ƒ2 ××  ×€€Therefore,€we€review€the€defendantððsÏsentence€without€the€presumption€of€correctness.ÌÌà àIn€considering€whether€the€trial€court€erred€in€sentencing€theÏdefendant,€we€must€consider€òòdeóó€òònovoóó€the€evidence€presented€as€well€as€theÏsentencing€principles€and€considerations€embodied€by€our€sentencing€laws.€ÏWe€must€also€evaluate€the€mitigating€and€enhancing€factors€that€are€applicableÏto€this€case.€€Finally,€we€must€examine€the€sentence€in€light€of€the€nature€andÏcharacter€of€the€offense€and€Downeyððs€potential€for€rehabilitation.€€òòSeeóó€€òòState€v.ÏAshbyóó,€823€S.W.2d€at€169.€ÌÌà àThe€foremost€purpose€of€sentencing€is€to€promote€justice€byÏimposing€sentences€that€are€ð ðjustly€deserved€in€relation€to€the€seriousness€ofÏthe€offense.ðð€€Tenn.€Code€Ann.€ðð€40„35„102€(1).€€The€sentence€should€beÏdesigned€to€encourage€respect€for€the€law,€to€prevent€further€criminal€conduct,Ïand€to€encourage€effective€rehabilitation€where€it€is€reasonably€feasible.€€Tenn.ÏCode€Ann.€ðð€40„35„102(3).€€Courts€must€consider€the€effect€a€sentence€willÍhave€on€the€individual€defendant€as€well€as€on€society€at€large.€€òòState€v.€Gilboyóó,Ï857€S.W.2d€at€889.€€€€Practical€fiscal€limitations€require€that€confinement€beÏreserved€for€those€with€long€criminal€histories€who€have€failed€under€lessÏrestrictive€punishments€and€for€offenses€which€require€confinement€to€avoidÏdepreciating€the€seriousness€of€the€offense.€€€Tenn.€Code€Ann.€ðð€40„35„103€(1).€ÏThe€sentence€imposed€should€be€the€minimum€necessary€to€achieve€theÏsentencing€purpose.€€òòIdóó.€at€(2).€€ÌÌà àThe€record€in€this€case€consists€of€a€transcript€of€the€sentencingÏœhearing›œ€and€exhibits,€including›€the€presentence€report,€œthe›€defendantððs€medicalÏœhistory›œ,€and›€notes€from€her€therapist€and€psychiatrist.€€The€defendant,€herÏmother,€and€the€defendantððs€therapist€testified€at€the€sentencing€hearing.€€TheÏrecord€discloses€that€the€œforty„seven›€year€old€defendant€was€married€andÏdivorced€twice.€€Her€first€husband€abused€her€sexually.€€She€has€no€childrenÏand€suffers€from€a€thyroid€disorder€and€lupus.€€She€has€been€disabled€sinceÏ1987€or€1988€when€her€leg€was€badly€broken€in€a€horseback€riding€accident.€€AtÏthe€time€of€the€sentencing€hearing,€she€lived€with€and€cared€for€her€elderlyÏmother€who€is€in€poor€health.€€Her€father€died€two€weeks€before€her€last€arrestÏon€March€29,€1996.€€As€a€result€of€œan›€arrest€in€1991,€the€defendant€became€aÏpatient€at€the€Nolachuckey„Holston€Mental€Health€Center€in€Greeneville,ÍTennessee,€where€she€œhas€received›€individual€and€group€therapy€andÏmedication€on€a€regular€basis€through€the€date€of€the€sentencing€hearing.€€ÌÌà àThe€clinic€diagnosed€her€as€having€a€mixed€personality€disorderÏwith€borderline€œtraits›œ;›€major,€reoccurring€depression€that€is€moderate€to€œsevere›œ;›Ïalcohol€dependence€that€is€in€œremission›œ;›€and€kleptomania.€€At€the€time€of€theÏhearing,€she€was€taking€prozac,€vistaril,€and€trazodone.