àThe€Defendant,€James€Leonard€Corder,€was€charged€in€an€indictmentÏreturned€by€the€Carroll€County€grand€jury€with€two€counts€of€aggravated€assaultÏagainst€Bobbie€Jo€Douglas€(one€by€use€of€a€deadly€weapon€and€the€other€byÏcausing€serious€bodily€injury),€one€count€of€aggravated€assault€upon€Martha€JoÏHindman,€and€one€count€of€aggravated€kidnapping€of€Bobbie€Jo€Douglas.€€AllÏacts€were€alleged€to€have€been€committed€on€the€same€date.€€The€jury€foundÏDefendant€guilty€of€aggravated€assault€upon€Martha€Jo€œHindman,€guilty€of€Ïaggravated€assault€upon€Bobbie€Jo€Douglas€by€causing€her€serious€bodilyÏinjury,€€and€guilty€of€the€lesser€included€offense€of€assault€on€the€other€charge€ofÏaggravated€assault.€€The€Defendant€was€acquitted€of€the€charge€of€aggravatedÏkidnapping.€€The€trial€court€subsequently€merged€the€misdemeanor€assaultÏconviction€with€the€conviction€of€aggravated€assault€upon€Bobbie€Jo€DouglasÏand€sentenced€Defendant€to€serve€six€(6)€years€imprisonment€on€bothÏconvictions€of€aggravated€assault,€to€be€served€concurrently.€€€ÌÌà àIn€this€appeal€as€of€right€pursuant€to€Rule€3€of€the€Tennessee€Rules€ofÏAppellate€Procedure,€Defendant€presents€two€issues:€(1)€The€trial€court€erred€byÏoverruling€his€objection€to€the€admission€into€evidence€of€photographs€of€theÍvictim€and€(2)€the€trial€court€erred€by€denying€his€motion€to€suppress€evidenceÏseized€from€his€van€during€a€warrantless€search.€€We€affirm€the€judgment€of€theÏtrial€court.ÌÌà àOn€January€26,€1995,€Martha€Jo€Hindman,€an€elderly€lady€who€wasÏnormally€confined€to€a€wheelchair,€and€Bobbie€Jo€Douglas,€who€was€theÏDefendantððs€girlfriend,€were€sitting€in€Ms.€Hindmanððs€home€when€the€DefendantÏentered€and€began€beating€Ms.€Douglas.€€Ms.€Hindman€tried€to€intervene,€butÏDefendant€threatened€her€with€a€knife,€placing€the€knife€in€her€face€and€tellingÏher€to€ð ðshut€up.ðð€€This€scared€Ms.€Hindman€and,€in€her€words,€she€ð ðbacked€off.ðð€ÏMs.€Hindman€went€to€another€room€to€a€telephone€to€call€for€help.€€TheÏDefendant€saw€her,€jerked€the€phone€out€of€her€hand€and€threw€it€on€the€floor.€ÏDefendant€then€folded€her€wheelchair€up€and€threw€it€on€the€floor,€grabbed€Ms.ÏHindman€and€slung€her€over€the€wheelchair,€and€she€was€unable€to€get€up.€€ÌÌà àMs.€Hindman€testified€that€after€the€Defendant€came€in€the€house,€heÏstated€to€Ms.€Douglas,€ð ðWhat€did€you€lie€to€me€for?ðð€€He€then€grabbed€Ms.ÏDouglas€by€the€hair€of€her€head€and€hit€her€several€times€in€the€face€with€hisÏfist.€€Ms.€Douglas€began€to€gather€her€belongings€and€the€Defendant€knockedÏher€down€again.€€Ms.€Douglas€began€bleeding€and€blood€was€on€the€floor,€aÏfootstool€and€a€blanket.€€In€addition,€the€Defendant€was€kicking€Ms.€DouglasÍwhile€she€was€on€the€floor.€€As€the€Defendant€was€taking€Ms.€Douglas€awayÏfrom€the€home,€he€told€Ms.€Hindman€that€if€she€told€anyone€what€hadÏhappened,€he€would€come€back€and€do€to€her€what€he€had€done€to€Ms.