Crowsoriginalconvictionandsentencewereaffirmedbythiscourt.Statev.Crow,1993WL247948,C.C.A.No.01C019110CC00304(Tenn.Crim.App.filedJuly8,1993,inNashville).Hefiledforpostconvictionrelief.Thedenialofthatpetitionresultedinthisappeal.  DENIALOFCOUNSEL   CrowallegesthathewasdeniedcounselatacriticalstageofprosecutioninviolationoftheSixthAmendmentoftheUnitedStatesConstitution.Thisissuewasaddressedondirectappealandfoundtobewithoutmerit.Therefore,theissuehasbeenpreviouslydetermined.T.C.A.4030112(a)(1990);Statev.House,911S.W.2d705(Tenn.1995).  PROSECUTORIALMISCONDUCT   Crownextallegesthatthestateengagedinprosecutorialmisconductbyimproperlyexpressingitsopinionduringclosingargument.Weagreewiththetrialcourtsfindingthatthecommentswerenotimproperandnotprejudicial.Therefore,thisissueiswithoutmerit.  DUEPROCESSCLAIM   Crowalsoarguesthatthedelayofovereighteenmonthsforthepreparationofthetrialtranscriptisaviolationofhisdueprocessrights.Hecitesnoauthorityforthisclaim;therefore,theissueiswaived.Rule10(b),RulesoftheCourtofCriminalAppeals.Furthermore,thedelay,althoughunfortunate,isnotadenialofCrowsdueprocessrights.  INEFFECTIVEASSISTANCEOFCOUNSEL   Crowcontendshistrialattorneyswereineffectiveinadvisinghimnottotestify.Thisadvicewasatacticaldecision.SeeHellardv.State,629S.W.2d4(Tenn.1982).Furthermore,therecordshowsitwasCrowsdecisionnottotestify.Therehasbeennoshowingofprejudice.SeeStricklandv.Washington,466U.S.668,694,104S.Ct.2052,80L.Ed.2d674(1984). Crowcontendshistrialattorneyswereineffectivebyfailingtochallengethevalidityofapriorconvictionthatwasusedtoenhancehissentence.Thetrialcourtconcludedthatsuchachallengewouldnothavebeensuccessful.Crowhasnotshownanythingtothecontrary.Thefailuretochallengethepriorconvictionwaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2930,936(Tenn.1975). Ourreviewoftherecorddoesnotrevealanydeficientperformanceofcounsel,norhastherebeenanyprejudicetoCrowasaresultofcounselsperformance.Thisissueiswithoutmerit.SeeStricklandv.Washington,supra.
