Ðsought€to€question€the€sheriff€as€to€his€knowledge€of€the€victimððs€reputation€for€violence€in€theÐ à%0!$ Ðcommunity.€€The€trial€court€held€a€second€jury„out€hearing€and€determined€that€the€first€aggressorÐ Ì&"% Ðissue€had€been€raised,€and€therefore€the€defense€was€entitled€to€question€other€witnesses€about€theÐ ¸'#& Ðvictimððs€reputation€for€violence€in€the€community.€€During€the€jury„out,€Sheriff€Meeks€testified€thatÐ ¤(ô#' Ðhe€did€not€have€an€opinion€of€Sweetonððs€character€for€violence,€but€that€he€had€heard€from€oneÐ )à$( Ðâ âperson€that€the€victim€could€be€dangerous€when€he€was€drinking.€€The€trial€court€determined€that€theÐ |*Ì%) Ðsheriff€did€not€have€an€opinion€as€to€the€victimððs€reputation€for€violence,€and€that€the€opinion€of€oneÐ ° Ðperson€cannot€establish€a€victimððs€reputation€in€the€community.€€Ð œì Ðâ âÌà  à€€€While€Rule€405(a)€permits€the€defendant€to€introduce€evidence€from€a€witness€regardingÐ tÄ Ða€victimððs€reputation€for€violence,€the€witness€must€lay€a€foundation€for€their€testimony.€€€€Ô‡ XõXXXõÔN.€Cohen,Ð `° Ðet€al.,€òòTennessee€Law€of€Evidenceóó,€ðð€4.05[3][b]Ô#†XõXX Xõ‚H#Ô.€€In€order€to€establish€the€proper€foundation€forÐ L œ Ðreputation€or€opinion€testimony,Ð 8 ˆ ÐÌÒ°ÒÒ°Ò[a]n€opinion€witness€must€establish€that,€through€personal€experience,€he€or€she€isÐ  ` Ðsufficiently€familiar€with€the€person€whose€character€is€being€discussed€to€have€beenÐ ü L  Ðable€to€form€an€opinion€of€that€personððs€character.€.€.€.€€A€reputation€witness,€on€theÐ è 8  Ðother€hand,€must€show,€in€order€to€satisfy€the€hearsay€rule,€familiarity€with€theÐ Ô$  Ðpersonððs€ððreputation€among€associates€or€in€the€community.ðð€€Reputation,€of€course,Ð À  Ðrefers€to€the€collective€assessment€of€a€òògroup€of€peopleóó.Ð ¬ü  ÐÓi1ÓÓ  ÓÒ°—IÒÒ°¥IÒÌÔ‡ XõXXXõÔòòId.óó€(emphasis€added).Ô#†XõXX Xõ`L#ÔÐ „Ô  ÐÌà  àWe€conclude€that€the€opinion€of€one€person€cannot€form€the€basis€for€a€personððs€reputationÐ \¬ Ðin€the€community.€€Therefore,€the€trial€court€did€not€abuse€its€discretion€in€ruling€that€Sheriff€MeeksÐ H˜ Ðcould€not€testify€as€to€the€victimððs€reputation€for€violence€in€the€community.€€The€Defendant€is€notÐ 4„ Ðentitled€to€relief€on€this€issue.Ð  p ÐÌò òII.€Admissibility€of€the€Victimððs€Prior€Convictions€under€Rule€609ó óÐ øH ÐÌà  àNext,€the€Defendant€argues€that€the€trial€court€erred€in€ruling€that€he€could€not€question€theÐ Ð  Ðvictim€about€a€prior€conviction.€€The€Defendant€contends€that€evidence€of€the€victimððs€prior€felonyÐ ¼  Ðconviction€was€admissible,€because€1)€the€State€opened€the€door€by€asking€the€victim€if€he€had€beenÐ ¨ø Ðconvicted€of€a€prior€felony;€and€2)€Tenn.€R.€Evid.€609€permits€inquiry€into€prior€convictions€onÐ ”ä Ðcross„examination.Ð €Ð ÐÌà  àAt€trial,€defense€counsel€attempted€to€ask€the€victim€about€whether€his€prior€felonyÐ X ¨ Ðconviction€had€involved€a€crime€of€violence.€€This€question€drew€an€objection€from€the€State,€whichÐ D!” Ðthe€trial€court€sustained.€€The€trial€court€and€the€attorneys€engaged€in€a€bench€conference,€and€theÐ 0"€  Ðtrial€court€determined€that€it€would€not€allow€the€defense€to€ask€the€victim€about€the€nature€of€hisÐ #l!