ÏDouglas.€€After€a€considerable€period€of€time,€Ms.€Hindman€finally€called€911Ïand€asked€for€a€police€officer€to€come€and€help€her€get€up.€€Being€fearful€of€theÏDefendant€and€his€threats,€Ms.€Hindman€told€the€officer€that€she€hadÏaccidentally€fallen€out€of€the€chair.€€Subsequently,€being€concerned€of€Ms.ÏDouglasðð€well„being€due€to€the€extent€of€her€injuries,€she€called€the€police€theÏnext€day€and€reported€the€incident.€ÌÌà àThe€proof€showed€that€the€Defendant€resided€in€Benton€County.€€OfficersÏof€the€Benton€County€Sheriffððs€Department€went€to€the€Defendantððs€residenceÏand€found€both€the€Defendant€and€Ms.€Douglas.€€Pictures€were€taken€of€Ms.ÏDouglas€as€she€was€found€at€the€Defendantððs€residence€and€as€sheÏappeared€at€the€hospital€in€Camden€on€January€27,€1995.€€ÌÌà àTo€say€that€Ms.€Douglas€was€a€reluctant€witness€at€the€trial€is€toÏunderstate€the€situation.€€She€testified€on€direct€examination€when€called€by€theÏState€that€she€could€not€remember€the€events€which€had€occurred€at€Ms.ÏHindmanððs€home,€even€though€the€record€reflects€that€she€apparently€had€aÏgood€memory€of€the€events€during€the€preliminary€hearing€in€General€SessionsÍCourt€on€February€9,€1995.€€During€cross„examination,€Ms.€Douglas€testifiedÏthat€she€had€spoken€with€the€Defendant€over€the€phone€and€he€said€that€if€heÏever€got€out€of€this€he€would€ð ðnever€do€it€no€more.ðð€€He€apologized€to€her€andÏshe€stated€that€she€had€written€to€him€and€made€phone€calls€to€him€since€theÏincident€had€occurred.€€In€summary,€Ms.€Douglas€testified€that€ð ð[Defendant]€donððtÏneed€to€be€„„€heððs€spent€enough€time€in€jail€for€what€he€has€done€.€.€.€I€think€heÏhas€been€punished€enough€for€what€he€has€done.ððÌÌà àOfficers€of€the€Benton€County€Sheriffððs€Department€searched€theÏDefendantððs€van€on€the€date€of€his€arrest€on€January€27,€1995.€€Evidence€ofÏitems€recovered€from€the€van€which€incriminated€the€Defendant€were€introducedÏat€trial.€€In€addition,€the€Defendant€made€a€statement€to€the€Sheriff€of€BentonÏCounty€that€he€[Defendant]€wished€he€had€just€gone€ahead€and€cut€off€theÏvictimððs€head.€€ÌÌà àPrior€to€the€trial,€the€Defendant€filed€a€motion€to€suppress€all€evidenceÏseized€during€the€warrantless€search€of€his€van€by€the€Benton€County€SheriffððsÏDepartment.€€Following€a€hearing,€the€court€denied€the€motion.€€The€record€onÏappeal€does€not€contain€the€transcript€of€the€proceedings€of€the€motion€toÏsuppress€evidence.€€ÌÌà àIt€is€the€duty€of€the€Defendant€to€prepare€a€record€which€includes€theÏproceedings€relevant€to€an€issue€on€appeal;€otherwise,€the€doctrine€of€waiverÏapplies.€€T.R.A.P.€24(b);€òòState€v.€Milleróó,€737€S.W.2d€556,€558€(Tenn.€Crim.€App.Ï1987).€€When€the€record€is€incomplete,€or€does€not€contain€the€proceedingsÏrelevant€to€an€issue,€this€court€must€presume€the€trial€court€ruled€correctly.€€òòStateÏv.