ThePetitionertestifiedthathedidnotbelievethatCounselspoketoallthewitnessesinhis   case.ThePetitionerstatedthathetoldCounselaboutsomewitnesseswhowouldhelphisdefense, p butstated, Idontbelievehecalledanywitnesses.HejustcrossexaminedeveryonethattheState \ puton.ThePetitionertestifiedthatCounseldidnotexplaintohimwhyhedidnotcallany H witnesses.ThePetitionerexplainedthathewantedtoputonJamieSammonsandthePetitioners 4 mother.Hestatedthatatthetimeoftrial,hismotherwasstillinLosAngeles,butshecouldhave  p flowntothetrialinTennessee.ThePetitionertestifiedthatCounselnevercalledhismotherabout  \ thepossibilityofhertestifyingatthetrial.Hestatedthathismotherwouldhavetestifiedaboutthe H friendlyrelationshipbetweenthePetitionerandthevictim. 4   ThePetitionertestifiedthatthekillingwasnotpremeditatedorintentionalbecause [t]hegun   ...hadonebulletandnoclip.Howcouldthatbeanintentionalkillingif,ifyouhaveonebulletand  noclip?Hestatedthatheshotthevictimbecausethevictimwasraisinghisgunand Iassumed  hewasgoingtoshootme.ThePetitionertestifiedthatCounsel probablycouldhavequestioned  thewitnessesalittlemore....HestatedthatCounselcrossexaminedwitnessesusingshortand l simplequestions. X    ThePetitioneralsotestifiedthatCounselsphysicalhandicapofblindnessaffectedCounsels 0"  abilitytoquestionwitnessesandobservethejury.HestatedthatCounseldidnotnoticeajurorwho #l! wassleepingduringhistrialbecauseofCounselsblindness.ThePetitionerfurthertestifiedthat $X" CounselfailedtoinvestigatewhetherthePetitionerhadanypsychologicalproblemsordiminished $D # mentalcapacity. %0!$   Oncrossexamination,thePetitioneradmittedthathadhetestified,hiscriminalhistoryand '#& ganginvolvementwouldhavecomeintoevidence.Healsostatedthathewouldhavetestifiedabout (#' howhedumpedthevictimsbodyinthewoodstoconcealthecrime.ThePetitioneradmittedthat )$( CameronstestimonythatthePetitionerwasnotinagangactuallyhelpedthePetitionerattrial.He |*%) admittedthatCounselfiledamotioninliminetoexcludeanyreferencetothePetitionerbeinga h+&* memberofagang.ThePetitioneradmittedthathediscussedallpossibledefenseswithCounsel  priortotrial,andtheyultimatelydecidedthatselfdefensewasthebestoption.Healsoadmittedthat  CounselexplainedtohimwhatwitnessestheStatewasgoingtocallandwhatfactstheStatewas  goingtouse.ThePetitionerstatedthatCounselthoughtselfdefensewasthebestdefensebased t uponthefactsandevidencefromtheStateandhisdiscussionswiththePetitioner.Headmittedthat ` Counselpresentedthetheoryofselfdefense ratherforciblytothejury.ThePetitioneralso L  admittedthatCounselquestionedwitnessesabouttheinconsistenciesintheirtestimonyand 8  challengedthewitnessescredibility. $ t   ThePetitionerstatedthatCounselexplainedtheelementsofthefirstdegreemurdercharge  L  tohimpriortotrial.ThePetitionerfurtherstatedthathetoldthetrialcourtthathechosenotto  8  testifyathistrialbecauseCounseladvisedhimnottotakethestand.HeadmittedthatCounselhad $  aninvestigatorwiththepublicdefendersofficeworkingonthecase.ThePetitionerstatedthat   Counselwouldconsultwiththeinvestigatorandhisassistantduringthetrial.     