DistrictAttorneyGeneral      ARTHURF.BIEBER      AssistantDistrictAttorneyGeneral      204FranklinStreet,Suite200      Clarksville,TN37040OPINIONFILED_______________________AFFIRMEDPURSUANTTORULE20DAVIDG.HAYES,JUDGE@ OPINION   Theappellant,AnnaM.Eadie,appealsasofrightfromthetrialcourtsrevocationofhercommunitycorrectionssentence.Shecontendsthattheevidencepresentedatherrevocationhearingisinsufficient,asamatteroflaw,tosupportarevocationofcommunitycorrections. /   ׀Basedonourreviewofthebriefsandoftheentirerecordinthiscause,weconcludethatthisisanappropriatecaseforaffirmanceunderRule20,TennesseeCourtofCriminalAppealsRules.  In1993,theappellantenteredaguiltypleatoDUI,firstoffense,andshewassentencedto11monthsand29days,allofwhichwassuspended.Shewasalsoorderedtopaya$250fine.Theappellantviolatedprobationin1993byfailingtoreporttoherprobationofficerandbyfailingtoreportachangeofaddress.In1995,theappellantagainviolatedprobationwhenshewasconvictedoftwocountsofforgery.Theappellantwassentencedtotwoyearsforeachcountofforgery,tobeservedconsecutively.Bothsentencesweresuspended.Shewasalsoorderedtopayallcourtcostsandrestitution.In1996,theappellantwasconvictedofaseparatechargeofforgeryandwassentencedtotwoyearsofcommunitycorrections.Shewasagainorderedtopayrestitution.Basedonthisconvictionofforgery,thetrialcourtrevokedtheappellantsprobationbeingservedforherDUIandpriorforgeryconvictions.Theappellantwasorderedtoservetheremainderofthosesentencesoncommunitycorrections,consecutivelytoher1996sentenceforforgery.  TheappellantscommunitycorrectionssentencebeganonOctober10,1996.Subsequently,onNovember14,1996,aviolationwarrantwasissued.TheappellantwasservedwiththeviolationwarrantonMarch14,1997,andtheappellantreportedtohercommunitycorrectionssupervisorapproximatelyoneweeklater.  Attherevocationhearing,theappellantscommunitycorrectionssupervisortestifiedthattheappellantfailedtoreport,leftthecountywithoutpermission,andfailedtopayrequiredcourtcosts.Theappellantadmittedthatshefailedtoreporttohercommunitycorrectionssupervisor.ShealsoadmittedgoingtoSouthCarolinafortwoweekswithoutrequestingpermission.Whiletherecordindicatesthattheappellantbegancomplyingwiththeconditionsofcommunitycorrectionsaftertheviolationwarrantwasserved,shecouldoffernoexplanationastowhyshehadfailedtocomplyinthepast.Basedontheproof,thetrialcourtrevokedtheappellantscommunitycorrectionssentenceandorderedthattheappellantservetheremainderofhersentenceinconfinement.  Uponafindingthatadefendanthasviolatedtheconditionsofcommunitycorrections,itiswithinthetrialcourtsdiscretiontoorderthedefendanttoservethesentenceinconfinement.Statev.Harkins,811S.W.2d79,82(Tenn.1991).InorderforthisCourttofindthatatrialcourtabuseditsdiscretioninarevocationproceeding,itmustbeestablishedthattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudgethatthedefendantviolatedthetermsofthecommunitycorrectionsprogram.Id.Theproofofaviolationofcommunitycorrectionsneednotbeestablishedbeyondareasonabledoubt,butitissufficientifitallowsthetrialjudgetomakeaconscientiousandintelligentdecision.Id.;Statev.Milton,673S.W.2d555,557(Tenn.Crim.App.1984).  Inrevokingtheappellantscommunitycorrectionssentence,thetrialcourtmadethefollowingfindings:8 TheissuebeforetheCourtiswhetherornotsheviolatedhersentence,andtheCourtfindsthatshedid.Shefailedtoreport.Shedidnotgetpermissionbeforeleavingthearea.Shehasnotcompliedwiththeconditionsofhersentence.8  TherecordreflectsthatMs.Eadiehas,bymycount,beenaccusedofviolatingprobationatleastsixtimessince1992.ForfiveyearsMs.Eadiehasbeeninandoutofthiscourt.AndshesbeenoneveryprogramthereisthatIknowof.8  TheCourttoldMs.EadiebackinOctoberof96whenshestoodrighttherethattheopportunitythatIgaveherthenwouldbeherlast,soitis.Youareorderedtoservethebalanceofyou[sic]sentencewithTDOC.  Onthisrecord,itisclearthatthetrialcourtwasjustifiedinfindingthattheappellantviolatedhercommunitycorrectionsandthattheproofoftheappellantsviolationswassufficienttoallowthetrialcourttomakeaconscientiousandintelligentdecision.Accordingly,baseduponareadingoftheentirerecord,thebriefsoftheparties,andtheapplicablelaw,thisCourtfindsthatthejudgmentofthetrialcourtshouldbeaffirmedpursuanttoRule20,TennesseeCourtofCriminalAppealsRules.
