àò òòòFACTUAL€BACKGROUNDó óóóÌÌà àDefendantððs€guilty€pleas€arose€from€the€burglary€of€the€residence€of€Mr.Ïand€Mrs.€Robert€Buckner.€€The€Buckners€were€an€elderly€couple€and€wereÏattending€church€at€the€time€their€home€was€burglarized.€€The€victims€had€anÏextensive€silver€coin€collection,€which€was€completely€destroyed.€€Mint€coinÏsets,€silver€certificates,€paper€money,€jewelry€and€other€items€were€taken€in€theÏburglary.Ìà àPrior€to€sentencing,€the€victims€submitted€impact€statements.€€As€a€resultÏof€the€burglary,€they€became€afraid€to€leave€their€home.€€Both€victims€wereÍunable€to€sleep,€and€their€physical€and€mental€health€deteriorated€after€theÏincident.€€Much€of€what€was€taken€in€the€burglary€was€irreplaceable.Ìà àDefendant€was€eighteen€(18)€at€the€time€the€burglary€occurred.€€He€hadÏno€prior€criminal€record€and€was€attending€high€school€at€the€time.€€However,Ïthe€pre„sentence€report€indicated€that€defendant€had€disciplinary€problemsÏwhile€attending€school.€€Defendant€reported€ð ðoccasionalðð€alcohol€use€andÏadmitted€experimenting€with€marijuana€two€(2)€months€prior€to€the€preparationÏof€the€pre„sentence€report.Ìà àIn€determining€defendantððs€sentence,€the€trial€court€considered€theÏdefendantððs€age€to€be€a€mitigating€factor.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„113(6).€ÏThe€trial€court€also€found€that€the€victimsðð€ages€were€enhancement€factors.€€òòSeeóóÏTenn.€Code€Ann.€ðð€40„35„114(4).€€The€trial€court€also€noted€that€the€victimsÏsuffered€psychological€damage€as€a€result€of€defendantððs€actions.€€The€trialÏcourt€sentenced€defendant€to€concurrent€sentences€of€four€(4)€years€forÏaggravated€burglary€and€two€(2)€years€for€theft€over€$1,000.€€Upon€the€service€ofÏone€(1)€year€in€the€Gibson€County€jail,€the€trial€court€ordered€that€defendantÏserve€the€remainder€of€his€sentence€in€an€alternative€sentencing€program€underÏthe€supervision€of€Corrections€Management.ÌÌà@ àIf€no€mitigating€or€enhancement€factors€for€sentencing€are€present,€Tenn.ÍCode€Ann.€ðð€40„35„210(c)€provides€that€the€presumptive€sentence€shall€be€theÏminimum€sentence€within€the€applicable€range.€€òòSeeóó€òòState€v.€Fletcheróó,€805ÏS.W.2d€785,€788€(Tenn.€Crim.€App.€1991).€€However,€if€such€factors€do€exist,€aÏtrial€court€should€start€at€the€minimum€sentence,€enhance€the€minimumÏsentence€within€the€range€for€enhancement€factors€and€then€reduce€theÏsentence€within€the€range€for€the€mitigating€factors.€€Tenn.€Code€Ann.€ðð€40„35„210(e).€€No€particular€weight€for€each€factor€is€prescribed€by€the€statute,€as€theÏweight€given€to€each€factor€is€left€to€the€discretion€of€the€trial€court€as€long€as€theÏtrial€court€complies€with€the€purposes€and€principles€of€the€sentencing€act€andÏits€findings€are€supported€by€the€record.€€òòState€v.€Mossóó,€727€S.W.2d€229,€238Ï(Tenn.€1986);€òòState€v.€Leggsóó,€955€S.W.2d€845,€848€(Tenn.€Crim.€App.€1997);ÏòòState€v.€Santiagoóó,€914€S.W.2d€116,€125€(Tenn.€Crim.€App.€1995);€òòseeóó€Tenn.ÏCode€Ann.€ðð€40„35„210€Sentencing€Commission€Comments.Ìà àAlthough€defendant€does€not€specifically€contest€the€propriety€of€the€trialÏcourtððs€enhancement€factors,€we€will€address€each€of€them.€€Firstly,€the€trialÏcourt€found€that€the€ages€of€the€victims€were€enhancement€factors.€€The€victimsÏwere€elderly.€€A€defendantððs€sentence€may€be€enhanced€if€the€victim€of€theÏoffense€was€ð ðparticularly€vulnerable€because€of€age€or€physical€or€mentalÏdisability.ðð€€Tenn.€Code€Ann.€ðð€40„35„114(4).€€However,€this€factor€œmay›€not€beÏestablished€by€the€showing€of€age€alone.€€òòState€v.€Waltonóó,€958€S.W.2d€724,€729Ï(Tenn.€1997);€òòState€v.€Pooleóó,€945€S.W.2d€93,€96€(Tenn.€1997);€òòState€v.€Adamsóó,Ï864€S.W.2d€31,€35€(Tenn.€1993).€€There€must€be€an€independent€showing€thatÏthe€victim€was€particularly€vulnerable€due€to€age€or€mental€condition.