Ðcausing€his€sister€to€come€outside.€€Defendantððs€sister€asked€him€not€to€hit€or€argue€with€the€victimÐ $X" Ðon€her€front€porch.€€The€victim€asked€Darlene€if€she€could€use€her€phone,€but€Darlene€did€notÐ ô$D # Ðrespond.€€The€victim€testified€that€Darlene€had€been€drinking.€€Ð à%0!$ ÐÓËÓÓÓÌÓÑ!ÓÓ  Óà  àThe€Defendant€lit€a€marijuana€ððjointðð€and€made€the€victim€smoke€it€about€three€times.€€TheÐ ¸'#& Ðvictim€stated€that€she€smoked€the€joint,€because€she€knew€that€if€she€refused,€the€Defendant€wouldÐ ¤(ô#' Ðstart€beating€her.€€Then,€the€Defendant€pulled€out€a€bag€of€cocaine€and€tried€to€make€the€victim€snortÐ )à$( Ðthe€cocaine,€but€the€victim€refused.€€The€Defendant€poured€cocaine€into€the€victimððs€mouth€and€madeÐ |*Ì%) Ðher€drink€beer€to€wash€the€cocaine€down.€€The€victim€testified€that€she€was€afraid€she€was€going€toÐ h+¸&* Ðdie,€because€she€did€not€know€how€much€her€beer€and€cocaine€her€body,€before€the€drugs€wouldÐ ° Ðmake€her€ill.€€The€victim€further€testified€that,€throughout€the€night,€the€Defendant€would€discuss,Ð œì Ðin€the€presence€of€his€family,€the€order€of€protection€she€had€taken€against€him.€€She€stated€that€hisÐ ˆØ Ðfamily€questioned€and€berated€her€for€getting€the€order€of€protection.Ð tÄ ÐÌà  àLater,€the€Defendant€and€the€victim€left€in€the€Defendantððs€car€and€made€several€other€stopsÐ L œ Ðbefore€the€Defendant€finally€took€the€victim€to€the€Economy€Inn.€€The€victim€testified€that€theÐ 8 ˆ ÐDefendant€gave€her€$40€to€get€a€room,€which€she€did.€€She€testified€that€she€was€afraid€to€alert€theÐ $ t Ðhotel€desk€clerk€to€her€situation,€because€she€did€not€think€he€would€help€her.€€When€they€got€to€theÐ  ` Ðroom,€the€Defendant€locked€the€door,€took€off€all€of€his€clothes€and€lay€on€the€bed€naked.€€Then,€theÐ ü L  ÐDefendant€grabbed€the€victim€by€her€hair€and€banged€her€head€against€his,€and€made€the€victim€takeÐ è 8  Ðoff€all€of€her€clothes.€€Next,€the€Defendant€slapped€the€victim€in€the€face,€grabbed€her€by€the€hair,Ð Ô$  Ðforced€her€head€between€his€legs€and€made€her€perform€fellatio€on€him.€€The€victim€stated€that€theÐ À  Ðdefendant€told€her€that€he€was€going€to€rape€her€and€have€anal€sex€with€her.€€Ð ¬ü  ÐÌà  àAfter€the€Defendant€completed€fellatio,€he€made€the€victim€lick€his€rectum.€€Then,€he€hadÐ „Ô  Ðvaginal€intercourse€with€the€victim.€€Next,€the€Defendant€turned€the€victim€over€and€had€anal€sexÐ pÀ Ðwith€her.€€The€victim€testified€that,€during€the€anal€sex,€the€Defendant€pressed€her€face€into€a€pillowÐ \¬ Ðcausing€her€to€have€difficulty€breathing.€€During€this€time,€the€Defendant€was€screaming€at€the€victimÐ H˜ Ðand€telling€her€to€shut€up€and€that€he€was€going€to€kill€her.€€Finally,€the€Defendant€allowed€the€victimÐ 4„ Ðto€go€to€the€restroom,€where€she€stayed€for€five€minutes€until€he€made€her€come€out.€€Again,€theÐ  p ÐDefendant€made€the€victim€perform€fellatio€on€him€and€have€vaginal€intercourse€with€him.€Ð  \ ÐFollowing€this€episode€of€sex,€the€victim€was€allowed€to€go€to€the€bathroom€again,€where€she€stayedÐ øH Ðfor€about€fifteen€minutes.