Theindictmentagainstthepetitionerprovidesthathe didunlawfullyandfeloniouslyhavesexualintercoursewith[thevictim],bytheuseofforceandcoercion,anddidcausebodilyinjury,inviolationofT.C.A.392603.InHill,theindictmentallegedmerelythatthedefendanthad unlawfullysexuallypenetrate[d][thevictim]apersonlessthanthirteen(13)yearsofage.ThisCourtfoundthattheuseoftheword unlawfullywasnotsufficienttoallegethedefendantsmensrea,anessentialelementoftheoffense.Accordingly,theindictmentwasfoundfatallydefective.  Theindictmentinthepetitionerscaseissignificantlydifferent.Inadditiontoallegingthatthecrimewascommitted unlawfully,theindictmentprovidesthatthedefendantcommittedtheoffense feloniouslyand bytheuseofforceandcoercion.AspointedoutbytheState,JudgeTiptonofthisCourthaspreviouslyconsideredallegationssimilartothoseofthepetitionersinwhichthedefendanthadbeenchargedwith unlawfullyandfeloniouslysexuallypenetrat[ing][thevictim]byuseofforceorcoercion.SeeCharlesGatesv.State,No.03C019510CC00313,BradleyCounty(Tenn.Crim.App.OrderfiledAug.16,1996,atKnoxville).Inthatcase,JudgeTiptonruledasfollows: 8 Historically,thewordfeloniouslyhasmeant[p]roceedingfromanevilheartorpurpose;donewithadeliberateintentionofcommittingacrime.Asoursupremecourthaspreviouslynoted,onemeaningattachedtothewordis: Inalegalsense,donewiththeintenttocommitacrime.Certainly,thesementalstatesthatarenecessarilyinherentinthewordfeloniously,asrecognizedinTennesseeforthebetterpartofthiscentury,wouldincludearecklessmensrea,assuchexistsinthepresentlaw. 8 Anindictmentisnolessvalidforfailingtoallegetheoffenseinthewordsofthestatuteifitallegestheequivalenttothoseterms.Thus,theindictment,inchargingaggravatedrape,wasandisjurisdictionallysufficienttosupporttheentryofajudgmentofconvictionforrape....Id.(citationsomitted).SeealsoStatev.JohnHawsBurrell,No.03C019404CR00157,AndersonCounty(Tenn.Crim.App.filedFeb.11,1997,atKnoxville)(inwhichapanelofthisCourtadoptedwithapprovalJudgeTiptonsconclusionthattheterm feloniouslynecessarilyimpliesthemensreaofintentional,knowingorreckless).Thesamereasoningappliesinthiscase.Thisissueiswithoutmerit.
