Therecorddoesnotcontainatranscriptoftheguiltypleaproceeding.AboutallwecanascertainregardingtheunderlyingfactsoftheoffenseisthattheDefendantsoldanotherindividualasmallquantityofcrackcocaine.Hepleadedguilty,withsentencinglefttothediscretionofthetrialjudge.TheStatefirstarguesthattheDefendantwassentencedpursuanttoapleaagreementandthatthereforetheDefendanthasnorighttoappealthedenialofdiversion.Fromourviewoftherecord,webelievetheDefendantenteredintoa openendedpleawithsentencinglefttothediscretionofthetrialcourt.WethereforeconcludethatanappealliesasofrightpursuanttoRule37(b)(2)(ii)oftheTennesseeRulesofCriminalProcedure.SeeStatev.TalmadgeG.Wilbanks,C.C.A.No.02C019601CR00003,ShelbyCounty(Tenn.Crim.App.,Jackson,ϜNov.19,1996)(holdingthatanappealliesasofrightfromthejudgmentofatrialcourtdenyingjudicialdiversion). Wenowturntotheprincipalissuebeforeusinthepresentcase,namely,whetherthetrialcourtabuseditsdiscretionindenyingjudicialdiversion.Tennesseecourtshaverecognizedthesimilaritiesbetweenjudicialdiversionandpretrialdiversionand,thus,havedrawnheavilyfromthecaselawgoverningpretrialdiversiontoanalyzecasesinvolvingjudicialdiversion.Forinstance,indeterminingwhethertograntpretrialdiversion,adistrictattorneygeneralshouldconsiderthedefendantscriminalrecord,socialhistory,mentalandphysicalcondition,attitude,behaviorsincearrest,emotionalstability,currentdrugusage,pastemployment,homeenvironment,maritalstability,familyresponsibility,generalreputationandamenabilitytocorrection,aswellasthecircumstancesoftheoffense,thedeterrenteffectofpunishmentuponothercriminalactivity,andthelikelihoodthatpretrialdiversionwillservetheendsofjusticeandbestinterestsofboththepublicandthedefendant.SeeStatev.Washington,866S.W.2d950,951(Tenn.1993);Statev.Hammersley,650S.W.2d352,355(Tenn.1983).Atrialcourtshouldconsiderthesamefactorswhendecidingwhethertograntjudicialdiversion.SeeStatev.Bonestel,871S.W.2d163,167(Tenn.Crim.App.1993);Statev.Anderson,857S.W.2d571,57273(Tenn.Crim.App.1992).Moreover,atrialcourtshouldnotdenyjudicialdiversionwithoutexplainingboththespecificreasonssupportingthedenialandwhythosefactorsapplicabletothedenialofdiversionoutweighotherfactorsforconsideration.SeeBonestel,871S.W.2dat168. Inaddition,thisCourtapplies thesamelevelofreviewasthatwhichisapplicabletoareviewof[a]districtattorneygeneralsactionindenyingpretrialdiversion.Statev.George,830S.W.2d79,80(Tenn.Crim.App.1992);seeϜalsoBonestel,871S.W.2dat168;Anderson,857S.W.2dat572.Inotherwords,thisCourtreviewstherecordtodeterminewhetherthetrialcourtabuseditsdiscretion.SeeBonestel,871S.W.2dat168;Anderson,857S.W.2dat572.Tofindanabuseofdiscretion,wemustdeterminethatnosubstantialevidenceexiststosupporttherulingofthetrialcourt.SeeBonestel,871S.W.2dat168;Anderson,857S.W.2dat572. Inthecasesubjudice,thepresentencereportreflectsthattheDefendantwastwentyoneyearsold,unmarriedandhadsuccessfullycompletedhighschool.Hehadagoodworkrecordandnosignificantcriminalhistory.Hehadrecentlyundergonesurgeryforakidneyproblem,buthishealthwasapparentlygood.HismotherhadsomehealthproblemsandshereportedthattheDefendanthelpedcareforher. Atthehearingonthepetitionforjudicialdiversion,theonlywitnesstotestifywastheDefendant.HestatedthatthepersontowhomhesoldtheϜdrugs,whowasacodefendant,cametohishomeandaskedhimifhehadanydrugstosell.Hesoldherthecocaineanditturnedoutshewasworkingwiththepoliceandhewassubsequentlyarrested.Hetestifiedthatthiswasthefirsttimehehadeversolddrugs.Hestatedthatatthetimehesoldtheotherpersonthedrugs,hedidnotknowherandthathewasamongagroupofpeopleshootingbasketballinfrontofahouseandshejustapproachedthemandaskedifsomeonecouldsellhersomedrugs.HesaidthathewastheoneϜwhohappenedtorespond.Hefirststatedthathehadacquiredthedrugsthedaybeforehesoldthembutthenstateditwasmoreliketwoweeksbeforehesoldthem.Hesaidthatheboughtten rocksforonehundreddollarsbuthelatertestifiedthathepaidfivedollarsper rock.Hesaidthatthe rockthathesoldtheotherpersonwastheonly rockhehadatthetimeandthathehadputtherestofthe rocksinafieldandasfarasheknewtheywerestillinthefieldatthetimeofthesentencinghearing.Hetestifiedthattheywerethefirstdrugshehaddealtwithandthathegotthemfromsomeonewhoheknewonlyas Snake.WhenthejudgeaskedtheDefendantaboutthepersonhehadacquiredthedrugsfrom,theDefendantstated, Idontknowhisfullname.IjustknowhimasSnake.ThatsallIknow. IndenyingtheDefendantdiversion,thetrialjudgeexpressedhisconcernthatdrugtraffickingisa horriblecrime.Concerningdrugtraffickers,thejudgestated Ithinkiftheresanysetofcircumstancesthatdoesnotdeservediversion,itsthesesetofcircumstances.Randomlysellingdrugstopeopleonthestreetandcarenotwhathappenstothem,becauseofgreed.ThetrialjudgefoundtheDefendantlackingincredibility,stating, no,sir,Mr.Douglas,Ithoughtthatagoodbitofyourtestimonywasntthetruth,veryhonestly.TheStatearguesthattheDefendantslackofcandorduringhistestimonyjustifiesthetrialjudgesdenialofdiversion.FromourreviewoftheDefendantstestimony,wecertainlyunderstandwhythetrialjudgefoundtheDefendantlackingincredibilityandwhythetrialjudgewasunimpressedwiththeDefendantsexplanationofthecircumstancessurroundingthisoffense.Ifatrialjudgefindsthatadefendanttestifiesuntruthfullyatahearingonanapplicationforjudicialdiversion,afavorabledecisioncanhardlybeexpected. Aswehavestated,thegrantingofjudicialdiversionlieswithinthesounddiscretionofthetrialcourt.ThetrialcourtisinthebestpositiontodeterminetheDefendantsattitudeanddemeanor.Here,itisclearthatthejudgefoundtheDefendanttobedishonestandunrepentant.Thesefactorsalonemaybesufficienttojustifythetrialcourtsdenialofjudicialdiversion.SeeStatev.Dowdy,894S.W.2d301,307(Tenn.Crim.App.1994).Therecordshowsthatthetrialjudgeconsideredthepresentencereport,thenatureoftheoffense,andthecircumstancesoftheDefendant.Thetrialjudgedeniedjudicialdiversionbutgrantedprobation.Weareunabletoconcludethatthetrialjudgeabusedhisdiscretion.SeeStatev.George,830S.W.2d79,80(Tenn.Crim.App.,1992);ϜseealsoStatev.Anderson,857S.W.2d571,574(Tenn.Crim.App.,1992).
