Thepetitionerwasoriginallyconvictedofseconddegreemurderin1975andsentencedtolifeimprisonment.Thepetitionerwasalsoconvictedofrobberywithadeadlyweaponandassaultwithintenttocommitmurderin1976andreceivedaneffectivetwentythreeyearsentence,tobeservedconsecutivelytothelifesentence.Itisunclearfromtherecordwhetherthepetitionerappealedtheseconvictions.Thepetitionersubsequentlyfiledahybridpetitionforpostconvictionreliefandpetitionforwritofhabeascorpus,whichwasdismissedbythetrialcourtonJune11,1986.ThisCourtaffirmedonappeal.RoyL.Crawfordv.State,No.21,ShelbyCounty(Tenn.Crim.App.,Feb.3,1988).  OnJanuary21,1998,thepetitionerfileda motiontoreopenandamendedpetitionforpostconvictionreliefandamendedpetitionforwritofhabeascorpus,whichwassummarilydismissedbythetrialcourt.Thetrialcourtfoundthatthepetitionforwritofhabeascorpuswasnotproperlybeforethecourtandthatthestatuteoflimitationshadexpiredonthepetitionforpostconvictionrelief.Onappeal,thepetitionerclaims,inessence,thatthetrialcourtshouldhavegrantedhimahearingonhispetitions.Thepetitionerallegedinhispetitionthatthereasonabledoubtinstructionwasunconstitutionalandthathisdueprocessrightswereviolatedwhenhewasarrestedonanallegedescapechargein1985.  ItappearsthepetitioneriscurrentlyincarceratedintheHardemanCountyCorrectionalCenter.PursuanttoT.C.A.2921105,apetitionforwritofhabeascorpusshouldbefiledwiththecourtorjudgenearestindistancetothepetitioner.Thiswasnotdoneandthepetitionerhasfailedtoprofferasufficientreasonfornotdoingsointhiscase.Accordingly,thecourtbelowproperlydismissedthepetitionforwritofhabeascorpuswithoutahearing.SeeStateexrel.Byrdv.Bomar,381S.W.2d280(Tenn.1964).  Furthermore,thetrialcourtproperlydismissedthepetitionforpostconvictionrelief.Thepetitionerischallengingaspectsofhisconvictionsfrom1975and1976,aswellashisarrestontheallegedescapechargein1985.Thispetitionisclearlybarredbythestatuteoflimitationsandthepetitionerhasnotsatisfiedanexceptiontothestatute.T.C.A.4030202.Accordingly,thetrialcourtproperlydismissedthepetitionwithoutahearing.T.C.A.4030206(b).Norhasthepetitionermettherequirementstoreopenhispriorpetitionforpostconvictionrelief.SeeT.C.A.4030217.
