ÐTo€prevail€on€a€claim€of€inef‚fective€counsel,€petitioner€ð ðmust€show€that€counselððsÏrepresenta‚tion€fell€below€an€objective€standard€of€reason‚ablenessðð€and€that€thisÏperformance€prejudiced€the€defense.€€There€must€be€a€reasonable€probability€that,Ïbut€for€coun‚selððs€error,€the€result€of€the€proceeding€would€have€been€different.€€òòSeeóó€Ð   Ðòò¢Strickland£€v.€Washingtonóó,€466€U.S.€668,€687„88,€692,€694€(1984);€òòBest€v.€Stateóó,€708Ð à€ ТS.W.2d£€421,€422€(Tenn.€¢Crim£.€App.€1985).ÌÔ‡XéæXXXéæÔÌà Œ àThis€Court€should€not€second„guess€trial€counselððs€tactical€and€strategicÏchoices€unless€those€choices€were€uninformed€because€of€inadequate€preparation,Ïòòseeóó€òò¢Hellard£€v.€Stateóó,€629€¢S.W.2d£€4,€9€(Tenn.€1982);€and€counsel€should€not€beÐ @à Ðdeemed€to€have€been€ineffective€merely€because€a€different€procedure€or€strategyÏmight€have€produced€a€different€result.€€òòSeeóó€òòWilliams€v.€Stateóó,€599€¢S.W.2d£€276,€280Ð   Ð(Tenn.€¢Crim£.€App.€1980).Ô#†XéæXXXéæÿ#ÔÐ à€ ÐÌà Œ àThe€reviewing€court€found€that€the€only€proof€as€to€the€petitioner's€mentalÏcondition€was€the€petitioner's€own€testimony€that€he€had€told€his€attorney€before€trialÏthat€he€ð ðwanted€to€see€a€psychiatristðð€and€thought€he€ð ðshould€be€admitted€into€aÏhospital.ðð€€The€court€found€that€this€ð ðbare€assertionðð€by€the€petitioner,€uncorroboratedÏby€any€independent€proof€that€he€had€been€suffering€from€some€mental€defect€at€theÏtime€of€trial,€was€insufficient€to€carry€his€burden€of€proof.€€We€agree.€€This€issue€isÏwithout€merit.ÌÌà Œ àAs€to€the€witnesses€that€defense€counsel€allegedly€failed€to€interview€andÏcall€at€trial,€these€persons€testified€at€the€post„conviction€hearing.€€The€court€belowÏfound,€Ð `6-0 ÐÒŒ SÒÒ4¦ÒÓÓIf€anything,€some€of€the€statements€that€were€made€by€theÏ¢witness[es£]€ñŽ ñœñŽ ñtoday€wouldñŽ ñ›ñŽ ñ€have€been€detrimental€to€ñŽ ñœñŽ ñtheÏdefendantñŽ ñ›ñŽ ñ€at€trial.€€And€counsel€was€probably€„„€not€only€wasÏhe€not€deficient€in€not€calling€those€witnesses,€he€probablyÏexercised€[a]€wise€tactical€decision€in€not€calling€theÏwitnesses€because€they€would€have€been€more€detrimentalÏthan€helpful€to€the€petitioner's€cause.ÌÒSŒ F ÒÒ¦4T ÒÌÓÓWe€agree.€€This€issue€is€without€merit.ÌÌà Œ àThe€petitioner€also€contends€that€his€trial€lawyer€was€ineffective€because€heÏdid€not€present€testimony€that€the€victim€had€been€wielding€a€knife€at€the€time€theÏpetitioner€killed€him.€€At€his€post„conviction€hearing,€the€petitioner€testified€that€theÏvictim€had€attacked€him€with€a€knife.€€However,€he€admitted€on€cross„examination€toÏhaving€testified€at€trial€that€the€victim€had€not€had€a€knife€and€that€a€knife€ñŽ ñœñŽ ñwas€noñ‹ ññŠ ñpñŠ ññ‹ ñtÏñŒ ñinvolvedñŒ ññ ñhad›€nothing›€to›€do›€with›€itñ ñ.ñŽ ñ›ñŽ ñ€€Moreover,€the€petitioner€presented€no€proof€at€the€post„conviction€hearingÏ(other€than€his€own€testimony)€that€the€victim€had€threatened€or€attacked€him€with€aÏknife.