Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt.@ FACTUALBACKGROUND OnApril11,1994Appellantpledguiltytorapeofaminorandreceivedanagreedupontwelveyearsentence.AsastandardRangeIOffender,Appellantsearliestparoleeligibilitydatewasafterserviceof30%ofhersentence.OnJuly20,1994,AppellantfiledaMotiontoModifySentencepursuanttoRule35oftheTennesseeRulesofCriminalProcedure.InherRule35motion,sheallegedthathersentenceshouldbemodifiedbecauseshewouldnotbeparoleduntilshehadserved50%ofhersentenceduetoherstatusasasexoffenderandthealleged policyoftheParoleBoardtodenyparoleofsexoffendersuntiltheyhadserved50%to60%oftheirsentence.AhearingwasheldonFebruary24,1995.AttheconclusionoftheFebruaryhearing,thepresidingjudgepermittedAppellanttosupplementtherecordonthestatisticalprofileofsexoffendersintheDepartmentofCorrectionascomparedwithothercriminals.ThehearingwasreopenedonJune24,1995.AttheJunehearing,AppellantintroducedthetestimonyofGaryLukowski,theassistantforPlanningandResearchfortheTennesseeDepartmentofCorrection.Hetestifiedthatsexoffendersweregrantedparolewithlessfrequencythanothercriminalsaccordingto1993/1994statistics.HefurthertestifiedthattheaveragesentenceforapersonconvictedofrapeinallgranddivisionsofTennesseewastwelveyearswithanaverageincarcerationofsixandahalfyearsbeforeparolewasgranted.Finally,Lukowskitestifiedthatothersexoffendersgenerallywerenotgrantedparoleuntiltheyservedover50%oftheirsentences.AppellantthentriedtointroducetheparolerecordsofelevencurrentsexoffenderinmatesintheTennesseePrisonforWomen.Thepresidingjudgedeniedcounselsrequesttointroducetheserecords.Appellantclaimsthatthesefileswouldhavehelpedprovethatsexoffenderswererequiredtoserve50%to60%oftheirsentencebeforeparolewasgranted.8 @ MOTIONTOMODIFYSENTENCE  InherMotiontoModifySentence,Appellantarguesthathersentenceshouldbemodifiedbecauseofanalleged policyoftheParoleBoardtodenysexoffendersparoleuntilfiftytosixtypercentoftheirsentencehasbeenserved.Becauseofthispolicy,Appellantarguesthatshewillbedeniedherthirtypercentreleaseeligibilitydateandthereforewillhavetoservesubstantiallymoretimethansheexpectedtoserve.AsentencemaybemodifiedunderRule35oftheTennesseeRulesofCriminalProcedurewhenthetrialcourtfindsthattheoriginalsentencemustbereduced intheinterestsofjustice.Statev.Hodges,815S.W.2d151,154(Tenn.1991);Statev.Irick,861S.W.2d375,276(Tenn.Crim.App.1993);Rule35(b),Tenn.R.Crim.P.(commissioncomments).However,whereatrialcourtacceptsaRule11(e)(1)(C)TennesseeRuleofCriminalProcedureguiltypleaagreement,thetrialcourtshouldnotmodifytheagreeduponsentenceabsentunusualcircumstances,suchasunforeseenpostsentencingdevelopment.Statev.McDonald,893S.W.2d945,947(Tenn.Crim.App.1994)citingStatev.Hargrove,1993WL300759,at*2(Tenn.1993).Onappeal,thetrialcourtsdispositionofamotiontomodifywillnotbedisturbedunlesstheappellantcourtfindsanabuseofdiscretion.Irick,861S.W.2dat376. Appellantsmotiontomodifyhersentencewasproperlydenied.Shehasfailedtodemonstrateanyunusualcircumstanceswhichwouldentitlehertoareducedsentence.AnyinformationregardingthereleaseeligibilitydatesofsexoffenderswouldhavebeenavailabletoAppellantwhensheagreedtothesentenceshereceived.Thefactshedidnotdiscoverthisevidenceuntilafterherpleadoesnotentitlehertoreliefeitherthroughareductionofsentenceorpostconvictionrelief.See,RickeySamsv.State,1996WL663884(holdingmisunderstandingastoparoleeligibilitynotsufficienttorenderguiltypleainvoluntary.) InviewofourholdingthatanymisunderstandingofherparoleeligibilitywouldnotentitleAppellanttoareductioninanagreeduponsentence,wefindthetrialcourtdidnoterrinrefusingtoallowAppellanttoplacetherecordsofotherfemalesexoffendersintoevidence.EvenifthishasbeenerroritwasharmlessinviewofthefactthatMr.Lukowskihadtestifiedtotheincreasedincarcerativeperiodsexperiencedbysexoffenders.Inaddition,therewasnorealdisputeatthehearingthatsexoffendersserverelativelylongerincarcerativeperiodsthandoothertypesofoffenders.Thus,theexclusionofthisevidenceaddslittleifanythingtotheresolutionofthismatter.
