Abriefproceduralhistoryisnecessary.TheappellantpledguiltytoseconddegreemurderonMarch27,1995.Atthetime,thePostConvictionProcedureActprovidedthatapetitionerundersentenceofacourtofTennesseehadthreeyearsfromthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakentofileapetitionforpostconvictionrelief.SeeT.C.A.4030102(repealed1995).  TheappellantfiledapetitionforpostconvictionreliefonMay21,1996.ThiswasafterthenewPostConvictionProcedureAct,effectiveMay10,1995,hadbeenenacted,reducingthestatuteoflimitationtooneyear.SeeT.C.A.4030202(a).Counselwasappointedtorepresenttheappellant,andanamendedpetitionwasfiledonDecember11,1996.Afterahearingonthemerits,thetrialcourtdeniedreliefonMarch14,1997.Anoticeofappealwasfiled,andthecaseproceededtothisCourt.Theappellantfiledabrief,andinresponse,thestatefiledamotiontoaffirmthejudgment.  Whileonthefaceoftherecorditappearedthattheappellantfailedtofilehispetitionforpostconvictionreliefwithintheoneyearstatuteoflimitation,therecorddidnotreflectthatthetrialcourtconsideredthestatuteoflimitationissue,andconsequently,theappellantwasnotgivenanopportunitytoshowthatoneormoreoftheenumeratedexceptionssetforthinT.C.A.4030202(b)wouldbeapplicable.Accordingly,thisCourtremandedthemattertothetrialcourtforfurtherproceedings.  Afterasecondhearing,thetrialcourtenteredanorderdismissingtheappellantspostconvictionpetition.Thetrialcourtfoundthatthepetitionwasfiledoutsidetheoneyearstatuteoflimitationandthatnoneoftheexceptionstothestatuteappliedintheinstantmatter.  TheappellantconcedesthathispetitionwasfiledoutsidetheoneyearstatuteoflimitationandthatnoneoftheenumeratedexceptionssetforthinT.C.A.4030202(b)areapplicable.Instead,onappeal,hecontendsthattheoriginalthreeyearstatuteoflimitationshouldapply.  UnderT.C.A.4030202(a),apetitionermustpetitionforpostconvictionreliefwithinoneyearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealwastakenor,ifnoappealwastaken,withinoneyearofthedateonwhichthejudgmentbecamefinal.TheCompilersNotestoT.C.A.4030201indicatethatthe1995PostConvictionActgovernsallpetitionsforpostconvictionrelieffiledafterMay10,1995,andthat anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastone(1)yearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart.Moreover,ourSupremeCourthasheldthat(&Ԁ(XtheenablingprovisionoftheAct,whichincludestheprovisiongrantingpersonssuchastheappellantuntilMay10,1996,tofileapetition,adequatelyprotectedtherightsofpetitioners.Carterv.State,952S.W.2d417,420(Tenn.1997).Thisissueiswithoutmerit.
