Theappellantcontendsthatthe reasonabledoubtjuryinstructiongivenbythetrialcourtwasconstitutionallyinfirmbecauseitincludedthephrase moralcertainty.Thisclaimiswithoutmerit.InVictorv.Nebraska,511U.S.1,114S.Ct.1239,127L.Ed.2d583(1994),theUnitedStatesSupremeCourtexpressedcriticismofthecontinueduseofthe"moralcertainty"phrase,however,theCourtdidnotactuallyholdthatitwasconstitutionallyinvalid.Instead,theCourtlookedtothefulljurychargetodetermineifthephrasewasplacedinsuchacontextthatajurywouldunderstandthatitmeantcertaintywithrespecttohumanaffairs.Id.at1317,114S.Ct.at124748.Inparticular,theCourtwasconcernedwiththeterms"graveuncertainty"and"actualsubstantialdoubt."Cagev.Louisiana,498U.S.39,41,111S.Ct.328,32930,112L.Ed.2d339(1990).  Wenotethatthejuryinstructionwasnotincludedinthisrecordonappeal,however,counselfortheappellantreadthechallengedportiontothetrialcourtduringthepostconvictionhearing.Fromourreviewofthisportionofthejuryinstruction,wefindthatalthoughthephrase"moralcertainty"wasincluded,thetermsofparticularconcerntotheUnitedStatesSupremeCourtwerenotincludedinthecharge.ThisCourthasconsistentlyupheldsimilarinstructionsascongruouswithconstitutionalprinciples.SeePettyjohnv.State,885S.W.2d364,36566(Tenn.Crim.App.1994);Statev.Hallock,875S.W.2d285,294.Moreover,ourSupremeCourthasheldthat"[t]heuseofthephrase'moralcertainty'byitselfisinsufficienttoinvalidateaninstructiononthemeaningofreasonabledoubt."Statev.Nichols,877S.W.2d722,734(Tenn.1994),cert.denied,___U.S.___,115S.Ct.909,130L.Ed.2d791(1995).  Thus,thechargegivenbythetrialcourt,althoughcontainingthephrase"moralcertainty,"didnotviolatetheappellantsrightsundertheUnitedStatesorTennesseeConstitutions.  TheappellantalsoreliesontheopinionofthefederaldistrictcourtinRickmanv.Dutton,864F.Supp.686,707(M.D.Tenn.1994).ThisCourtisonlyrequiredtofollowtheapplicableconstitutionalrulingsoftheUnitedStatesSupremeCourt.SeeStatev.McKay,680S.W.2d447,450(Tenn.1984),cert.denied,470U.S.1034,105S.Ct.1412,84L.Ed.2d795(1985);Statev.Bowers,673S.W.2d887,889(Tenn.Crim.App.1984).Seealso,Statev.Vickers,159Ariz.532,768P.2d1177,1188n.2(1989),cert.denied,497U.S.1033,110S.Ct.3298,111L.Ed.2d806(1990)(ArizonaSupremeCourtrefusestofollowNinthCircuit'sinvalidationofArizonadeathpenaltystatute).
