Knoxville,TN37902OPINIONFILED:___________________ AFFIRMED PAULG.SUMMERS, Judge      ` p    7sXXdXXd7 OPINION    `  p Theappellant,MichaelB.Davis,appealsthedenialofhispetitionforpostconvictionrelief,arguingthathisguiltypleawasnotenteredknowinglyandvoluntarilybecausehereceivedineffectiveassistancefromhisattorneyandbecausehewascoercedintopleadingguiltyduetothepossibilityoffederalguncharges.Theappellantpledguiltytoseconddegreemurder,possessionofcocaineforresale,andpossessionofaweaponinthecommissionofafelony.HewassentencedasaRangeI,standardoffendertotheminimumsentenceoffifteenyearsonthemurdercharge,sixyearsonthedrugcharge,andoneyearontheweaponscharge.Thesixyearsentenceandtheoneyearsentenceweretobeservedconcurrentlytoeachother,butconsecutivelytothemurdercharge.Thus,theappellantreceivedatotalsentenceoftwentyoneyearstobeservedintheDepartmentofCorrection.Weaffirm. Theappellantpresentsforourreviewoneissue:whetherhisguiltypleawasvoluntarilyentereddespitehisattorneysrepresentationsregardinghispossiblereleaseeligibilitydateanddespitethethreatofprosecutiononfederalguncharges. Theappellantkilledamanafterafightandwassubsequentlychargedwithfirstdegreemurder.Afterhewaschargedwiththiscrime,theappellantbecameinvolvedinanaltercationwithamanonCumberlandAvenueinKnoxville,butapoliceofficerintervenedandstoppedthealtercation.Thepoliceofficernoticedthebuttofagunexposedfromundertheappellantscarseat.Thecarwassearched,andthesearchproducedseveralgramsofcocaine.Thisincidentoccurredduring OperationTriggerLock,afederalprojectinvolvingtheprosecutionofdrugandgunviolations. Althoughtheappellantpledguiltyinstatecourt,heassertedinhispetitionforpostconvictionreliefthathispleawasnotvoluntarilyenteredbecauseofineffectiverepresentationbyhisattorney.DonaldBosch,aprivateattorney,representedtheappellantattheplea.Accordingtotheappellant,Mr.Boschinformedhimthathecouldbereleasedinaslittleasthreeorfouryearsundertheproposedpleaagreement.Furthermore,theappellantassertsthatMr.Boschinformedhimthathewouldbeprosecutedonfederalgunchargesifhedidnotacceptthepleaagreement.Accordingtotheappellant,Mr.Boschdidnotinformthetrialcourtofthepossibilityoffederalguncharges. Thestate,however,arguesthatthepostconvictioncourtproperlydismissedtheappellantspetitionforpostconvictionrelief.Thestatecontendsthattheappellantwasnot inducedtopleadguiltybyhisattorneysmisrepresentationastothereleaseeligibilitydatesandthefederalgovernmentsthreatofprosecution.Thestatemaintainsthattheappellanthasfailedtoshow thathisattorneysineffectivenessprejudicedhimbyforcinghimtoaccepttheguiltyplea.Furthermore,thestatearguesthattherecordfromtheappellantsguiltypleahearingindicatesthattheappellanthadnotbeenpressuredtopleadguilty. Tobegrantedreliefonthegroundofineffectiveassistanceofcounsel,anappellantmustestablishthattheadvicegivenortheservicesrenderedwerenotwithinthecompetencedemandedofattorneysincriminalcasesandthat,butforcounselsdeficientperformance,theresultofhisorhertrialwouldhavebeendifferent.Stricklandv.Washington,466U.S.668(1984).Thistwopartstandard,asitappliestoguiltypleas,ismetwhentheappellantestablishesthat, H butforcounselserror,heorshewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.Hillv.Lockhart,474U.S.52,59(1985).InTennessee,theappropriatetestiswhethercounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975). ` pB'`  pB' Inpostconvictionproceedings,petitionersbeartheburdenofprovingtheirallegationsbyapreponderanceoftheevidence.Blackv.State,794S.W.2d752,755(Tenn.Crim.App.1990);McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Furthermore,thetrialcourtsfindingsoffactinpostconvictionhearingsareconclusiveonappealunlesstheevidencepreponderatesagainstthosefindings.Butlerv.State,789S.W.2d898,899(Tenn.1990);Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983);Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978). Becauseaguiltypleainvolvesthewaiverofseveralofthedefendantsconstitutionalrights,thetrialcourtmaynotacceptaguiltypleawithoutanaffirmativeshowingthatthedefendantspleadecisionwasknowingandvoluntary.Boykinv.Alabama,395U.S.238(1969);Statev.Mackey,553S.W.2d337(Tenn.1977).Ifapleaofguiltyisinducedbycoercion,fraud,duress,ormistake,thenreliefmaybegranted.CapriAdultCinemav.State,537S.W.2d896,898(Tenn.1976). Theappellantarguesthathisguiltypleawasnotvoluntarilymadebecausehisattorneywasineffectivebymisrepresentingtotheappellanthispossiblereleaseeligibilitydate.However,theappellantadmittedthathisattorneytoldhimthathecouldservethreeorfouryearsorhecouldservetheentiretwentyoneyearsentence.Furthermore,thetranscriptofthepleahearingclearlyindicatesthattheappellantunderstoodhisrights,andheindicatedatthattimethathehadnotbeenpressuredorcoercedintopleadingguilty.
