OnNovember14,1995,atabout11:00p.m.,thearrestingofficerobserveddefendantcrossthehighwaycenterlinetwotimesandrunofftheroadonce.Theofficerstoppedthedefendant.Defendanthadastrongodorofalcoholabouthimandwasunabletoproperlyperformthefieldsobrietytests.Twootherofficerstestifiedthatdefendantwasdrunk.Defendantrefusedthebreathalysertest.Therevokedstatusofhisdriverslicensewasstipulated. Defendantadmittedtohavingthreebeers,butsaidthathewasnotimpaired.Defendanttestifiedthathisweavingwasprobablyduetoalowtire,andhefelthehadpassedthefieldsobrietytests.Thewreckerdriverwhotowedthecarsaidhehadnotnoticedwhetherthetirewasflatbeforehetowedit,buthenoticedthetirewasflatthenextmorning.