€€òòState€v.ÍWaltonóó,€958€S.W.2d€at€729;€òòState€v.€Adamsóó,€864€S.W.2d€at€35.€€In€the€presentÏcase,€although€the€victims€were€an€elderly€couple,€there€is€no€evidence€toÏestablish€that€they€were€especially€vulnerable€to€burglary€and€theft€because€ofÏtheir€advanced€years.€€Therefore,€the€trial€court€improperly€considered€theÏvictimsðð€age€as€an€enhancement€factor.Ìà àThe€trial€court€also€found€that€the€psychological€harm€to€the€victimsÏshould€be€considered€as€an€enhancement€factor.€€Under€Tenn.€Code€Ann.€ðð€40„35„114(6),€a€defendantððs€sentence€may€be€enhanced€if€the€personal€injuries€toÏthe€victim€were€ð ðparticularly€great.ðð€€Psychological€or€emotional€harm€can€beÏconsidered€as€ð ðpersonal€injuryðð€under€Tenn.€Code€Ann.€ðð€40„35„114(6).€€òòStateÏv.€Smithóó,€891€S.W.2d€922,€930€(Tenn.€Crim.€App.€1994).€€However,€this€factorÏmay€be€applied€only€when€the€state€establishes€that€ð ðthe€emotional€injuries€andÏpsychological€scarring€are€ððparticularly€great.ðððð€òòState€v.€Hoytóó,€928€S.W.2d€935,Ï948€(Tenn.€Crim.€App.€1995)€(citations€omitted).Ìà àThe€psychological€trauma€to€the€elderly€victims€was€indeed€particularlyÏgreat.€€Both€victims€are€afraid€of€leaving€their€home,€and€when€they€do€leave,Ïthey€are€afraid€of€returning.€€They€lock€the€doors€to€their€home€even€if€they€areÏmerely€going€outside€into€their€own€yard.€€They€installed€new€locks€on€the€doorsÏand€placed€bars€on€the€windows.€€Both€victims€are€afraid€to€sleep,€and€theirÏphysical€health€has€worsened€as€well.€€We€find€that€the€emotional€damageÏsuffered€by€these€victims€is€ð ðparticularly€greatðð€in€comparison€to€theÏpsychological€damage€experienced€by€other€burglary€victims.€€Therefore,€weÏfind€that€the€trial€court€properly€considered€the€victimsðð€emotional€damage€as€anÍenhancement€factor.Ìà àUnder€our€power€of€òòde€novoóó€review,€we€also€find€that€defendant€has€aÏprevious€history€of€criminal€behavior.€€Tenn.€Code€Ann.€ðð€40„35„114(1).€ÏAlthough€defendant€was€eighteen€(18)€at€the€time€of€the€offense,€he€reportedÏð ðoccasionalðð€alcohol€use.€€Therefore,€he€admitted€to€the€illegal€act€of€underageÏdrinking.€€Defendant€also€admitted€that€he€had€used€marijuana€prior€to€hisÏsentencing€hearing.€€This€Court€has€previously€held€that€this€factor€appliesÏwhen€the€ð ðcriminal€behaviorðð€occurs€after€the€convicted€offense€but€prior€toÏsentencing.€€òòSeeóó€òòState€v.€Robert€Arthur€Whiteóó,€C.C.A.€No.€02C01„9601„CC„00009,€Lake€County€(Tenn.€Crim.€App.€filed€February€27,€1997,€at€Jackson).€ÏEven€though€this€factor€may€be€entitled€to€little€weight,€it€is,€nonetheless,€aÏrelevant€consideration€in€determining€defendantððs€sentence.Ìà àAlthough€the€trial€court€improperly€considered€the€victimsðð€ages€asÏenhancement€factors,€we€find€that€two€(2)€enhancement€factors€apply€in€thisÏcase.€€Under€our€òòde€novoóó€review,€we€find€that€the€four€(4)€year€sentenceÏimposed€by€the€trial€court€for€aggravated€burglary€is€appropriate.Ìà àThis€issue€is€without€merit.ÌÌà@ àò òòòPROBATIONó óóóÌÌà àDefendant€also€claims€that€the€trial€court€erred€in€denying€full€probation.€ÏHe€contends€that€he€is€a€favorable€candidate€for€alternative€sentencing€and€isÏnot€a€defendant€for€which€incarceration€is€a€priority.€€He€argues€that€it€is€in€theÍbest€interest€of€the€public€and€himself€to€be€granted€probation.Ìà@ àò òA.ó óÌà àAn€especially€mitigated€or€standard€offender€convicted€of€a€Class€C,€D€orÏE€felony€is€presumed€to€be€a€favorable€candidate€for€alternative€sentencing€inÏthe€absence€of€evidence€to€the€contrary.€€Tenn.€Code€Ann.€ðð€40„35„102(6).€€AÏtrial€court€must€presume€that€a€defendant€sentenced€to€eight€years€or€less€andÏwho€is€not€an€offender€for€whom€incarceration€is€a€priority€is€subject€toÏalternative€sentencing.