€Ð ä4 ÐÌà  àThe€victim€told€the€jury€that,€when€she€finally€exited€the€bathroom,€the€Defendant€was€lyingÐ ¼  Ðon€the€bed€with€his€pants€on,€but€he€would€not€permit€her€to€put€her€clothes€on.€€She€testified€that€sheÐ ¨ø Ðlaid€on€the€bed€for€approximately€15€or€20€minutes,€before€the€Defendant€passed€out€and€went€toÐ ”ä Ðsleep.€€The€victim€went€to€the€bathroom,€put€on€her€clothes,€grabbed€a€cigarette€and€lighter,€and€leftÐ €Ð Ðthe€room.€€She€explained€that€she€took€the€cigarette€and€lighter,€so€that€if€the€Defendant€awakenedÐ l¼ Ðand€saw€her€leaving,€she€could€tell€him€that€she€was€going€outside€to€smoke€a€cigarette.€€The€victimÐ X ¨ Ðran€to€a€room,€which€had€its€door€open,€and€used€another€guestððs€phone€to€call€911.€€She€also€calledÐ D!” Ðher€brother€and€asked€him€to€call€the€police€and€their€parents.€€Then€she€went€to€the€motelððs€frontÐ 0"€  Ðdesk€€and€told€the€clerk€that€she€had€been€raped,€and€that€she€needed€to€use€the€phone€to€call€911.€Ð #l! ÐShe€told€the€911€operator€that€she€had€been€raped.€€She€was€taken€to€Fort€Sanders€Regional€MedicalÐ $X" ÐCenter€and€examined€by€Dr.€Douglas€Holland.€€The€victim€stated€that€she€did€not€consent€to€any€ofÐ ô$D # Ðthe€sexual€acts€that€occurred€between€her€and€the€Defendant.€€Ð à%0!$ ÐÌà  àDr.€Holland€testified€that€the€victim€was€ð ðvisibly€upset€and€cryingðð€when€he€examined€her.€Ð ¸'#& ÐHe€also€noted€a€scratch€on€the€victimððs€right€chin,€tenderness€on€the€right€side€of€her€neck,€bruisingÐ ¤(ô#' Ðon€her€right€upper€eye€lid,€breast€tenderness,€a€scratch€on€her€vulva,€and€a€large€bruise€on€the€topÐ )à$( Ðportion€of€her€rectum.€€He€stated€that€these€injuries€were€consistent€with€the€victimððs€complaints.€Ð |*Ì%) ÐHe€further€opined€that€it€was€very€unlikely€that€these€injuries€were€the€result€of€consensual€sex.€€Ð h+¸&* Їà  àThe€Defendant€testified€that€the€victim€willingly€accompanied€him€from€Senor€Frogs€and€thatÐ ° Ðshe€wanted€to€have€sex€with€him.€€He€further€testified€that€he€never€hit€or€abused€the€victim€in€anyÐ œì Ðmanner,€on€the€night€of€this€incident.€€He€admitted€that€he€had€hit€the€victim€on€prior€occasions.€€TheÐ ˆØ ÐDefendant€also€testified€that,€on€the€day€of€this€incident,€he€and€the€victim€had€been€together€fromÐ tÄ Ðabout€2:00€p.m.€until€7:30€p.m.€€The€Defendant€said€that€the€victim€was€supposed€to€call€him,€so€thatÐ `° Ðthey€could€meet€later€in€the€evening,€but€the€victim€never€called.€€Later,€he€saw€her€at€Senor€FrogsÐ L œ Ðdancing€with€another€man.€€He€testified€that,€after€the€club€closed,€the€victim€agreed€to€leave€withÐ 8 ˆ Ðhim.€The€Defendant€explained€that€the€victim€became€upset,€when€she€found€out€he€was€drivingÐ $ t Ðanother€womanððs€car.€€He€testified€that€the€victim€was€arguing€with€him€and€wanted€to€fight€withÐ  ` Ðhim.€€The€Defendant€told€the€jury€that€he€did€not€force€the€victim€to€take€the€cocaine,€but€that€sheÐ ü L  Ðwillingly€snorted€the€cocaine.€€He€stated€that€he€and€the€victim€had€previously€engaged€in€rough€sexÐ è 8  Ðand€that€the€victim€enjoyed€sex€in€this€manner.€€He€testified€that€the€victim€did€not€have€any€bruisesÐ Ô$  Ðor€scratches€on€her€the€last€time€he€saw€her.