Asdefendantpassedfourfullyloadedtobaccotractors,hemetTroopersBillMillerandTony   Wilsonatthebottomofasmallhill.Bothtroopersweretravelinginseparatecruisersintheopposite   directionofdefendant.Defendantsvehiclewasclockedusingaradarspeeddetectiondeviceat76 p milesperhourina55milesperhourspeedzone.Bothtroopersturnedtheirvehiclesaroundforthe \ purposeofcitingdefendant.Withinthreetenthsofamilefromwherethetroopersturnedtheir H vehicles,theyfounddefendantsvehicleamidstafuryofdustintheQuickStopMarketgravel 4 parkinglot.Thedriversdoorwasajar,anddefendantwasnotinsidethevehicle.  p   Thetroopersproceededinsidethemarketwheretheyfounddefendant.Defendantsmelled H ofalcoholandurine,sotheyescorteddefendantoutside.Herefusedtosubmittoabreathalcohol 4 testandperformedpoorlyonfieldsobrietytests.Theofficersconcludedthathewasdrivingunder   theinfluenceofanintoxicant.     Defendanttestifiedthathedrankfourbeerssixhoursearlieratlunch,butbecausehewas  landscaping,hedrankfourgallonsofwaterduringthesixhoursprecedinghisarrest.Hedeniedthat  hewasundertheinfluenceofalcohol. l @ II.TIMELINESSOFAPPEAL  0"      Thestatecontendsthatdefendantsappealshouldbedismissedbecausetheconvictionsand $X" sentenceswereenteredonSeptember16,1999;nomotionfornewtrialwasfiled;anddefendant $D # filednoticeofappealonNovember3,1999.Althoughthestateiscorrectinitsassertionthat %0!$ defendantfailedtofileatimelynoticeofappeal,wewaivethisrequirementandreachthemeritsof &"% thiscase.SeeTenn.R.App.P.4(a).