€Hoosieróó,€631€S.W.2d€474,€476€(Tenn.€Crim.€App.€1982);€òòHerron€v.€Stateóó,€3ÏTenn.€Crim.€App.€39,€456€S.W.2d€873,€876€(1970).€€Based€upon€the€status€ofÏthe€record€on€appeal,€this€court€must€presume€that€the€trial€court€ruled€correctlyÏon€the€motion€to€suppress€evidence€seized€from€the€Defendantððs€van.€€ThisÏissue€is€without€merit.ÌÌà àThe€Defendant€also€filed,€pre„trial,€a€motion€òòinóó€òòlimineóó,€requesting€the€trialÏcourt€to€enter€an€order€prohibiting€the€State€from€introducing€into€evidence€theÏphotographs€of€the€victim,€Bobbie€Jo€Douglas.€€Defendant€alleged€in€thisÏmotion,€and€argues€on€appeal,€that€the€prejudicial€effect€of€the€photographs€farÏoutweighs€the€probative€value.€€He€asserts€that€the€extent€of€the€victimððs€injuriesÏcould€be€adequately€proven€through€the€testimony€of€the€treating€physician.ÌÌà àAs€in€the€case€of€the€motion€to€suppress€evidence,€the€record€does€notÏcontain€the€transcripts€of€any€proof€presented€to€the€trial€court€concerning€theÍmotion€òòinóó€òòlimineóó.€€A€pre„trial€hearing€was€apparently€held€and€an€order€wasÏentered€denying€the€motion€òòinóó€òòlimineóó.€€ÌÌà àEven€if€this€issue€is€not€waived€by€failure€of€the€Defendant€to€include€inÏthe€record€proceedings€in€the€trial€court€related€to€the€motion€òòinóó€òòlimineóó,€we€areÏable€to€rule€that€the€probative€value€of€the€photographs€is€not€outweighed€byÏany€prejudicial€effect.€€From€the€record€it€is€apparent€that€the€photographsÏaccurately€and€clearly€display€the€injuries€to€the€victim€which€support€proof€ofÏserious€bodily€injury.€€The€victimððs€treating€physician€testified€during€cross„examination€by€Defendantððs€counsel,€that€the€photographs€did€not€look€worseÏthan€the€victimððs€actual€injuries€and€in€fact,€the€photographs€ð ðlooked€exactlyðð€likeÏthe€injuries.€€ÌÌà àThe€physician€further€testified€that€the€victim€had€massive€swelling€of€herÏface€with€bruising,€especially€around€her€eyes,€to€the€extent€that€she€wasÏunable€to€open€her€eyes.€€In€addition,€the€victim€had€multiple€bruises€on€her€ribÏcage€and€swelling€of€both€hands.€€He€related€that€the€victim€did€not€haveÏmassive€bleeding€and€had€no€broken€bones.€€He€further€testified€that€the€victimððsÏeyes€were€so€swollen€that€she€would€have€been€unable€to€get€up€and€moveÏaround€on€her€own.€€The€photographs€which€were€objected€to€by€theÍDefendant€show€the€victimððs€face€with€the€eyes€swollen€shut,€bruising€on€theÏface,€and€the€swollen€left€hand.€€The€photographs€are€not€particularly€gruesome.€€ÌÌà àEspecially€in€light€of€the€victimððs€inability€to€remember€events€of€theÏaggravated€assault,€we€conclude€that€the€probative€value€of€the€photographsÏfar€outweighs€any€prejudicial€effect.€€òòSeeóó€òòState€v.€Banksóó,€564€S.W.2d€947,€951Ï(Tenn.€1978).€€The€trial€court€did€not€err€in€overruling€the€Defendantððs€objection€toÏthe€introduction€of€the€photographs€of€the€victim.€ÌÌà
