OnJuly16,1990,PetitionerwasconvictedoftheoffenseofrapefollowingatrialintheCriminalCourtofShelbyCounty.Thiscourtaffirmedtheconvictionondirectappeal,andthesupremecourtdeniedhisapplicationforpermissiontoappealonJanuary27,1992.OnNovember3,1993,hefiledapetitionforpostconvictionreliefattackingthisconvictionbaseduponallegationsofreceivingineffectiveassistanceofcounsel.ThetrialcourtdismissedthepetitionandthiscourtaffirmedthedismissalofthepostconvictionpetitiononAugust30,1995.AntonioCrenshawv.State,No.02C019502CR00050,ShelbyCounty(Tenn.Crim.App.,Jackson,Aug.30,1995).  OnApril18,1996,PetitionerfiledhissecondpetitionforpostconvictionreliefintheCriminalCourtofShelbyCounty.Asgroundsforrelief,heallegedthattheindictmentwasinsufficientbecauseitfailedtoallegealloftheelementsofrape,thattherewasanunconstitutionalselectionofboththegrandjurywhichreturnedtheindictmentandthepetitjurywhichconvictedhim,thattheStaterefusedtodiscloseexculpatoryevidence,thattherewerevariouserrorsbythetrialcourtduringandafterhistrial,thattheStatewasguiltyofprosecutorialmisconduct,andthattheprosecutionusedperjuredtestimony.  Thenew PostConvictionProcedureActwasenactedbyPublicActsof1995,ch.207.Section3ofthatActprovidedthattheActshallgovernallpetitionsforpostconvictionrelieffiledafterMay10,1995.Petitionerssecondpetition,therefore,isgovernedbythenewAct.TennesseeCodeAnnotatedsection4030202(c)providesinpertinentpartasfollows:8 (c)Thispartcontemplatesthefilingofonlyone(1)petitionforpostconvictionrelief.Innoeventmaymorethanone(1)petitionforpostconvictionreliefbefiledattackingasinglejudgment.Ifapriorpetitionhasbeenfiledwhichwasresolvedonthemeritsbyacourtofcompetentjurisdiction,anysecondorsubsequentpetitionshallbesummarilydismissed.  RegardingtheallegationsthattheStatefailedtodiscloseexculpatoryevidence,thePetitionerallegesthattheevidencepertainedtoinconsistentstatementsand otherevidencemadebyandconcerningprosecutionwitnesseswhichcontradictedtheStatestheoryofthecaseagainstPetitioner.Specifically,Petitionerallegesthat [a]mongothers,the[S]tatemadeadealwithStatewitnessKatronKendricktoreducethependingchargesagainsthiminexchangeforhisfalseevidenceconcerningthesequenceofeventsinvolvingthefactsofthiscase.HealsoallegestheprosecutionwithheldcomputerprintoutsandjaillogbookswhichconclusivelyshowedthatPetitionerwasnothousedorphysicallypresentatthelocationoftherape.Petitionerfailstoallegewhenorhowheobtainedtheinformationwhichformsthebasisoftheseallegationsanddidnotfileanyexhibitswithhispetitiontosupporttheallegations.̀  Therefore,weconcludethattheallegationsinthepetitionconcerningthefailuretodiscloseexculpatoryevidencedonotrisetothelevelnecessarytograntreliefunderBurfordv.State,845S.W.2d204(Tenn.1992).  Wehavecarefullyreviewedtheremainingallegationscontainedinthepetitionandnotethatallcouldhavebeenbroughteitherinthedirectappealoftheconvictionorinthefirstpetitionforpostconvictionrelief.Petitionerdoesnotsetforththereasonsthathedidnotbringthesegroundsinpriorproceedings,otherthanassertingthatthenewPostConvictionProcedureActallowshimoneyearfromMay10,1995tofileapetitionforpostconvictionrelief.Thisassertioniswithoutmerit.SeeArnoldCarterv.State,____S.W.2d____,No.03S019612CR00117,MonroeCounty(Tenn.,atKnoxville,Sept.8,1997).  PetitioneralsoarguesonappealthatthetrialcourterredbydismissinghispetitionwithoutenteringapreliminaryorderpursuanttoTennesseeCodeAnnotatedsection4030207.However,asarguedbytheStateinitsbrief,TennesseeCodeAnnotatedsection4030206(b)statesinpertinentpartasfollows: Ifitplainlyappearsfromthefaceofthepetition,anyannexedexhibitsorthepriorproceedingsinthecasethat...apriorpetitionwasfiledattackingtheconvictionandwasresolvedonthemerits,thejudgeshallenteranorderdismissingthepetition.Likewise,PetitionersassertionsthatthetrialcourtdidnotproperlycomplywiththeprovisionsofTennesseeCodeAnnotatedsection4030206(a)arewithoutmerit.̜  Weaffirmthejudgmentofthetrialcourt.       ____________________________________     THOMAST.WOODALL,JudgeCONCUR:___________________________________GARYR.WADE,Judge___________________________________JOHNH.PEAY,Judge