€€Obviously,€the€petitioner's€attorney€could€not€pursue€this€line€of€defense€underÏthese€circumstances.€€Indeed,€as€found€by€the€hearing€court,ÌÓÓà8 Œ àIf€the€defendant€testified€at€trial€there€was€not€a€knife€and€the€onlyÏ[other€testifying]€.€.€.€eye„witness€.€.€.€testified€there€wasn't€a€knifeÏinvolved,€what€was€counsel€to€do?€€He€can't€fabricate€somethingÏthat€is€just€not€there.€€Ð Œ ù!Œ ù! ÐÌà8 Œ àToday€the€defendant€says€there€was€a€knife.€€He€is€the€only€oneÏthat€says€that.Ð Œ ù!Œ ù! ÐÌÓÓThis€issue€is€without€merit.ÌÌà Œ àFinally,€the€petitioner€contends€that€his€lawyer€was€ineffective€in€not€movingÏto€suppress€his€statement.€€Inexplicably,€the€hearing€court€failed€to€make€any€findingsÏwith€respect€to€this€allegation.€€The€petitioner€testified€at€his€post„conviction€hearingÏthat€he€had€told€his€attorney€he€had€been€ð ðcoerced€into€signingðð€a€statement€he€hadÐ `6-0 Ðgiven€to€an€assistant€district€attorney€and€a€detective€shortly€after€he€shot€the€victim.€ÏSpecifically,€he€testifiedÌÓÓñ“ ñÓ  Óñ“ ñà8 Œ àWhen€I€was€brought€in€for€questioning€after€leaving€the€hospitalÏfrom€being€¢sew[n£]€up,€Mr.€Reed€was€questioning€me€and€I€told€himÏa€little€bit€of€what€happened.€€Then€I€advised€him€that€I€wanted€myÏright€to€an€attorney€to€be€present€before€I€say€any€more.€€He€thenÏsaid€well,€you€have€told€more€or€less€the€story.€€He€said€but€youÏneed€to€go€ahead€and€finish€it€and€sign€this€statement.€€I€told€himÏthat€I€wanted€an€attorney€present.Ð Œ ù!Œ ù! ÐÌà8 Œ àThat€is€when€this€other€gentleman€I€didn't€know€at€the€time€said€IÏneeded€to€sign€the€statement.Ð Œ ù!Œ ù! Ðà Œ à.€.€.€Ìà8 Œ àHe€stood€up€and€said€yeah,€you€need€to€tell€us€what€happened€andÏyou€need€to€tell€us€now.€€I€asked€the€gentleman,€I€said€what€if€IÏdon't?€€He€said€well,€I'm€a€district€attorney,€Gary€Jones,€and€I€willÏgive€you€the€F„ing€chair€if€you€don't€sign€the€statement.Ð Œ ù!Œ ù! Ðñ“ ñÓP)Óñ“ ñÌÓÓAccording€to€the€petitioner,€he€signed€the€statement€because€of€this€threat€by€theÏassistant€district€attorney.€€He€further€testified€that€when€he€told€his€trial€counsel€aboutÏthis,€his€lawyer€ð ðtold€[him]€that€[he]€shouldn't€say€anything€about€the€coercion.ððÌÌà Œ àNeither€of€the€law€enforcement€officials€involved€in€taking€the€petitioner'sÏstatement€testified€at€the€post„conviction€hearing;€neither€did€the€petitioner's€trialÏcounsel.€€However,€this€Court€found€on€the€direct€appeal€of€the€petitioner's€case€€thatÏð ðDetective€Reed€recounted€the€circumstances€surrounding€the€statement€given€by€theÏdefendant€on€the€morning€after€the€killing.€€He€stated€that€he€advised€the€defendant€ofÏhis€rights€and€that€the€defendant€responded€that€he€was€able€to€talk.ðð€€The€remainderÏof€Detective€Reed's€testimony€recounted€what€the€petitioner€had€told€him€and€how€itÏdiffered€from€the€petitioner's€testimony€at€the€preliminary€hearing.€€Apparently,€theÏpetitioner's€written€statement€was€not€introduced€at€trial.