S1OPINION #S1 # `  88  97 "S79:7Xi XS7:87@  %78 87OPINION78 8778 87(Davidson)78 8778 ` OnAugust14,1996,theAppellant,JohnnyDavidson,pleadedguiltyto  T fourcountsofsellingcocaine,onecountofsellingmarijuana,andonecountofevadingarrest.Asaresult,theAppellantreceivedaneffectivesentenceoftwelveyearsunsupervisedprobationwiththespecialconditionthattheAppellantcontactthejudgeorhisprobationofficerbeforereenteringtheStateofTennessee.OnMay9,1997,thetrialcourtrevokedhisprobation.Onappeal,theAppellantraisesthefollowingissuesforreview:>>0 ` 1)whetherthetrialcourtcorrectlyrevokedtheAppellantsprobationafterlawenforcementofficersfoundcocaineontheAppellantsperson; ` T$` T$ 0 ` 2)whethertheAppellantspresenceintheStateofTennesseeprovidedsufficientgroundsforrevocation,eventhoughthetrialcourtdidnotrelyonthisfactinrevokinghisprobation. ` T$` T$ >>Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt.@II, FACTS  &|  ` Attheprobationrevocationhearing,HowardMangrumoftheMauryCountySheriffsDepartmenttestifiedthatonMarch9,1997,hewasworkingsecurityforMauryRegionalHospitalwhentheAppellantwasbroughtinfortreatmentofagunshotwound.WhenMr.Mangrumenteredtheemergencyroom,henoticedthattheAppellantwasclutchingabaginhishand.TheAppellantwasholdingthebaginatightgrip,andMr.Mangrumwasinitiallyunabletopryhisfingersopen.Mr.Mangrumtestifiedthatatthistime,theAppellantwas justlyingtheremotionless.AfterMr.MangrumremovedthebagfromtheAppellantsgrip,he \8.0 noticedthatitappearedtocontaincrackcocaine.Thecontentsofthebagwerelateridentifiedascocainebase. ` KiannaMostella,afriendoftheAppellant,testifiedthatshewaswiththeAppellantwhenhewasshotandthatshedidnotseeanydrugsinhispossessionatthattime.Inaddition,theAppellanttestifiedthathedidnothaveanydrugsinhispossessionwhenhewasshotandthathewasunconsciousatthetimehewasbroughttothehospitalemergencyroom. ` Attherevocationhearing,theStatearguedthattheAppellantsprobationshouldberevokedbecausehehadenteredtheStateofTennesseewithoutpermissionandbecausehewasfoundwithcocaineinhispossession. In P revokingtheAppellantsprobation,thetrialcourtreliedonthefactthattheAppellanthadbeenfoundwithcocaineinhispossessionandnotonthefactthathehadbeenpresentintheStateofTennessee.Thetrialcourtstated:??0 ` Onthisprovisionaboutleavingthestate,nowthatinotherwords,Iwouldntfeelcomfortableinjustorderingsomebodytoleavethestate.Iwouldnt,underthesecircumstanceswherehesayshecametohelpouthisgrandmotherwhowassickatthetime.Iwouldntrevokehimonthat.Asfarasthecocaineinhishand,thatssufficientforme.Imsatisfiedbythepreponderanceoftheevidencethathepossessedthiscocaine,crackcocaine,andImgoingtorevokehisprobationandhissentence,twelveyearsentence,willbeserved. ` T$` T$ ??@))$ POSSESSIONOFCOCAINE   2(*  ` TheAppellantcontendsthatthetrialcourterredinrevokinghisprobationbecausehewasunconsciousatthetimehewasfoundinpossessionofthecocaineandbecausethereisnoproofthatheknowinglyorintentionally 902 possessedcocaine.Specifically,theAppellantcontendsthatabsentproofofaculpablementalstate,thereisnoevidencethathisconductwascriminalandthus,nobasisforrevokinghisprobation.ThecircumstancesuponwhichprobationcanberevokedarespecifiedinTennesseeCodeAnnotated4035311(d):@@0 ` IfthetrialjudgeshouldfindthattheAppellanthasviolatedtheconditionsofprobationandsuspensionbyapreponderanceoftheevidence,thetrialjudgeshallhavetherightbyorderdulyenteredupontheminutesofthecourt,torevoketheprobationandsuspensionofsentenceandcausetheAppellanttocommencetheexecutionofthejudgmentasoriginallyentered,orotherwiseinaccordancewith40-35-310;provided,thatincaseofsuchrevocationofprobationandsuspension,theAppellanthastherighttoappeal. ` T$` T$ @@Tenn.CodeAnn.4035311(d)(1997).TheTennesseeSupremeCourthasstatedthatunderthissection:AA0 ` Thejudgmentofthetrialcourtinthisregardwillnotbedisturbedonappealunlessitappearsthattherehasbeenanabuseofdiscretion.Inorderforareviewingcourttobewarrantedinfindinganabuseofdiscretioninaprobationrevocationcase,itmustbeestablishedthattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudgethataviolationoftheconditionsofprobationhasoccurred.Theproofofaprobationviolationneednotbeestablishedbeyondareasonabledoubt,butitissufficientifitallowsthetrialjudgetomakeaconscientiousandintelligentjudgment. ` T$` T$ A AStatev.Harkins,811S.W.2d79,82(Tenn.1991).Thus, [t]herevocationofa (/%' suspendedsentenceiscommittedtothesoundjudicialdiscretionofthetrialjudge,andhisdecisiononthematterwillnotbereversedonappealunlessitappearsthatthetrialjudgehasactedarbitrarilyinthematter.Statev. 4+- Williamson,619S.W.2d145,146(Tenn.Crim.App.1981)(citingFinleyv.State, 6-/ 214Tenn.149,378S.W.2d169(1964)). 8x/1 Ї ` Inthiscase,therewassufficientevidenceforthetrialcourttorevoketheAppellantsprobationunderTennesseeCodeAnnotated4035311forviolatingtheconditionsofprobation.Indeed, [u]nderthissection,compliancewithourstatelawsisanautomaticcondition....Statev.Stubblefield,953S.W.2d223, 0 225(Tenn.Crim.App.1997).TherewassufficientevidenceforthetrialcourttofindthattheAppellanthadviolatedtheconditionsofhisprobationbypossessingcocaine.C CCC  #  1      ׀Mr.MangrumtestifiedthattheAppellanthadabagofcocaineinhis   handandthathewouldnotletgoofthebag.Infact,Mr.MangrumtestifiedthattheAppellantinitiallyhadsuchatightgriponthebagthathewasunabletoprytheAppellantsfingersopen.Further,Mr.MangrumnevertestifiedthattheAppellantwasunconsciousatthetimehewasholdingthebag,onlythattheAppellantwas justlyingtheremotionless.ItisareasonableinterpretationofthisevidencethattheAppellantcouldnothavebeengrippingthebagofcocainesotightlywithoutintentionallyholdingthebagatsomepoint.WhilethisevidencemayormaynothavebeenstrongenoughtoconvicttheAppellantofacriminaloffenseisnotthetest. Theevidencenecessarytoorderarevocationofasuspendedsentencedoesnotrequirethequantumofproofnecessarytoconvictoneofacrimeinthefirstinstance.Bledsoev.State,215Tenn.553,560,387 P* " S.W.2d811,814(1965);Stampsv.State,614S.W.2d71,73(Tenn.Crim.App. @,"$ 1980). ` ItistruethatboththeAppellantandhisfriend,Ms.Mostella,testifiedthattheAppellantdidnothaveanydrugsinhispossessionatthetimehewasshotandthattheAppellanttestifiedthathewasunconsciouswhenhewasholdingthe 5,. bagofcocaine.However,thetrialcourtwasfreetodecidehowmuchweighttogivethistestimony.Indeed, [i]nprobationrevocationhearings,thecredibilityofthewitnessesisforthedeterminationofthetrialjudge.Statev.Wall,909 @  S.W.2d8,10(Tenn.Crim.App.1994)(citingBledsoev.State,387S.W.2d811, 0 814(Tenn.1965);Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980)).
