ÐHouse€contacted€her€on€March€18,€1999,€to€tell€her€that€the€defendant€had€that€day€tested€positiveÐ °"  Ðfor€drug€use,€for€benzodiazepines.€€The€following€day€Kerr€was€again€contacted€by€Agapeððs€director,Ð  #ð! Ðwho€told€her€that€the€defendant€had€left€the€house€during€the€night€without€permission,€and€that€theyÐ $à" Ðdid€not€know€her€whereabouts.€€Kerr€said€that€the€last€contact€she€had€had€with€the€defendant€wasÐ €%Ð # Ðthe€February€1999€probation€form€that€the€defendant€faxed€from€Agape€House.€€Kerr€further€testifiedÐ p&À!$ Ðthat€€the€defendant€owed€€back€probation€fees€to€Blount€County.€Ð `'°"% ÐÌà  àWhen€asked€her€opinion€regarding€the€defendantððs€continued€probation,€€Kerr€indicated€thatÐ @)$' Ðshe€would€recommend€revocation:Ð 0*€%( Ðâ âÐ  +p&) Ðà8  àà8` Ð Ð àò òQ.€€€€€ó óBased€on€this€history€of€supervision€or€lack€of€supervision,€doÐ ° Ðâ âyou€have€an€opinion€as€to€whether€you€or€the€Department€ofÐ  ð ÐProbations€and€Paroles€can€effectively€supervise€this€individual€onÐ à Ðcommunity€release?ЀÐ` x` x ÐÌà8  àà8` Ð Ð àò òA.€€€€€ó óFrom€what€I€have€experienced€so€far€with€Ms.€Cooper,€I€donððtÐ ` ° Ðsee€any€indication€that€she€wishes€to€cooperate€or€be€honest€with€ourÐ P   Ðdepartment€of€probation€or€any€other€department.ò òó ó€Ð@ ` x` x ÐÌà  àThe€€defendant€testified€in€her€own€defense.€€She€said€that€she€had€been€a€resident€atÐ  p  ÐCornerstone,€a€drug€treatment€facility€in€Blount€County,€at€the€time€she€was€arrested€for€violationÐ `  Ðof€her€Blount€County€probation.€€€She€explained€that€she€had€been€in€Hamilton€County,€where€sheÐ P  Ðwas€arrested€on€November€24,€1998,€for€driving€on€a€revoked€license,€because€she€had€beenÐ ð@  Ðattending€a€methadone€clinic€in€Chattanooga.€€The€defendant€stated€that€she€failed€to€make€the€initialÐ à0  Ðcourt€date€on€that€charge€because€she€lacked€transportation€to€court.€€She€had€later€pled€guilty€to€theÐ Ð  Ðcharge,€received€a€six„month€suspended€sentence,€and€been€placed€on€unsupervised€probation.Ð À ÐÌà  à€The€defendant€said€that€her€positive€test€for€benzodiazepines€on€March€18,€1999,€was€theÐ  ð Ðresult€of€€her€ingesting€benzodiazepines€that€she€had€been€given€at€a€detoxification€center,€Dry€Dock,Ð à Ðwhich€she€had€attended,€prior€to€her€admission€to€Agape€House,€in€an€effort€to€overcome€herÐ €Ð Ðaddiction€to€methadone.€€According€to€the€defendant,€the€officials€at€Agape€House€had€asked€her€toÐ pÀ Ðleave€the€house€after€her€positive€drug€test€because€they€did€not€believe€that€any€benzodiazepines€sheÐ `° Ðhad€received€at€Dry€Dock€would€have€still€been€in€her€system€on€March€18.Ð P  ÐÌà  àThe€defendant€acknowledged€that€she€had€called€on€the€telephone€from€a€friendððs€house€theÐ 0€ Ðvictim€in€the€harassment€case.€€She€insisted,€however,€that€the€phone€call€had€been€unintentional.€Ð  p ÐShe€stated€that€she€had€ð ðdialed€a€number€incorrectly,ðð€when€attempting€to€call€a€friend,€that€she€Ð ` Ðð ðmust€have€hit€another€number€that€was€similar€somewhere,ðð€and€that€it€had€€happened,€by€chance,€Ð P Ðto€be€the€victimððs€phone€number€that€she€dialed.