€€He€further€stated€that€the€victim€had€many€opportunitiesÐ À  Ðto€leave€him€that€night,€but€she€chose€to€stay€with€him.€€à p àÐ ¬ü  ÐÌà  àChurchill€Moore€testified€that€he€was€with€the€Defendant€at€Senor€Frogs,€on€the€morning€ofÐ „Ô  Ðthese€offenses.€€Moore€stated€that,€as€he€left€the€club,€he€saw€the€Defendant€and€the€victim€ð ðhugged„Ð pÀ Ðupðð€next€to€his€Mercedes.€€Moore€gave€the€Defendant€and€the€victim€a€ride€to€the€Old€City,€whereÐ \¬ ÐDefendant€had€parked€the€Saturn€he€was€borrowing€from€one€of€his€girlfriends.€€During€the€drive€toÐ H˜ Ðthe€Defendantððs€car,€Moore€overheard€the€Defendant€arguing€with€the€victim€and€fussing€at€her€aboutÐ 4„ Ðwhat€she€had€been€doing€at€the€club.€€At€one€point,€the€victim€asked€Moore€to€let€her€out€on€theÐ  p Ðinterstate,€but€he€refused.€€Upon€dropping€the€Defendant€and€the€victim€off,€Moore€testified€that€theÐ  \ Ðtwo€exited€out€of€his€car€on€opposite€sides€and€entered€another€car.€€Moore€stated€that€he€did€not€seeÐ øH Ðthe€Defendant€grab€or€force€the€victim€into€the€other€car.€€Ð ä4 ÐÌà  àDarlene€Holmes,€the€Defendantððs€sister,€testified€that€the€victim€came€to€her€house€almostÐ ¼  Ðeveryday€looking€for€the€Defendant.€€She€stated€that,€on€the€morning€of€this€incident,€the€victim€andÐ ¨ø Ðthe€Defendant€were€at€her€home€and€argued€on€her€front€porch.€€Holmes€testified€that€she€overheardÐ ”ä Ðthe€victim€arguing€about€the€Defendant€driving€another€womanððs€car.€€She€also€said€that€the€victimÐ €Ð Ðwillingly€smoked€marijuana€as€they€all€took€turns€smoking.€€Ð l¼ ÐÌÓò!Óòòò òÓ  ÓANALYSISó óóóÐ D!” ÐÓ/CÓÓ#ÓÌò òI.€Sufficiency€of€the€Evidenceó óÐ #l! ÐÓnCÓÌÓ  Óà  àThe€Defendant€contends€that€the€evidence€was€insufficient€for€a€reasonable€trier€of€fact€toÐ ô$D # Ðconvict€him€of€aggravated€rape€beyond€a€reasonable€doubt.€€€Specifically,€the€Defendant€argues€that,Ð à%0!$ Ðbecause€the€State€failed€to€prove€that€he€used€force€or€coercion€and€the€use€of€a€weapon,€the€evidenceÐ Ì&"% Ðis€insufficient€to€sustain€his€convictions.€òòSeeóó€Tenn.€Code€Ann.€ðð39„13„502(a)(1).€€The€State€arguesÐ ¸'#& Ðthat€it€was€not€required€to€prove€any€of€the€elements€disputed€by€the€Defendant,€because€theÐ ¤(ô#' Ðindictment€charged€the€Defendant€with€three€counts€of€aggravated€rape€as€defined€under€subsectionÐ )à$( Ð(2)€of€39„13„502.€€The€State€further€argues€that€the€evidence€was€sufficient€to€convict€the€DefendantÐ |*Ì%) Ðof€aggravated€rape€resulting€in€bodily€injury.Ð h+¸&* ЇÔ‡ XôðXXXôðÔà  àWhen€evaluating€the€sufficiency€of€the€evidence,€we€must€determine€whether€ð ðany€rationalÐ ° Ðtrier€of€fact€could€have€found€the€essential€elements€of€the€crime€beyond€a€reasonable€doubt.ðð€òòStateÐ œì Ðv.€Keoughóó,€18€S.W.3d€175,€180„81€(Tenn.€2000)€(quoting€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319,Ð ˆØ Ð99€S.€Ct.€2781,€2789,€61€L.€Ed.€2d€560€(1979)).€We€afford€the€prosecution€the€strongest€legitimateÐ tÄ Ðview€of€the€evidence€in€the€record€as€well€as€all€reasonable€and€legitimate€inferences€which€may€beÐ `° Ðdrawn€from€the€evidence.€€òòState€v.€Keoughóó,€18€S.W.3d€at€181€(citing€òòState€v.€Blandóó,€958€S.W.2dÐ L œ Ð651,€659€(Tenn.€1997)).