PursuanttoT.C.A.4030202(a),apetitionermustpetitionforpostconvictionreliefwithinoneyearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenor,ifnoappealistaken,withinoneyearofthedateonwhichthejudgmentbecamefinal.TheCompilersNotestoT.C.A.4030201statethatthe1995PostConvictionActgovernsallpetitionsforpostconvictionrelieffiledafterMay10,1995.Moreover,theCompilersNotesindicatethatanypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastoneyearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart.  UnderT.C.A.4030202(b),acourtdoesnothavejurisdictiontoconsiderapetitionforpostconvictionreliefifitwasfiledoutsidetheoneyearstatuteoflimitationunless(1)theclaiminthepetitionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequired,(2)theclaiminthepetitionisbaseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted,or(3)theclaiminthepetitionseeksrelieffromasentencethatwasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentence,andthepreviousconvictionhassubsequentlybeenheldtobeinvalid.  Inthepresentcase,thepetitionerfiledhispetitionforpostconvictionreliefonJanuary27,1997.Accordingly,thepetitionisgovernedbythe1995PostConvictionAct,andthepetitionwasfiledoutsidethestatuteoflimitationsetforthinT.C.A.4030202(a).Moreover,thepetitionerhasfailedtoshowthatanyofhisclaimsfallwithinoneoftheexceptionssetforthinT.C.A.4030202(b).  Itis,therefore,ORDEREDthatthestatesmotiontoaffirmthejudgmentofthetrialcourtunderRule20,RulesoftheCourtofCriminalAppeals,isgranted,andthejudgmentofthetrialcourtisaffirmed.
