Ðperson.Ô#†XÁXX XÁ›+#ÔÔ‡ XÁXXXÁÔÐ $X" ÐÌà  àJoseph€Russell,€who€at€the€time€of€the€Defendantððs€trial€had€also€been€charged€with€theÐ à%0!$ Ðmurder€of€the€victim,€testified€that€in€1996€he€had€been€a€drug€dealer€for€eight€or€nine€years.€€RussellÐ Ì&"% Ðtestified€that€the€victim€was€his€drug€supplier€and€that€the€Defendant€was€another€local€drug€dealer.€Ð ¸'#& ÐRussell€stated€that€at€approximately€10:00€p.m.€on€July€14,€1996,€the€Defendant,€whom€Russell€hadÐ ¤(ô#' Ðnever€met€before,€approached€Russell€and€asked€to€purchase€a€quarter„ounce€of€crack€cocaine.€Ð )à$( ÐRussell€informed€the€Defendant€that€he€did€not€have€the€quantity€of€ð ðdopeðð€that€the€DefendantÐ |*Ì%) Ðrequested€and€would€have€to€contact€his€supplier.€€Ð h+¸&* Їà  àRussell€and€the€Defendant€then€got€a€ride€with€a€man€named€Sterling€Howard€to€theÐ ° Ðapartment€of€€Russellððs€friend,€Shemmika€Fullwiley,€and€her€roommate,€Stacey€Young.€€AccordingÐ œì Ðto€Russell,€he€and€the€Defendant€remained€at€Fullwileyððs€for€a€brief€period€of€time€drinking€beer€andÐ ˆØ Ðsmoking€marijuana.€€Russell€testified€that€while€there,€the€Defendant€pulled€out€a€pistol€and€laid€itÐ tÄ Ðon€a€table.€€Russell€reported€that€he€picked€up€the€pistol€and€told€the€Defendant€to€put€it€away.€Ð `° ÐRussell€then€paged€the€victim.€€According€to€Russell,€the€victim€called€Russell€a€few€minutes€later,Ð L œ Ðand€Russell,€the€victim€and€the€Defendant€agreed€to€meet€at€the€Mapco€station€because€the€victimÐ 8 ˆ Ðsaid€that€the€Clementine€apartment€complex€where€Fullwiley€and€Young€lived€was€ð ðhotðð€with€police.€Ð $ t ÐÌà  àRussell€testified€that€he€and€the€Defendant€then€walked€to€the€convenience€store.€€As€theyÐ ü L  Ðwere€walking,€the€Defendant€asked€Russell€how€much€money€he€owed€the€victim,€and€the€DefendantÐ è 8  Ðtold€Russell€that€he€should€not€pay€the€victim€what€he€owed€the€victim.€€They€arrived€at€the€MapcoÐ Ô$  Ðas€the€victim€was€walking€from€the€store€to€his€car.€€Russell€recalled€that€all€three€of€the€men€got€intoÐ À  Ðthe€vehicle€at€the€same€time.€€Russell€got€into€the€front€passenger€seat,€and€the€Defendant€got€intoÐ ¬ü  Ðthe€rear€seat€just€behind€Russell.€€Russell€testified€that€after€the€victim€got€into€the€car,€the€victimÐ ˜è  Ðstarted€the€car,€passed€a€quarter„ounce€of€crack€cocaine€to€Russell,€and€then€asked€the€Defendant€forÐ „Ô  Ðmoney.€€The€Defendant€asked€how€much€the€victim€wanted,€and€the€victim€replied€by€asking€howÐ pÀ Ðmuch€the€Defendant€had.€€According€to€Russell,€the€Defendant€stated€that€he€wanted€Russell€and€theÐ \¬ Ðvictim€to€give€him€ð ðeverything€thatððs€in€the€car,ðð€but€started€shooting€before€Russell€and€the€victimÐ H˜ Ðhad€a€chance€to€respond.€€Ð 4„ ÐÌà  àRussell€testified€that€when€the€shooting€started,€the€victim€ð ðjacked€back€in€the€car,ðð€and€theÐ  \ Ðcar€began€to€ð ðspeed€up€a€lot.ðð€€The€car€surged€across€the€street€and€crashed€into€a€fence.€€At€thisÐ øH Ðpoint,€Russell€jumped€out€of€the€car.€€Russell€stated€that€he€started€running€down€the€street€and€sawÐ ä4 Ðthe€Defendant€lying€in€the€street€by€a€curb.€€Russell€recalled€that€he€heard€the€Defendant€moan€andÐ Ð  Ðthen€saw€the€Defendant€stop€moving.€€Russell€testified€that€he€did€not€stop€to€help€the€Defendant.€Ð ¼  ÐHowever,€he€saw€a€woman€driving€down€the€street,€and€the€woman€asked€him€if€she€could€help.€Ð ¨ø ÐRussell€stated€that€he€told€her€to€call€the€police.€€Russell€reported€that€he€then€ran€back€toÐ ”ä ÐFullwileyððs,€where€he€ran€inside€and€ð ðthrowed€up€in€their€bathroom.ðð€€Russell€testified€that€he€didÐ €Ð Ðnot€remain€at€the€scene€because€he€was€ð ðscared.ðð€€Russell€stated€that€while€at€Fullwileyððs€apartment,Ð l¼ ÐFullwiley€noticed€blood€on€Russellððs€shirt.€€Russell€reported€that€two€days€after€the€incident,€he€sawÐ X ¨ Ðthe€incident€on€the€news€and€called€the€police.