àò òFACTSó óÌóóÌà àAtwood€Rawls,€an€off„duty€Memphis€police€officer,€œwas€a›€security€officer€forÏDillardððs€department€store€on€the€date€of€the€offense,€January€2,€1995.€€HeÏobserved€defendant€take€four€(4)€Perry€Ellis€vests€from€a€display€rack€and€go€intoÏa€dressing€room.€€Rawls€went€to€the€door€of€the€dressing€room€and€heard€aÏsnapping€sound€like€that€made€when€the€anti„theft€sensors€are€removed€fromÏclothing.€€Defendant€came€out€of€the€dressing€room€carrying€only€two€(2)€vests,Ïwhich€she€returned€to€the€display€rack.€€When€she€left€the€store,€the€alarm€did€notÏsound.€€Because€Rawls€could€not€find€the€two€(2)€missing€vests€or€the€brokenÏsensors€in€the€dressing€room,€he€searched€the€pockets€of€the€vests€defendantÏhad€replaced€on€the€rack.€€He€found€two€broken€sensors€and€the€price€tags€fromÏthe€missing€vests.€€He€found€defendant€in€the€mall.€€When€he€asked€her€about€theÏmissing€vests,€she€said€she€had€them€underneath€her€coat.€€Rawls€told€her€sheÍwas€under€arrest€and€took€her€back€to€œDillardððs.›Ìà àMary€Pickens,€also€a€Memphis€police€officer,€was€on€patrol€at€the€mall€andÏaccompanied€Rawls€and€defendant€back€to€Dillardððs.€€She€heard€the€defendantÏsay€that€she€had€popped€the€sensors€with€her€fingers,€and€that€she€had€one€vestÏfor€herself€and€one€for€her€boyfriend.€€Ìà àDefendant€married€her€boyfriend€prior€to€trial.€€He€testified€that€he€and€the€œÌÌdefendant›€had€bought€the€two€vests€as€Christmas€gifts€for€each€other€but€couldÏnot€find€the€receipt.€€He€produced€undated€Polaroid€snapshots€showing€themÏunwrapping€and€wearing€their€vests€with€a€Christmas€tree€in€the€background.€€HeÏtestified€the€pictures€were€taken€during€Christmas€1994.€€They€had€both€beenÏwearing€these€vests€on€January€2,€1995,€and€as€she€dropped€him€off€at€work,€heÏhad€given€her€his€vest€to€wear€due€to€the€cold.€€She€drove€away€wearing€bothÏvests€according€to€the€husbandððs€testimony.Ìà àDefendant€also€testified€that€she€and€her€husband€had€given€each€otherÏPerry€Ellis€vests€for€Christmas€1994.€€As€she€dropped€him€off€at€work€the€day€ofÏher€arrest,€he€had€given€her€his€vest€which€she€wore€œover›€her€vest.€€She€went€toÏDillardððs€to€look€for€washable€vests.€€She€tried€on€two€vests€and€replaced€them€onÏthe€rack.€€After€leaving€Dillardððs,€she€was€grabbed€by€Rawls.€€She€deniedÏconfessing€to€Rawls€and€Officer€Pickens€that€she€took€the€vests.ÌÌà@ àò òòòSUFFICIENCY€OF€THE€EVIDENCEóóó óÌÌà àWhen€an€accused€challenges€the€sufficiency€of€the€evidence,€this€courtÏmust€review€the€record€to€determine€if€the€evidence€adduced€during€the€trial€wasÏsufficient€œð ðThe€trial€judgeððs€conduct€andÏstatements€toward€defense€witnesses€constitute€improper€comments€on€theÏevidence.ðð€€The€only€comments€actually€mentioned€at€the€motion€for€new€trialÏrelated€to€defendantððs€requests€for€a€lie„detector€test.€€On€appeal€defendantÏalleges€other€examples.€€Any€alleged€errors€as€to€these€other€examples€haveÏbeen€waived€for€failure€to€specifically€raise€them€in€the€motion€for€new€trial.€€òòSeeóóÏTenn.€R.€App.€P.€3(e);€€òòState€v.€Gauldinóó,€737€S.W.2d€795,€798€(Tenn.€Crim.€App.Ï1987).€€However,€our€review€of€these€comments€does€not€reveal€any€reversibleÏerror.€€Ìà àThe€comments€before€us€on€appeal€consist€of€the€trial€courtððs€warning€œÌÌdefendant›€to€refrain€from€referring€to€her€alleged€offer€to€take€a€ð ðlie„detector€test.ððÏDefendant€claims€these€comments€constituted€an€improper€comment€on€theÏweight€of€the€evidence.€€€The€challenged€exchange€consisted€of€the€following:ÌÓÓÌœà8 à[DEFENDANT]:›€€Yes,€she€[Pickens]€said„„she€said,€ð ðHow€did€you€getÏthose€sensors€off:ðð€And€I€said,€ð ðYouððve€got€the€wrong€person.ðð€€I€said,Ïð ðWe€can€clear€all€this€up€by€giving€me€a€lie„detector€test.ðð€€I€said,€ð ðIððllÏtake€a€lie„detector€test.€€Just€please€get€someone€in€here€right€nowÏand€[Iððll]€take€a€lie„detector€test.ðð€€And€when€I€said€that„„à8 àÌà8 àÌœà8 àTHE›€COURT:€Ms.€Dowagiac,€if€you€mention€the€lie€detector€œagain,ÏIððm›€going€to€find€you€in€contempt€of€court.€€Do€œnot›€mention€that€wordÏagain.€€All€right,€maððam?€œòòÌ›ÌÓÓœóó.›€.€.€.Ìà àWhen€defense€counsel€attempted€to€resume€his€direct€examination,€theÏdefendant€referred€to€the€subject€again:€€ð ðWell,€right€before€she„„when€I€said€thatÏlast€statement€that€Iððm€not€supposed€to€œsay„„.ð𛀀The€court€€reminded€her€again€notÏto€refer€to€anything€having€to€do€with€this€subject.€Ìà àThe€trial€judge€at€the€motion€for€new€trial€explained€that€he€was€presentedÏwith€an€€emergency€situation€of€the€defendantððs€making€and€felt€from€the€look€onÏher€face€and€her€attitude€that€she€knew€it€was€improper€but€did€it€anyway.€€WeÏgive€great€deference€to€the€trial€judge€who,€unlike€this€Court,€was€able€to€observeÏthe€demeanor€of€the€witness.€€€€€Ìà àAn€offer€to€take€a€polygraph€test€is€not€admissible€in€a€criminal€proceeding.€ÏòòState€v.€Campbellóó,€904€S.W.2d€608,€614„615€(Tenn.€Crim.€App.€1995).€€The€trialÏjudge€had€to€act€immediately.€€While€the€trial€court€should€not€have€threatenedÍthe€witness€with€contempt€of€court€in€the€presence€of€the€jury,€we€find€that€the€trialÏcourtððs€admonition€did€not€affect€the€results€of€this€trial.€€Tenn.€R.€App.€P.€36(b).€ÏThis€issue€is€without€œmerit.›ÌÌœ›à@