€€Joy€White,€herÏtherapist,€€testified€that€kleptomania€is€a€recognized€disorder€listed€in€theÏAmerican€Psychiatric€Associationððs€Diagnostic€and€Statistical€Manual€of€MentalÏDisorders,€Number€4€Revised€(DSM„IV„R).€€She€described€kleptomania€as€anÏincorrect€coping€mechanism€to€which€the€defendant€resorts€in€times€of€tension,Ïstress,€anxiety€and€grief.€€According€to€her€testimony,€large€doses€of€prozac€hadÏrecently€been€found€useful€in€controlling€the€impulsive€behavior€ofÏkleptomaniacs.€€The€psychiatrist€was€gradually€increasing€defendantððs€dosageÏof€prozac,€and€the€therapist€reported€that€she€was€œdisplaying€less€impulsiveÏbehavior.›€€€She€recommended€a€continuing€intensive€treatment€programÏinvolving€therapy€as€well€as€continued€medication.€€œShe€testified€thatÏincarceration€ð ðwonððt€stop€the€behavior,€if€anything€it€will€enhance€it€....€€TheÏproblem€is€psychological€...€not€physical€or€practical.ðð€€Also,€the€therapist€statedÏthat€there€are€ð ðsome€medical€problems€involved.ðð›ÌÌà àThe€trial€judge€found€that€two€enhancement€and€five€mitigatingÏfactors€apply€to€the€defendantððs€sentence.€The€record€sustains€the€trial€courtððsÏconclusion€that€the€defendant€has€ð ða€previous€history€of€criminal€convictions€orÏcriminal€behavior.ðð€€Tenn.€Code€Ann.€ðð€40„35„114(1).€€The€defendant€admittedÏthat€she€had€two€prior€convictions€for€shoplifting,€one€in€1988€and€one€in€1992.€ÏShe€also€admitted€to€numerous€shoplifting€incidents€throughout€her€life.× ƒ3 ××  ×€€TheÏevidence€in€the€record,€however,€does€not€support€the€trial€judgeððs€finding€thatÏshe€has€ð ða€previous€history€of€unwillingness€to€comply€with€the€conditions€of€aÏsentence€involving€release€in€the€community.ðð€€The€defendant€was€placed€onÏprobation€both€in€1988€and€in€1992.€€In€1992,€she€served€15€days€in€jail€and€theÏrest€of€her€eleven€month€and€twenty„nine€day€sentence€on€probation.€€The€trialÏjudge€assumed€that,€since€she€admitted€to€many€shoplifting€incidents€in€her€life,Ïsome€of€them€must€have€occurred€when€she€was€on€probation.€€Nothing€in€theÍrecord€supports€this€assumption.€€She€apparently€completed€her€probationaryÏperiods€without€incident.× ƒ4 ××  ×€ÌÌà àAs€mitigating€factors,€the€trial€court€found€that€ÌÓÓà à1.à8 àThe€defendantððs€conduct€neitherÏcaused€nor€threatened€any€seriousÏbodily€injury.€€Tenn.€Code€Ann.€ðð€40„35„113(1).ÌÌà à2.à8 àThe€defendant€suffers€fromÏkleptomania,€a€well„diagnosedÏpsychiatric€illness€not€caused€by€anyÏmisconduct€on€her€part.ÌÌà à3.à8 àThe€defendant€cares€for€and€helps€herÏelderly€mother€who€needs€considerableÏcare.ÌÌà à4.à8 àThe€defendant€suffers€from€œdepression›œÏand€has›€physical€ailments€including€aÏdisability€resulting€from€a€kick€by€aÏhorse.ÌÌà à5.à8 àThe€defendant€had€an€unfortunateÏmarriage€during€which€she€sufferedÏconsiderable€abuse.ÌÌÓÓThe€trial€judge€refused€to€consider€the€stressful€situation€caused€by€her€fatherððsÏrecent€death€as€a€mitigating€factor€because€he€had€died€ð ðon€or€about€the€time€ofÏthis€offense.ðð€€€We€agree€that€the€defendantððs€mental€and€physical€condition€areÏsignificant€mitigating€factors.