€Ð ð@ ÐÌà  àThe€defendant€further€acknowledged€that€she€had€not€only€failed€to€inform€her€probationÐ Ð  Ðofficers€of€her€attendance€at€the€Chattanooga€methadone€clinic,€but€that€she€had€also€failed€to€informÐ À! ÐKerr€of€her€arrest€and€conviction€in€Hamilton€County€for€driving€on€a€revoked€license,€of€herÐ °"  Ðð ðaccidentalðð€phone€call€to€the€victim,€of€the€fact€that€she€had€been€on€probation€in€Knox€County€atÐ  #ð! Ðthe€time€of€her€conviction€in€Blount€County€for€harassment,€of€her€attendance€at€Dry€Dock,€or€of€herÐ $à" Ðadmittance€to€Cornerstone€Recovery€House.Ð €%Ð # ÐÌà  àThe€defendant€testified€€that€her€time€at€Cornerstone€House€had€been€ð ðvery€beneficialðð€to€her,Ð `'°"% Ðand€€that€she€had€not€used€drugs€since€shortly€before€she€entered€the€program€at€Cornerstone.€€SheÐ P( #& Ðsaid€that€she€had€ð ðworked€on€a€lot€of€issues,ðð€including€ð ðhonesty€issues,ðð€while€she€was€in€treatment.€Ð @)$' ÐShe€indicated€that€she€believed€she€would€be€able€to€turn€her€life€around€and€become€a€productiveÐ 0*€%( Ðmember€of€society€if€allowed€to€return€to€Cornerstone.€€€€€€€€€€€€Ð  +p&) ÐÐ ,`'* Ðà  àA€representative€from€Cornerstone€testified€that€the€program€was€willing€to€readmit€theÐ ° Ðdefendant,€and€that€if€it€did€so,€she€would€live€in€Cornerstoneððs€halfway€house,€Stepping€Stone,€andÐ  ð Ðattend€the€Professional€Assistance€Program,€an€outpatient€drug€treatment€program.€€On€cross„Ð à Ðexamination,€the€representative€admitted€that€the€defendant€would€be€free€to€leave€Stepping€StoneÐ €Ð Ðat€any€time€she€wished,€and€that€unless€the€defendant€authorized€the€facility€to€do€so,€it€would€notÐ pÀ Ðhave€the€authority€to€inform€the€defendantððs€probation€officers€of€the€results€of€any€of€theÐ ` ° Ðdefendantððs€drug€tests,€or€of€whether€she€had€left€the€facility.Ð P   ÐÌà  àAt€the€conclusion€of€the€hearing,€the€trial€court€found€that€overwhelming€proof€had€beenÐ 0 € Ðpresented€that€the€defendant€had€violated€the€terms€of€her€probation.€€The€trial€court€further€foundÐ  p  Ðthat€the€defendant€would€not€be€able€successfully€to€complete€a€term€of€supervised€release,€given€herÐ `  Ðpast€failure€to€inform€her€probation€officers€of€her€whereabouts€and€activities.€€The€trial€courtÐ P  Ðrevoked€the€defendantððs€probation,€and€ordered€that€€she€serve€her€sentence€as€originally€imposed,Ð ð@  Ðwith€credit€given€for€the€forty„one€days€she€had€already€spent€in€custody.€€Ð à0  ÐÌà@òò&ìàò òòòANALYSISˆÐ À ÐÌóóó óà  àThe€defendant€argues€that€the€trial€court€abused€its€discretion€in€revoking€her€probation.€€She€Ð  ð Ðadmits€that€she€violated€the€terms€of€her€probation,€but€contends€that€the€court€erred€by€finding€thatÐ à Ðshe€would€be€unable€to€successfully€complete€a€term€of€supervised€probation.€€The€defendant€assertsÐ €Ð Ðthat€she€was€on€the€road€to€recovery€from€her€serious€drug€addictions€at€the€time€she€was€arrestedÐ pÀ Ðfor€violation€of€her€Blount€County€probation,€and€that€forcing€her€to€serve€her€sentence€in€jail,€whereÐ `° Ðshe€will€not€have€ready€access€to€treatment,€will€undermine€her€recovery€and€rehabilitation.€TheÐ P  Ðdefendant€suggests€that€an€appropriate€response€to€her€violation€of€probation€would€be€the€impositionÐ @ Ðof€a€period€of€split€confinement€followed€by€the€extension€of€her€probationary€period€for€a€periodÐ 0€ Ðup€to€one€year,€with€the€requirement€that€she€continue€to€reside€in€a€halfway€house€and€receive€out„Ð  p Ðpatient€drug€treatment.