€€Questions€regarding€the€credibility€of€the€witnesses;€the€weight€to€be€givenÐ 8 ˆ Ðthe€evidence;€and€any€factual€issues€raised€by€the€evidence€are€resolved€by€the€trier€of€fact.€€òòState€v.Ð $ t ÐBlandóó,€958€S.W.2d€651,€659€(Tenn.€1997).Ô#†XôðXX XôðkG#Ô€€On€appeal,€the€defendant€has€the€burden€of€overcomingÐ  ` Ðthe€presumption€of€guilt.€€òòState€v.€Blackóó,€815€S.W.2d€166,€175€(Tenn.€1991).Ð ü L  ÐÌà  àAggravated€rape€is€the€ð ðunlawful€sexual€penetration€of€a€victim€by€the€defendant€.€.€.€[when]Ð Ô$  Ðthe€defendant€causes€bodily€injury€to€the€victim.ðð€€òòSeeóó€Tenn.€Code€Ann.€ðð€39-13-502(a)(2).€€In€theÐ À  Ðlight€most€favorable€to€the€State,€the€evidence€was€that€the€Defendant€forced€the€victim€toÐ ¬ü  Ðaccompany€him€to€a€hotel,€where€he€abused€the€victim€and€forced€her€to€perform€fellatio€on€him.€Ð ˜è  ÐThe€Defendant€also€forced€the€victim€to€engage€in€vaginal€and€anal€sex€with€him.€Dr.€HollandÐ „Ô  Ðexamined€the€victim€and€testified€that€she€suffered€scratches,€bruises,€breast€tenderness,€and€damageÐ pÀ Ðto€her€vaginal€and€rectal€area,€which€were€consistent€with€her€complaints.€€Under€theseÐ \¬ Ðcircumstances,€we€hold€that€the€evidence€is€sufficient€to€support€the€Defendantððs€convictions€forÐ H˜ Ðaggravated€rape.Ð 4„ ÐÌòòò òII.€Rule€609ó óóóÐ  \ ÐÌà  àThe€Defendant€contends€that€the€trial€court€improperly€allowed€the€State€to€impeach€him€onÐ ä4 Ðcross-examination€by€asking€him€about€two€prior€convictions€€for€the€sale€of€cocaine.€€He€argues€thatÐ Ð  Ðthe€trial€court€failed€to€state€on€the€record€whether€the€probative€value€of€this€evidence€substantiallyÐ ¼  Ðoutweighed€any€unfair€prejudice€resulting€from€the€admission€of€this€evidence.€€The€State€respondsÐ ¨ø Ðthat€the€Defendant€has€waived€this€issue€for€failing€to€raise€the€issue€in€his€motion€for€new€trial€andÐ ”ä Ðfor€failing€to€submit€an€amended€motion€for€new€trial,€the€transcript€of€the€hearing€on€this€motionÐ €Ð Ðor€a€written€order€denying€this€motion.€€Although€the€Defendant€failed€to€raise€this€issue€in€hisÐ l¼ Ðmotion€for€a€new€trial,€we€nonetheless€find€the€appellate€record€is€sufficient€for€us€to€address€theÐ X ¨ Ðmerits€of€this€issue.€€Ð D!” ÐÌà  àPursuant€to€Rule€609,€the€credibility€of€the€accused€may€be€attacked€by€presenting€evidenceÐ #l! Ðof€prior€convictions€if€the€conditions€of€the€rule€€are€satisfied,€one€of€which€is€that€the€trial€court€mustÐ $X" Ðfind€that€the€convictionððs€probative€value€on€credibility€outweighs€its€unfair€prejudicial€effect€on€theÐ ô$D # Ðsubstantive€issues.€€Tenn.€R.€Evid.€609(a)(3).€€Here,€the€probative€value€of€the€sale€of€cocaineÐ à%0!$ Ðconvictions€on€the€issue€of€the€Defendantððs€credibility€was€overwhelming,€given€the€victimððsÐ Ì&"% Ðcontention€that€the€Defendant€poured€cocaine€down€her€mouth.€€Further,€the€conviction€€reflectedÐ ¸'#& Ðthe€Defendantððs€inability€to€abide€by€the€laws€of€this€State.€€€òòSee€generallyóó€òòState€v.€Farmeróó,€841Ð ¤(ô#' ÐS.W.2d€837,€841€(Tenn.€Crim.€App.€1992).€€Moreover,€because€the€convictions€were€for€crimesÐ )à$( Ðsubstantially€different€than€€aggravated€rape,€we€find€that€any€resulting€prejudice€was€minimal.