KarlaG.Gothard,executiveassistantdistrictpublicdefender,testifiedthatshewasthe   supervisoroftheotherassistantdistrictpublicdefendersinherofficeatthetimeofthePetitioners p trial.GothardtestifiedthatCounselwashiredasapublicdefenderinherofficein1989and \ continuedasapublicdefenderuntilhisdeathinMayof2002.Shestatedthatpriortobeinghired H asapublicdefender,Counselhadbeeninprivatepracticeasacriminaldefenselawyerfornineor 4 tenyears.GothardexplainedthatCounselwasatriallawyerinherofficeandworkedinthejuvenile  p court,generalsessionscourtandcriminalcourt.ShestatedthatCounselwasblind,butthathis  \ handicapdidnotpreventhimfrombeinganeffectivecriminaldefenselawyer. H   Gothardtestifiedthatherofficemaintainsfilesoneverycaseaspartofthebusinessrecords   inheroffice.Sheexplained:   8  [A]fterthecase...isclosed,wemaintainthefile.Wehaventdestroyedanyfiles. GothardtestifiedthatshedidnotworkwithCounselonthePetitionerscase,butshehad l workedwithCounselonmanyothercasesasbothsupervisorandcocounsel.Shestatedthat I X  appreciatedhaving[Counsel]sitassecondchairformebecauseofhisinsightandwisdom,andwhen D! [Counsel]hadatrial,Iwouldsitsecondchairforhimandhopefullyprovidealittlebitofinsightand 0"  wisdomandactedashiseyes...inmanycases.SheexplainedthatCounselwasasightedattorney #l! wholosthiseyesightaftermanyyearsofpracticinglaw.GothardtestifiedthatCounselsdisabilities $X" didnothinderhimfrombeinganeffectiveattorney.Sheexplained: $D # 8   ` Hehad...otherphysicalproblemsaswellovertheyears.Hisblindnessand &"% theotherphysicalproblemswererelatedtojuvenilediabetes,and[Counsel] '#& constantlyamazedmeintermsofhowhefunctioned,thathefunctionedaswellas (#' hedid....)$(   8   ` Irememberhavingaconversationwithhimandaskedhimhowhedidit, h+&*  Howdoyoucome,standupinfrontofajuryanddothis?Imean,Iwouldbetoo  afraidtodothat,Ithink....[Counsel]justalwayssaidthat, Youknow,Karla,what  elsecanIdo?Andhedidntsayitinthesenseof,youknow,Icantdoanyother  kindofbusiness,butwhatelseistheretodoexceptgoanddowhatyoucando.t   8   ` Hehad,Ibelieve,threestrokesduringthetimehewasinourofficeandhad L  tobeoutforperiodsoftime.[Counsel]alwayscamebackbeforehisdoctors 8  releasedhim,quitefrankly,Ithinkononeoccasion,andtheothertwotimeshecame $ t backbeforeweexpectedhimtocomeback,alwaysanxiousto,tobealawyer,tobe  ` atriallawyer. L    8   ` [Counsel]wasajoytosupervise,becauseifyouhadsomething,asa $  supervisor,ifIhadanassignmentoraparticularcasethatIdneedtotalktothestaff   about,...[Counsel]wouldalwaysvolunteerforthings.Henevershirkedhis   responsibilityinanyway.Hesquiteadmirable,Ithink....    8   ` [Counsel]tried,Ithink,morecasesthananyotherassistant[publicdefender] p inourofficeevertried,includingme.HetriedmanymorethanIdid.\   8   ` AndasIsaid,alotoftimeshewouldvolunteertoassistpeopleintrialsor. 4 ..hesometimesassistedbytryingcaseswhereaconflict,apersonalityconflictarose  p betweenanattorneyandtheirclient,andmanytimes[Counsel]wouldbetheoneto  \ takeoverthatcase,volunteertodoitandtrythecase.H     GothardtestifiedthatCounseldidnothavethemobilityskillsnortheBrailleskillsofpeople   wholosetheireyesightatanearlyage,butherofficeacquiredfundingtoprovideCounselwitha   readerwhowouldassisthim.Shetestified, Iadmired[Counsel]somuchthatIcanonlyofferpraise  forhimasapersonandasalawyer.ShestatedthatCounselsgreatestabilitywasintalkingtoa  juryandgettingthejurytolikehim.Gothardexplained, Ithinkthatoverall,throughtheyearsthat  Itriedcaseswithhim,Ithinkhewasverygoodatbuildingarelationshipwithajury....Ithinkthey