Inthisappealofright,thedefendantclaimsthatthetrialcourterredbysentencingthedefendanttoserveaneffectivetermof"overeightmonths."Wefindnoerrorandaffirmthejudgmentofthetrialcourt.  Theunderlyingfactswerestipulated:8 8 Thearrestingofficerobservedthedefendant'svehicletravelingveryslowlyandalmoststrikingacurbonFoothillsMallDrive.Atrafficstopwasmadeandtheofficernoticedthatthedefendantwasunsteadyonhisfeet,hadbloodshoteyes,andastrongodorofalcohol.Thedefendantcouldnotperformsimplefieldsobrietytests.Atthetime,thedefendant'slicensewasinarevokedstatus.Abreathalyzerexaminationindicatedthatthedefendanthadabloodalcohollevelof.12.  Thedefendantarguesthathiscrimesarenotsosevereinnaturethattheyrequireincarcerationofapproximatelytwohundredfiftyfourdays.Hecontendsthatthetrialcourtgavenoreasonsforincreasingthesentenceabovetheminimum.  Whenachallengeismadetothelength,range,ormannerofserviceofasentence,itisthedutyofthiscourttoconducta"denovoreview...withapresumptionthatthedeterminationsmadebythecourtfromwhichtheappealistakenarecorrect."Tenn.CodeAnn.4035401(d).  Ourreviewrequiresananalysisof(1)theevidence,ifany,receivedatthetrialandsentencinghearing;(2)thepresentencereport;(3)theprinciplesofsentencingandtheargumentsofcounselrelativetosentencingalternatives;(4)thenatureandcharacteristicsoftheoffense;(5)anymitigatingorenhancingfactors;(6)anystatementsmadebythedefendantinhisownbehalf;and(7)thedefendant'spotentialforrehabilitationortreatment.Tenn.CodeAnn.4035102,103,and̄210.Statev.Smith,735S.W.2d859,863(Tenn.Crim.App.1987).   Inmisdemeanorsentencing,aseparatesentencinghearingisnotmandatorybutthecourtisrequiredtoprovidethedefendantwithareasonableopportunitytobeheardastothelengthandmannerofthesentence.Tenn.CodeAnn.4035302(a).Misdemeanorsentencesmustbespecificandinaccordancewiththeprinciples,purposes,andgoalsoftheCriminalSentencingReformActof1989.Tenn.CodeAnn.4035104,117,and302;Statev.Palmer,902S.W.2d391,393(Tenn.1995).Themisdemeanoroffendermustbesentencedtoanauthorizeddeterminantsentencewithapercentageofthatsentencedesignatedforeligibilityforrehabilitativeprograms.Generally,apercentageofnotgreaterthan75%ofthesentenceshouldbefixedforamisdemeanoroffender;however,aDUIoffendermayberequiredtoservethefull100%ofhissentence.Palmer,902S.W.2dat39394.Indeterminingthepercentageofthesentence,thecourtmustconsiderenhancementandmitigatingfactorsaswellasthelegislativepurposesandprinciplesrelatedtosentencing.Id.  Uponserviceofthatpercentage,theadministrativeagencygoverningtherehabilitativeprogramsdetermineswhichamongthelawfulprogramsavailableisappropriate.Thetrialcourtretainstheauthoritytoplacethedefendantonprobationeitherimmediatelyorafteratermofperiodicorcontinuousconfinement.Tenn.CodeAnn.4035302(e).ThelegislaturehasencouragedcourtstoconsiderpublicorprivateagenciesforprobationsupervisionpriortodirectingsupervisionbytheDepartmentofCorrection.Tenn.CodeAnn.4035302(f).Thegoverningstatuteisdesignedtoprovidethetrialcourtwithcontinuingjurisdictioninmisdemeanorcasesandawidelatitudeofflexibility.Themisdemeanant,unlikethefelon,isnotentitledtothepresumptionofaminimumsentence.Statev.Creasy,885S.W.2d829,832(Tenn.Crim.App.1994).  Thedefendant,fortysixyearsofage,hasthreepriorconvictionsfordrivingundertheinfluenceandfourpriorconvictionsfordrivingonarevokedlicense.Hehasotherconvictionsaswell;atleasttwoarefelonies.Priorattemptsatalcoholabusetreatmenthavebeenunsuccessful.Thetrialcourtindicatedsomeleniencybysuggestingthatthedefendantwouldserve"theminimummandatoryonehundredtwentydaysbeforehe'seligibleforanykindofreleaseorworkϜprograms."Underallofthecircumstances,thesentencesimposedarefullyϜwarranted.