׃×Ý ƒ #ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×Ð  2@), Ðà Œ àDetective€Reed's€testimony€at€trial€about€what€the€petitioner€had€told€himÏwas€summarized€by€this€Court€as€follows:ÌÓÓà8 Œ àThe€defendant€told€Detective€Reed€that€he,€his€mother€and€Mr.Ï¢Pinkston£€had€gotten€into€an€argument€over€who€would€drive€homeÏfrom€the€bar€the€night€before.€€They€were€still€arguing€when€theyÏreturned€home€and€the€victim€told€the€defendant€not€to€cuss€theirÏmother.€€The€victim€hit€the€defendant€and€a€fight€ensued€that€lastedÏabout€three€minutes.€€The€defendant€told€Detective€Reed€that€heÏwanted€to€get€his€mother's€pistol€from€her€bedroom€in€order€toÏscare€the€victim.€€He€remembered€his€mother€warning€the€victim€asÏhe€walked€to€the€back€bedroom€for€the€gun.€€The€defendant€toldÏDetective€Reed€that€he€thought€the€victim€had€a€gun€in€his€car.€ÏThe€defendant€went€to€the€bathroom€to€wipe€his€face€and€returnedÏto€the€living€room.€€He€told€Detective€Reed€that€his€mother€alwaysÏkept€the€pistol€loaded.Ð Œ ù!Œ ù! ÐÌà8 Œ àInitially,€the€defendant€told€Detective€Reed€that€the€victim€returnedÏto€the€trailer€and€began€fighting€with€him€again.€€Later,€theÏdefendant€said€that€the€victim€was€in€the€front€doorway€when€aÏstruggle€began€and€that€he€shot€the€victim€while€the€victim€was€onÏtop€of€him.€€He€told€Detective€Reed€that€he€tried€to€revive€the€victimÏwith€CPR€for€about€twenty€minutes€and€finally€told€Mr.€¢Pinkston£€toÏcall€911.€€When€asked€what€happened€to€the€gun,€he€reported€thatÏMr.€¢Pinkston£€took€the€gun€away€from€him€and€hit€him€in€the€headÏwith€it€after€he€shot€the€victim.€Ð Œ ù!Œ ù! ÐÌThis€Court€further€summarized€the€petitioner's€own€testimony€at€trial:ÌÌà8 Œ àThe€defendant€testified€that€he,€his€mother€and€Mr.€¢Pinkston£€wentÏto€a€local€bar€and€drank€ðða€lot€of€beer'€in€the€evening€of€NovemberÐ p& Ð6,€1993.€€They€arrived€home€and€began€drinking€again.€€TheÏdefendant€stated€that€the€victim€had€been€arguing€with€him€whenÏthe€defendant's€girlfriend€arrived.€€He€stated€that€they€were€sittingÏthere€when€ððthe€next€thing€I€know€I€get€hit€upside€the€head.'€€HeÐ 0*Ð # Ðtestified€that€the€victim€hit€him€with€the€heating€element€and€hit€himÏmore€than€once€with€his€fist.€€He€stated€that€the€victim€pointed€hisÏfinger€at€him€and€threatened€him€before€going€outside.€€He€testifiedÏthat€he€went€to€his€mother's€room€to€get€her€pistol€because€he€wasÏscared€that€the€victim€had€gone€to€get€his€.32€pistol€from€his€car.€ÏHe€recalled€that€as€he€looked€out€the€window€of€the€door,€the€victimÏpushed€the€door€open€and€began€assaulting€him€again.€€He€couldÏnot€recall€how€the€pistol€was€fired€but€testified€that€he€did€notÏintentionally€pull€the€trigger€and€shoot€the€victim.€€He€stated€that€theÏgun€fired€during€the€scuffle.€€He€testified€that€he€tried€to€performÏCPR€on€the€victim€and€finally€called€911.€€He€said€that€this€was€theÏworst€that€the€victim€had€ever€beaten€him€and€that€he€was€terrifiedÏof€the€victim.Ð Œ ù!Œ ù!
