,€she€had€already€been€involved€in€an€accident.€€Officer€Wilson€identifiedÐ øH Ðthe€videotape€of€his€interaction€with€the€defendant,€which€was€admitted€as€an€exhibit€to€the€hearingÐ ä4 Ðand€played€before€the€court.€€The€videotape€shows€that€the€defendant€was€unable€to€stand€withoutÐ Ð  Ðleaning€against€her€vehicle€for€support€and€had€great€difficulty€answering€routine€questions.€€InÐ ¼  Ðresponse€to€repeated€queries,€she€informed€the€officer€that€she€had€taken€four€ð ðSomasðð€and€that€theÐ ¨ø Ðð ðChastity€Vanandaðð€whose€name€appeared€on€the€prescription€bottle€she€had€in€her€possession€wasÐ ”ä Ðher€daughter.€€Officer€Wilson€testified€that€the€defendant€was,€in€his€opinion,€under€the€influence€ofÐ €Ð Ðnarcotics€at€the€time€of€her€arrest.€€He€acknowledged€on€cross„examination€that€neither€the€defendantÐ l¼ Ðnor€the€occupants€of€the€second€vehicle€involved€in€the€accident€were€injured,€although€there€wasÐ X ¨ Ðextensive€front„end€damage€to€the€defendantððs€vehicle.€Ð D!” ÐÌà  àKelly€Cooper,€the€defendantððs€younger€daughter,€testified€she€was€nineteen€years€old€and€Ð #l!
