 `  `     h      `     h     WilliamPaulPhillips  @$8   `     h     DistrictAttorneyGeneral `     h     P.O.Box323 `     h     Jacksboro,TN37757 `     h     OPINIONFILED:򀀀 \,T%) AFFIRMEDPURSUANTTORULE20 DavidG.Hayes  1*/ Judge  2+0 @+ OPINION    ` Theappellant,JohnnyLeeDavis,5::::55 5  #  1      ׀appealsthesentencingdecisionofthe   CampbellCountyCriminalCourtfollowinghisguiltypleastotwocountsofsexualbattery,onecountofarson,andonecountoftheftofpropertyoveronethousanddollars.Underthetermsofthepleaagreement,theappellantagreedtoaneffectivefifteenyearsentence,however,heremainedeligibleforalternativesentencingasnosingleconvictionwasinexcessofeightyears.Thepleaagreementfurtherprovidedthatthemannerofserviceofthesentenceswastobesubmittedtothetrialcourtfordetermination.Thetrialcourtorderedtotalconfinement.Theappellantappealscontendingthatthetrialcourterredinfailingtograntalternativesentences. ` Afterreviewoftherecord,weaffirmthejudgmentofthetrialcourtpursuanttoRule20,Tenn.Ct.Crim.App.R. ` Thisappealoriginatesfromcases,C8805andC9105,whichwereconsolidatedforsentencingpurposes.InOctoberof1995,theappellantwascharged,byindictment,incaseC8805,withonecountofrapeofachild,aclassAfelony,andonecountofaggravatedsexualbattery,aclassBfelony.TheincidentleadingtothesechargesoccurredbetweenJanuaryandNovember21,1993,andinvolvedtheappellantsstepdaughter.Theappellantagreedtopleadguiltytotwocountsofthelesseroffenseofsexualbattery,aclassEfelony.Theagreementprovidedthattheappellantwouldbesentenced,asarangeIIIpersistentoffender,tofiveyearsononecountand,asarangeIImultipleoffender,tofouryearsontheremainingcount.Itwasfurtheragreedthatcountsoneandtwowouldrunconsecutivetoeachotherforaneffectivesentenceofnineyears,withthemannerofservicetobesubmittedtothetrialcourtfordetermination. 706 Ї ` AfterthechargesincaseC8805werependingagainsttheappellant,aCampbellCountyGrandJury,inOctoberof1996,returnedasecondindictment,caseC9105,againsttheappellant,charginghimwithonecountofarson,aclassCfelony,andonecountoftheftofpropertyoveronethousanddollars,aclassDfelony.TheseoffensesresultedfromtheappellantsemploymentatDiscountPagersinLaFollette,Tennessee.WhileemployedasthemanagerofDiscountPagers,theappellanthadstolenmerchandisefromhisemployer.Inanattempttoavoidprosecution,theappellantsetfiretothebusiness,resultinginthedestructionofthepremisesandnumeroussurroundingbusinesses/establishments.Indeed,afairestimateofthedamagescausedbythearsontotalsapproximately$637,398.33.AsincaseC8805,theappellantagreedtopleadguiltytothesecharges.ThepleaagreementprovidedthattheappellantwouldbesentencedasarangeIImultipleoffendertosixyearsoneachcount,tobeservedconcurrentwitheachotherbutconsecutivetothosesentencesimposedincaseC8805.Again,themannerofservicewasreservedforthedeterminationofthetrialcourt. ` AsentencinghearingwasheldonSeptember2,1997.Neitherpartypresentedanywitnesses,relyingsolelyonthepresentencereportandargumentofcounsel.Afterconsideringtheevidence,thetrialcourtimposedasentenceoftotalincarceration.Specifically,thetrialcourtfound:8 ` Inthisparticularcase,theCourtiscompelledtofindthat[analternativesentence]wouldbeinappropriate.Thisdefendanthasalongcriminalrecord.[5: :::555  #  2      ]Theseareveryseriousmattersthathehas ,%* beenconvictedof.Hehasbeenonprobationbefore...whichdidnotseemtodeterhimincommittingothercrimes.Consideringthetotalityofthecircumstances,itistheopinionoftheCourtthatsplitconfinement,communitycorrectionsand/orprobationareinappropriateandwillnotbeappliedinthesentencesheretoforeimposedandthesesentencesaretobecarriedout. ` !` !