€Moreover,€the€therapist€testified€that€stressfulÏevents€such€as€death,€divorce,€and€illness€could€trigger€the€impulsive€behaviorÏthat€leads€to€shoplifting,€and€the€death€of€the€defendantððs€father€may€well€haveÏled€to€the€shoplifting€for€which€she€was€arrested€just€two€weeks€later.€€€€We€findÏthat,€although€the€enhancement€factor€is€entitled€to€great€weight,€the€mitigatingÏœfactors€found€by€the€court€›€in€this€case€are€œalso€of›€œgreat›€significance.ÌÌà àNext€we€must€assess€the€nature€and€character€of€the€offense.€ÏKaren€Downey€stole€a€watch,€an€ankle€bracelet,€and€a€few€other€pieces€ofÏjewelry.€€The€total€value€of€these€items€was€considerably€less€than€five€hundredÏdollars,€and€the€œgoods€were›€returned€œto›€Hillððs€Department€Store.€€€Although€thisÏincident€does€not€involve€a€significant€loss,€the€trial€court€was€properlyÏconcerned€about€the€defendantððs€lengthy€history€of€shoplifting€that€is€clearlyÏmuch€more€extensive€than€her€two€previous€convictions€would€indicate.€€€TheÏtrial€court€was€rightly€aware€of€the€need€to€protect€the€public€from€such€criminalÏacts.€Tenn.€Code€Ann.€ðð€40„35„103)(1)(A)€(1990).€ÌÌà àFinally,€we€must€consider€the€defendantððs€potential€forÏrehabilitation.€€We€find€that,€although€she€has€missed€appointments€for€therapyÏand€has€sometimes€resisted€or€denied€the€need€to€change,€she€has€persisted€inÏher€treatment€program€for€several€years.€€This€persistence€indicates€that€sheÏhas€the€desire€to€make€positive€changes€and€is€willing€to€work€to€achieve€them.€ÏHer€efforts,€unfortunately,€€have€not€always€been€successful.€€The€recordÏindicates€that€she€is€œin€need›€of€consistent€structure€and€intensive€counseling€asÏwell€as€close€monitoring€for€her€medication.€€€œMoreover,€the€evidence€reflectsÏthat€at€the€time€of€sentencing,€management€of€her€impulsive€behavior€wasÏimproving€because€of€her€therapy€and€medication€regimen.›ÌÌœ›à àWe€conclude€that,€on€the€rather€unusual€facts€of€this€case,€a€periodÏof€incarceration€œwould€not€serve€the€purposes€of€the€1989€Sentencing€Act.€ÏHowever,€we€do›€œnot€believe›€œthat€it€would›€be€in€the€best€interests€of€either€theÏpublic€or€the€defendant€to€leave€the€defendant€without€adequate€supervision.€ÏTherefore,€we€affirm€the€defendantððs€sentence€of€eleven€months€and€twenty„nine€days€but€modify€the€service€of€that€sentence€to€require€that€she€serve€theÍentire€period€on€intensive€probation.œ× ƒ5 ××  ×›€€Upon€remand€the€trial€judge€shall€imposeÏappropriate€conditions€of€probation,€including,€but€not€limited€to,€continued€andÏconsistent€participation€in€individual€and€group€counseling€as€recommended€byÏher€psychiatrist€and€therapist,€strict€compliance€with€the€medication€ordered€byÏher€doctors,€and€some€form€of€community€service€that€is€compatible€with€herÏphysical€disabilities.€€ÌÌà àThe€judgment€of€the€trial€court€is€hereby€affirmed€in€part€andÏmodified€in€part.€€The€case€is€remanded€for€the€entry€of€a€modified€judgmentÏform€consistent€with€this€opinion€and€to€allow€the€court€to€impose€conditions€ofÏprobation.€€ÌÌÓÓà