Ð ` ÐÌà  àThe€State€argues€that€the€trial€court€did€not€abuse€its€discretion€in€revoking€the€defendantððsÐ ð@ Ðprobation€and€in€ordering€that€she€be€required€to€serve€her€original€sentence€in€jail.€€The€StateÐ à0 Ðcontends€that€the€trial€courtððs€decision€was€supported€by€€substantial€evidence€of€the€defendantððsÐ Ð  Ðrepeated€violations€of€the€terms€of€her€probation,€and€of€the€deception€she€practiced€in€her€dealingsÐ À! Ðwith€her€probation€officer.Ð °"  ÐÌà  àTennessee€Code€Sections€€40„35„310€and€40„35„311€grant€the€trial€court€the€right€to€revokeÐ $à" Ða€suspended€sentence€and€to€reinstate€the€original€sentence€if€the€court€finds€by€the€preponderanceÐ €%Ð # Ðof€the€evidence€that€the€defendant€has€violated€the€terms€of€his€or€her€probation€and€suspension€ofÐ p&À!$ Ðsentence.€€Tenn.€Code€Ann.€ðððð€40„35„310€and€40„35„311€(1997).€€The€revocation€of€probation€liesÐ `'°"% Ðwithin€the€soundò òòòóóó ó€discretion€of€the€trial€court.€òòState€v.€Harkinsóó,€811€S.W.2d€79,€82€(Tenn.€1991);€òòStateÐ P( #& Ðv.€Stubblefieldóó,€953€S.W.2d€223,€226€(Tenn.€Crim.€App.€1997)òòóó;€òò€State€v.€Mitchellóó,€810€S.W.2d€733,Ð @)$' Ð735€(Tenn.€Crim.€App.€1991).€To€show€an€abuse€of€discretion€in€a€probation€revocation€case,€ð ðaÐ 0*€%( Ðdefendant€must€demonstrate€ððthat€the€record€contains€no€substantial€evidence€to€support€theÐ  +p&) Ðconclusion€of€the€trial€judge€that€a€violation€of€the€conditions€of€probation€has€occurred.ðððð€òòState€v.Ð ,`'* ÐWallóó,€909€S.W.2d€8,€10€(Tenn.€Crim.€App.€1994)€(quoting€òòState€v.€€Delpóó,€614€S.W.2d€395,€398Ð ° Ð(Tenn.€Crim.€App.€1980)).€€We€review€this€issue,€therefore,€for€an€abuse€of€discretion.€Ð  ð ÐÌà  àOur€review€of€the€record€reveals€no€abuse€of€discretion€by€the€trial€court€in€this€matter.€€TheÐ €Ð Ðpreponderance€of€the€evidence€clearly€supports€the€trial€courtððs€finding€that€the€defendant€repeatedlyÐ pÀ Ðviolated€the€terms€of€her€probation.€Probation€Officer€Kerr€testified,€and€the€defendant€herselfÐ ` ° Ðadmitted,€that€the€defendant€violated€the€terms€of€her€probation€by€driving€on€a€revoked€license,Ð P   Ðrepeatedly€changing€her€location€without€prior€approval€and€without€notifying€her€probation€officer,Ð @  Ðcontacting€her€victim,€neglecting€her€monthly€probation€reports,€and€failing€to€pay€her€monthlyÐ 0 € Ðprobation€fees.€€Moreover,€the€record€shows€that€throughout€the€period€of€her€probation€theÐ  p  Ðdefendant€deceived€Kerr€by€failing€to€inform€Kerr€of€her€status€and€activities,€including€the€crucialÐ `  Ðfacts€that€she€was€on€probation€in€Knox€County€at€the€time€she€was€convicted€in€Blount€County,€thatÐ P  Ðshe€had€been€arrested€and€convicted€for€driving€on€a€revoked€license€in€Hamilton€County,€and€thatÐ ð@  Ðshe€had€contacted€her€victim.€Ð à0  ÐÌà  àAlthough€the€defendant€admits€these€probation€violations,€she€nonetheless€argues€that€theÐ À Ðtrial€court€abused€its€discretion€by€revoking€her€probation€and€reinstating€her€original€jail€sentence.Ð ° ÐThe€defendant€cites€òòState€v.€Dyeóó,€715€S.W.2d€36,€41€(Tenn.