XD2 XHowever,thecontradictionariseswhenonecontinuestoreadsubsections(a)and(b) ^  whichmentionsboth pretrialandjudicialdiversionthreeseparatetimes.Thisisconfusing D  becausethosedefendantswhosecasesaredisposedofthroughjudicialdiversionarenot *z  convicted.Rather,proceedingsagainstaqualifieddefendantaredeferredandnojudgmentof ` guiltisentered.SeegenerallyTenn.CodeAnn.4035313.Therefore,underthefirstand F dominantparagraphofthestatute,theyarenot sexualoffenders.Yet,subsections(a)and(b) , seemtocontemplatetheirinclusion.Thisisconfusing,vague,andambiguous.    Inthefaceofthisconfusion,weareinstructedbyseveralprinciplesimportanttothe  constitutionallawincludinglegality,notice,fairness,anddueprocess.Generally,thelanguage t ofapenalstatutemustbeclearandconcisetogiveadequatewarningsothatindividualsmight Z avoidtheforbiddenconduct.SeeStatev.Boyd,925S.W.2d237,24243(Tenn.Crim.App. @ 1995).Abasicprincipleofdueprocessisthatanenactmentwhoseprohibitionsarenot &v sufficientlydefinedisvoidforvagueness.SeeStatev.Lakatos,900S.W.2d699,701(Tenn.  \ Crim.App.1994).Inthiscase,thesevaluesandprotectionsmustapply,andweareboundto B concludethatthisdefendantsviolationoftheSexOffenderMonitoringActshouldbereversed ( anddismissed.% X(#,.%Simplyput,hehasnotbeen convictedofasexoffense,andwecannot  concludethatthestatuteslanguageputshimonfairnotice.