òòóó€€òòSeeóóÐ |*Ì%) ÐòòState€v.€Mixonóó,€983€S.W.2d€661,€674€(Tenn.€1999).€€Therefore,€the€probative€value€on€credibilityÐ h+¸&* Ðoutweighed€the€unfair€prejudicial€effect€on€the€substantive€issues.€€We€conclude€that€the€trial€courtÐ ° Ðdid€not€abuse€its€discretion€in€allowing€the€State€to€impeach€based€upon€these€convictions.Ð œì Ðò òòòÌIII.€Sentencingóóó ó€Ð tÄ ÐÌà  àThe€Defendantððs€final€challenge€is€to€the€sentence€imposed€by€the€trial€court.€€The€trial€courtÐ P   Ðsentenced€the€Defendant€to€serve€twenty„two€(22)€years€for€each€aggravated€rape€conviction.€€TheÐ < Œ Ðcourt€further€ordered€that€the€sentences€be€served€consecutively€to€each€other€and€consecutive€to€aÐ ( x Ðpreviously€imposed€sentence€of€eight„years€for€the€sale€of€cocaine.€€The€Defendant€also€challengesÐ  d Ðthe€trial€courtððs€application€of€enhancement€factor€(7).€€Ð  P  ÐÌà  àWhen€a€defendant€appeals€the€manner€of€service€of€a€sentence€imposed€by€the€trial€court,€thisÐ Ø(  Ðcourt€conducts€a€de€novo€review€of€the€record€with€a€presumption€that€the€trial€courtððsÐ Ä  Ðdeterminations€are€correct.€€Tenn.€Code€Ann.€ðð€40-35-401(d).€€The€presumption€of€correctness€isÐ °  Ðð ðconditioned€upon€the€affirmative€showing€in€the€record€that€the€trial€court€considered€the€sentencingÐ œì  Ðprinciples€and€all€relevant€facts€and€circumstances.ðð€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169€(Tenn.Ð ˆØ  Ð1991).€€The€burden€of€showing€that€the€sentence€is€improper€is€upon€the€appealing€party.€€Tenn.Ð tÄ ÐCode€Ann.€ðð€40-35-401(d),€Sentencing€Commission€Comments.€€However,€if€the€record€shows€thatÐ `° Ðthe€trial€court€failed€to€consider€the€sentencing€principles€and€all€relevant€facts€and€circumstances,Ð Lœ Ðthen€review€of€the€sentence€is€purely€de€novo.€€òòAshbyóó,€823€S.W.2d€at€169.Ð 8ˆ ÐÌà  àThe€appellant€was€classified€as€a€100%€violent€offender.€€The€trial€court€found€that€Tenn.Ð ` ÐCode€Ann.€ðððð€40-35-114€(1),€(7),€(8)€and€(13)€enhancement€factors€applied€to€each€of€theÐ üL ÐDefendantððs€convictions.€€The€trial€court€also€gave€some€consideration€to€mitigating€factor€40„35„113Ð è8 Ð(13).€€The€Defendant€concedes€that€each€of€the€enhancement€factors€applied€by€the€trial€court€wereÐ Ô$ Ðapplicable€to€his€case.€€However,€he€argues€that€the€trial€court€misapplied€factor€(7),€the€offense€wasÐ À Ðcommitted€to€gratify€the€defendantððs€desire€for€pleasure€or€excitement.€€After€careful€consideration,Ð ¬ü Ðwe€find€that€the€trial€court€followed€the€principles€of€sentencing€and€properly€applied€each€factor.€Ð ˜è ÐThe€evidence€showed€that€the€Defendant€held€the€victim€for€a€long€period€of€time,€made€her€performÐ „Ô Ðfellatio€on€him,€made€her€lick€his€butt,€pinched€her€breast€and€made€her€have€anal€sex€with€him.€Ð pÀ ÐUnder€these€facts,€we€find€that€the€evidence€supports€a€finding€that€the€Defendant€raped€the€victimÐ \ ¬ Ðto€gratify€his€desire€for€pleasure€or€excitement.€€òòSee€e.g.óó,€òòState€v.€Adamsóó,€864€S.W.2d€31,€35Ð H!˜ Ð(Tenn.1993);€òòState€v.€Alvaradoóó,€961€S.W.2d€136,€152„53€(Tenn.€Crim.€App.€1993).€€Thus,€theÐ 4"„  Ðtwenty„two„year€sentences€imposed€were€proper.€€Ð  #p!