€1986),€for€the€proposition€that€when€theÐ  ð Ðtrial€court€fails€to€make€a€finding€that€an€alternative€to€imprisonment€is€ð ðinadequate€to€meet€theÐ à ÐStateððs€interest€in€punishing€the€offender,€deterring€others€from€similar€conduct,€and€insuring€theÐ €Ð Ðpayment€of€restitution€to€victims€of€crime,ðð€allowing€a€defendant€who€has€violated€the€terms€of€hisÐ pÀ Ðprobation€to€remain€on€probation€is€appropriate.€€Ð `° ÐÌà  àThe€facts€€in€òòDyeóó,€however,€are€not€analogous€to€those€of€the€case€at€bar.€€The€defendant€inÐ @ ÐòòDyeóó€pled€guilty€to€a€charge€of€fraudulent€breach€of€trust,€was€given€a€three„year€suspended€sentence,Ð 0€ Ðplaced€on€probation,€and€ordered€to€make€restitution€of€$14,295.€€òòId.óó€at€37.€€He€failed€to€pay€onÐ  p Ðschedule.€€òòId.óó€€At€the€conclusion€of€the€probation€revocation€hearing,€the€trial€court€revoked€theÐ ` Ðdefendantððs€probation,€refusing€his€offer€to€pay€$200€per€month€for€five€years€and€ten€months.€òòId.óóÐ P Ðat€39.òòòòóóóó€€This€court€affirmed.€€òòId.óó€€Our€supreme€court€reversed,€finding€that€the€defendant,€who€hadÐ ð@ Ðspent€over€two€years€in€a€Veteransðð€Administration€Hospital€since€his€sentencing,€and€who€hadÐ à0 Ðdeclared€bankruptcy,€had€shown€good€cause€for€his€failure€to€make€restitution.€€òòId.óó€at€41.€€The€courtÐ Ð  Ðremanded€the€case€to€the€trial€court€for€a€hearing€to€determine€an€appropriate€schedule€and€monthlyÐ À! Ðamount€for€the€defendant€to€pay€until€full€restitution€had€been€made.€€òòId.óó€Ð °"  ÐÌà  àThe€defendant€in€this€case,€unlike€the€defendant€in€òòDyeóó,€has€repeatedly€and€materiallyÐ $à" Ðviolated€numerous€terms€of€her€probation,€all€of€which€were€within€her€power€to€meet,€had€sheÐ €%Ð # Ðdesired€to€do€so.€€Furthermore,€we€note€that,€contrary€to€the€defendantððs€implied€assertion,€the€trialÐ p&À!$ Ðcourt€did,€in€fact,€make€a€finding€that€the€defendantððs€proposed€alternative€to€imprisonment€wouldÐ `'°"% Ðbe€inadequate€in€this€case.€€The€trial€court€stated:Ð P( #& ÐÌà8  àà8` Ð Ð à€€€And€the€next€question€is€the€likelihood€of€rehabilitation€andÐ 0*€%( Ðâ âwhether€or€not€she€will€successfully€complete€a€term€of€supervisedÐ  +p&) Ðrelease,€which€is€what€sheððs€asking€for.€€And€for€whatever€reason,€IÐ ° Ðjust€donððt€think€thereððs€any€chance€thatððs€going€to€happen.Рð` x` x Ðâ âÌà8  àà8` Ð Ð à€€€€€There€is€no€way€to€be€supervised€if€you€refuse€to€let€the€peopleÐ €Ð Ðthat€are€supposed€to€be€supervising€you€know€where€you€are€and€whatÐ pÀ Ðyouððre€doing.€€And€if€you€had€done€that€once,€that€would€be€oneÐ ` ° Ðthing.€€But€youððve€done€it€countless€times€in€the€last€two€years.€€ÐP  ` x` x ÐÌà  àSubstantial€evidence€in€the€record€supports€the€trial€courtððs€findings€that€the€defendant€hadÐ 0 € Ðviolated€her€probation€and€that€she€was€unwilling€to€comply€with€the€terms€of€supervised€release.€Ð  p  ÐAccordingly,€we€find€no€abuse€of€discretion€by€the€trial€court€in€revoking€the€defendantððs€probationÐ `  Ðand€ordering€her€to€serve€her€full€sentence€in€jail.€€Ð P  ÐÌà  àBased€€upon€the€foregoing€reasoning€and€authorities,€we€affirm€the€judgment€of€the€trialÐ à0  Ðcourt.€€Ð Ð  ÐÌà  àÌÌÓ€ (н83 Óò òó óÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð €Ð Ðà  àà ` àà ¸ àà  àà h àà À àà  àALAN€E.€GLENN,€JUDGEÐ pÀ ÐÌÌÌÌ