l feltadmirationforhimaswell,buthewas...verygood,personablewiththejurors.Shestated X  thatCounselalsodidanexcellentjobatfocusingontherealissuesofacaseandtrying aclean D! casebynotgettingboggeddowninsideissues.GothardtestifiedthatCounselssenseofhearing 0"  wassogreatthathecouldtellwhenthejurorswerestirringaroundandgettingfidgety.Also,she #l! explainedthat [h]ecouldhearpeoplesnoreiftheywenttosleep,andhewould,youknow,raisehis $X" voiceoraskfora...recessorsomethingofthatsort. $D #   Gothardtestifiedthatshedidnothaveanyknowledgeaboutwhathappenedatthe &"% Petitionerstrial,butthePetitionersfilecontainednotesregardingthetrialandthedatesthat '#& CounselvisitedwiththePetitioner.Shestatedthataccordingtothefile,Counselvisitedwiththe (#' Petitioneratleasteighttimesatthejailtopreparefortrial. )$(  h+&*   II.Analysis    #X:XXAX:8F#SXXXX:  Inordertoobtainpostconvictionrelief,apetitionermustshowthathisorherconvictionor  sentenceisvoidorvoidablebecauseoftheabridgmentofaconstitutionalright.Tenn.CodeAnn. t 4030203(1997).Thepetitionerbearstheburdenofprovingfactualallegationsinthepetition ` forpostconvictionreliefbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f)(1997). L    First,thePetitionerarguesthatthepostconvictioncourterredbyfindingthatthePetitioner $ t wasnotdeniedeffectiveassistanceofcounsel.Inthepostconvictionhearing,thePetitionerraised  ` severalgroundsregardingwhetherCounselprovidedthePetitionerwitheffectiveassistanceduring  L  histrial.E X#  1      ׀However,inhisappellatebrief,thePetitionerbaseshisargumentthathewasdenied  8  effectiveassistanceofcounselupononlyoneground: thatcounselfailedtoadequatelymeetwith $  [thePetitioner]toadequatelypreparehimfortrialandtodiscussproceduresandtrialstrategieswith   him.#X:XXSXĬ#BecausethePetitionerfailedtoraisetheotherissuesrelatingtohisineffectiveassistanceof   counselclaiminhisappellatebrief,thePetitionerhaswaivedthoseissues.Tenn.R.App.P.13(b);   Nicholsv.State,90S.W.3d576,607(Tenn.2002).O^ XX:Ԁ   #X:X O^W#  SXXXX:Duringthepostconvictionhearing,#X:XXSXĽ#AX:XXX:thePetitionertestifiedthatCounselmetwithhimabout \ eighttimesregardinghisdefense, butitwasnt...enoughtoreallygooverthecaseandpossibly H comeupwithastrongdefense.HestatedthateachsessionwithCounsellastedonlythirtyminutes, 4 foratotaloffourhoursofmeetingswithCounsel.TheStatepresentedproof,throughthetestimony  p ofGothard,whichcorroboratedthePetitionersassertionthatCounselmetwiththePetitioneratleast  \ eighttimes.TheStatealsopresentedproofthatCounselsassistantandinvestigatorvisitedwiththe H Petitioneronvariousoccasionspriortothetrial.ThePetitionerfailedtopresentanyproofthatthis 4 amountofconferencetimewasinsufficientforCounseltopreparethePetitionersdefense.   Furthermore,thePetitionerfailedtopresentanyproofthatthelackofvisitswithCounselsomehow   prejudicedhimattrial.Tothecontrary,thePetitionertestifiedthatCounselexplainedthecharges  againsthim,whichdefenseswouldbebestattrial,andwhowouldtestifyagainsthimattrial.The  PetitioneralsotestifiedthatCounseldiscussedthepossibilityofthePetitionertestifyingattrialand  advisedthePetitionernottotakethestand.Accordingly,weconcludethat#X:XXAX:##AX:XXX: Counselsperformance l indefendingthePetitioner #X:XXAX:S#fallswithinthewiderangeofreasonableprofessionalassistance.