€€Ð D!” ÐÌà  àShemmika€Fullwiley€testified€that€on€July€14,€1996,€Russell€and€the€Defendant€came€to€herÐ #l! Ðvictim,€and€in€the€process,€shot€the€victim€numerous€times€in€the€head€and€shoulder€region.€€AfterÐ H˜ Ða€review€of€the€record,€we€believe€that€there€is€sufficient€corroboration€in€the€record€of€thisÐ 4„ Ðaccomplice€testimony.€€Sergeant€Robert€Shemwell€testified€that€four€spent€cartridge€casings€and€oneÐ  p Ðspent€bullet€fragment€were€recovered€from€inside€the€vehicle€in€which€the€Defendant,€Russell,€andÐ  \ Ðthe€victim€were€reportedly€riding€at€the€time€of€the€crime.€€Dr.€Smith€opined€that€if€the€victim€wasÐ øH Ðdriving€the€car,€the€gun€was€probably€fired€from€behind€him.€€The€record€reveals€that€after€forensicÐ ä4 Ðstudy,€the€shell€casings€and€fragments€were€determined€to€have€been€fired€from€the€weapon€thatÐ Ð  ÐOfficer€Eric€Rogers€found€in€a€grassy€area€near€the€car.€€Shemmika€Fullwiley€and€Stacey€YoungÐ ¼  Ðtestified€that€the€Defendant€had€a€gun€on€his€person€in€their€apartment€earlier€that€night.€€FullwileyÐ ¨ø Ðtestified€that€the€gun€shown€to€her€in€court€was€very€similar€to€the€gun€that€she€saw€the€DefendantÐ ”ä Ðlay€on€a€table€in€her€home€on€the€night€of€the€offense.€€Stacey€Young,€Fullwileyððs€roommate,€testifiedÐ €Ð Ðthat€when€Russell€ran€into€her€apartment€after€the€shooting,€he€said€that€the€Defendant€tried€to€robÐ l¼ Ðthe€victim.€€Fullwiley€claimed€that€Russell€said€that€the€Defendant€shot€the€victim.€€We€conclude€thatÐ X ¨ Ðthere€was€sufficient€evidence€to€corroborate€the€testimony€of€accomplice€Joseph€Russell.€Ð D!” ÐAccordingly,€the€evidence€presented€to€the€jury€is€sufficient€to€sustain€the€Defendantððs€convictions.€Ð 0"€  Ѐ€Ìà@ìàB.€€Lost€or€Destroyed€EvidenceˆÐ $X" ÐÌÓ XÓThe€Defendant€also€argues€that€the€trial€court€erred€in€denying€his€request€for€a€special€juryÐ à%0!$ Ðinstruction€on€the€loss€or€destruction€of€evidence€regarding€the€results€of€a€paraffin€test€allegedlyÐ Ì&"% Ðconducted€on€the€Defendant€to€determine€whether€he€had€recently€fired€a€weapon.€€The€TennesseeÐ ¸'#& ÐSupreme€Court€addressed€the€issue€of€lost€or€destroyed€evidence€in€òòState€v.€Fergusonóó,€2€S.W.3d€912,Ð ¤(ô#' Ð917€(Tenn.€1999).€€In€òòFergusonóó,€the€court€adopted€a€balancing€approach€to€determine€whether€aÐ )à$( Ðdefendantððs€right€to€a€fundamentally€fair€trial€has€been€affected€by€the€loss€and/or€destruction€ofÐ |*Ì%) Ðevidence.€€òòId.óó€at€917„18.€€Under€òòFergusonóó,€when€the€loss€or€destruction€of€evidence€occurs,€the€firstÐ h+¸&* Ðstep€is€to€determine€whether€the€State€had€the€duty€to€preserve€the€evidence€in€question.€€òòId.óó€€OnceÐ ° Ðthe€proof€demonstrates€the€existence€of€a€duty€to€preserve€the€evidence€in€question€and€the€stateððsÐ œì Ðfailure€in€that€regard,€the€court€should€examine€the€following:€(1)€the€degree€of€negligence€involved;Ð ˆØ Ð(2)€the€significance€of€the€missing€evidence,€taken€in€light€of€the€probative€value€and€reliability€ofÐ tÄ Ðwas€lost€or€destroyed€even€existed.€€Sgt.€Fitzpatrick€testified€that€his€notes€indicated€that€OfficerÐ  ` ÐMcNabb€told€him€that€McNabb€conducted€a€paraffin€test€on€the€Defendant€to€determine€if€he€hadÐ ü L  Ðrecently€fired€a€weapon.€€However,€Fitzpatrick€testified€that€he€never€received€any€paraffin€testÐ è 8  Ðresults€and€that€no€test€results€were€located.€€Other€than€Fitzpatrickððs€testimony,€no€evidence€that€aÐ Ô$  Ðparaffin€test€was€ever€conducted€is€included€in€the€record.€€The€trial€court€determined€that€it€couldÐ À  Ðnot€be€shown€whether€or€not€the€paraffin€test€was€conducted€and,€therefore,€whether€any€test€resultsÐ ¬ü  Ðwere€actually€lost€or€destroyed€by€the€State.€€We€agree.€€After€a€review€of€the€record,€we€haveÐ ˜è  Ðconcluded€that€there€is€no€substantial€evidence€showing€that€the€test€was€ever€conducted.€Ð „Ô  ÐÐ pÀ ÐNevertheless,€we€also€conclude€that€even€if€such€a€test€was€conducted,€the€Defendant€hasÐ \¬ Ðfailed€to€demonstrate€that€his€right€to€a€fair€trial€was€affected€by€the€loss€and/or€destruction€of€theÐ H˜