€€òòState€v.€Byrdóó,€861€S.W.2d€377,€379„80€(Tenn.€Crim.ÏApp.€1993).€€It€is€further€presumed€that€€a€sentence€other€than€incarcerationÏwould€result€in€successful€rehabilitation€unless€rebutted€by€sufficient€evidenceÏin€the€record.€€òòId.óó€at€380.€€However,€although€a€defendant€may€be€presumed€toÏbe€a€favorable€candidate€for€alternative€sentencing,€the€defendant€has€theÏburden€of€establishing€suitability€for€total€probation.€€òòState€v.€Boggsóó,€932€S.W.2dÏ467,€477€(Tenn.€Crim.€App.€1996);€òòseeóó€Tenn.€Code€Ann.€ðð€40„35„303(b).€€EvenÏthough€probation€must€be€automatically€considered,€ð ðthe€defendant€is€notÏautomatically€entitled€to€probation€as€a€matter€of€law.ðð€€Tenn.€Code€Ann.€ðð€40„35„303(b)€Sentencing€Commission€Comments;€òòState€v.€Hartleyóó,€818€S.W.2dÏ370,€373€(Tenn.€Crim.€App.€1991).Ìà àIn€determining€whether€to€grant€or€deny€probation,€a€trial€court€shouldÏconsider€the€circumstances€of€the€offense,€the€defendantððs€criminal€record,€theÏdefendantððs€social€history€and€present€condition,€the€need€for€deterrence,€andÏthe€best€interest€of€the€defendant€and€€the€public.€€òòState€v.€Grearóó,€568€S.W.2dÏ285,€286€(Tenn.€1978);€òòState€v.€Boydóó,€925€S.W.2d€237,€244€(Tenn.€Crim.€App.Í1995);€òòState€v.€Blackóó,€924€S.W.2d€912,€917€(Tenn.€Crim.€App.€1995).€€TheÏdefendant's€lack€of€credibility€is€also€an€appropriate€consideration€and€reflectsÏon€a€defendantððs€potential€for€rehabilitation.€€òòState€v.€Dowdyóó,€894€S.W.2d€301,Ï306€(Tenn.€Crim.€App.€1994).Ìà àIn€determining€if€incarceration€is€appropriate,€a€trial€court€may€considerÏthe€need€to€protect€society€by€restraining€a€defendant€having€a€long€history€ofÏcriminal€conduct,€the€need€to€avoid€depreciating€the€seriousness€of€the€offense,Ïwhether€confinement€is€particularly€appropriate€to€effectively€deter€others€likelyÏto€commit€similar€offenses,€and€whether€less€restrictive€measures€have€often€orÏrecently€been€unsuccessfully€applied€to€the€defendant.€€Tenn.€Code€Ann.€ðð€40„35„103(1);€òòsee€alsoóó€òòState€v.€Ashbyóó,€823€S.W.2d€at€169;€òòState€v.€Grigsbyóó,€957ÏS.W.2d€541,€545€(Tenn.€Crim.€App.€1997).Ìà@ àò òB.ó óÌà àThe€trial€court€did€not€make€any€specific€findings€regarding€alternativeÏsentencing,€nor€did€the€trial€court€discuss€the€principles€to€be€considered€inÏalternative€sentencing.€€Therefore,€we€must€review€this€issue€òòde€novoóó€without€aÏpresumption€of€correctness.€€òòState€v.€Pooleóó,€945€S.W.2d€at€96.Ìà àWe€agree€with€the€trial€court€that€total€probation€is€not€appropriate€in€thisÏcase.€€However,€the€remaining€issue€before€this€Court€is€the€length€ofÏincarceration€defendant€must€serve€prior€to€being€placed€on€communityÏcorrections.€€Considering€the€circumstances€of€the€offense€and€theÏpsychological€impact€on€the€victims,€a€period€of€incarceration€is€necessary€toÏavoid€depreciating€the€seriousness€of€the€offense.€€There€is€evidence€in€theÍrecord€that€defendant€had€disciplinary€problems€while€attending€high€school.€ÏDefendant€has€admitted€that€he€occasionally€uses€alcohol,€although€it€is€illegalÏfor€him€to€do€so.€€Moreover,€defendant€reported€using€marijuana€several€monthsÏafter€defendant€was€arrested€on€the€present€offense.€€We€find€that€these€factsÏreflect€negatively€on€defendantððs€rehabilitation€potential.Ìà àHowever,€we€also€note€the€youth€of€the€defendant€and€that€he€had€noÏprior€criminal€record.€€These€factors€are€entitled€to€great€weight.€€Pursuant€to€theÏprinciples€of€the€1989€Sentencing€Act,€this€Court€is€required,€upon€our€òòde€novoóóÏreview,€to€impose€ð ðthe€least€severe€measure€necessary€to€achieve€the€purposesÏfor€which€the€sentence€is€imposed.ðð€€Tenn.€Code€Ann.€ðð€40„35„103(4).€ÏAccordingly,€defendantððs€sentence€is€modified€to€reflect€a€confinement€period€ofÏsix€(6)€months.Ìò
