DistrictAttorneyGeneralP.O.Box937Franklin,TN370650937 OPINIONFILED:򀀀AFFIRMEDJOEG.RILEY,JUDGE 7IXXdXXd7@  OPINION    8  Appellant,DonaldWayneEasley,appealsthedenialofamotiontoreopenhispriorpetitionforpostconvictionrelief.Themotionallegedthe reasonabledoubtjuryinstructiongivenathis1986trialwasunconstitutional.Healsoallegedthatthestatein1990agreedtorecommendasentencereductiontothecourtinexchangeforhiscooperation.Thetrialcourtdeniedreliefwithoutahearing,findingthemotiondidnotstateacolorableclaimforrelief.Weaffirmthejudgmentofthetrialcourt.@ PROCEDURALHISTORY  Appellantwasconvictedofrobberywithadeadlyweaponin1986andsentencedtolifeimprisonment.ThisCourtupheldthatconviction,Statev.DonaldWayneEasley,C.C.A.No.8775111,WilliamsonCounty(Tenn.Crim.App.filedMay11,1988,atNashville),andtheTennesseeSupremeCourtdeniedpermissiontoappealinAugust1988.Appellantfiledhisoriginalpetitionforpostconvictionreliefin1990,whichwasheardanddeniedin1991.InMay1996,appellantfiledthemotiontoreopenhispostconvictionproceedingpursuanttoTenn.Code.Ann.4030217.Thatmotionwasdeniedwithoutahearing.̜ @ MOTIONTOREOPENPOSTCONVICTIONPROCEEDING ̛̜ Tenn.CodeAnn.4030217specifies:8 (a)Apetitionermayfileamotioninthetrialcourttoreopenthefirstpostconvictionpetition only ifthefollowingapplies:̀8 (1)Theclaiminthemotionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequired.Suchmotionmustbefiledwithinone(1)yearoftherulingofthehigheststateappellatecourtortheUnitedStatessupremecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial; or 8 (2)Theclaiminthemotionisbaseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted; or 8 (3)Theclaimassertedinthemotionseeksrelieffromasentencethat$wasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentence,andthepreviousconvictionhassubsequentlybeenheldtobeinvalid,inwhichcasethemotionmustbefiledwithinone(1)yearofthefinalityoftherulingholdingthepreviousconvictiontobeinvalid; and 8 (4)Itappearsthatthefactsunderlyingtheclaim,iftrue,wouldestablishbyclearandconvincingevidencethatthepetitionerisentitledtohavetheconvictionsetasideorthesentencereduced.(emphasesadded).     Thisstatutehasbeenthesourceofsomeconfusion.Acarefulreadingwillclarifyitseffectsandlimitations.Theword onlyintheopeningsentenceshowstheverynarrownatureofthisstatute.Onlythoseeventssetoutinoneofthefirstthree(3)subsectionsqualifiesasapotentialbasisforreopeningapostconvictionproceeding.However,toripenintoacolorableclaim,theground(orgrounds)allegedmustalsomeetthestandardsetoutinsubsection(4);namely,thatthefacts,iftrue,wouldestablishentitlementtorelief.@  REASONABLEDOUBTJURYINSTRUCTION  Onappeal,appellantcontendsthetrialcourterredwhenitdismissedhismotiontoreopenwithoutfirstappointingcounselandconductinganevidentiaryhearing.Hismotiontoreopenclaimedanewconstitutionalrightnotrecognizedatthetimeofthefirstpostconvictionproceeding,specifically,thatthe reasonabledoubtjuryinstructiongivenathistrialhadsincebeendeclaredunconstitutional. AppellantreliesuponthefederaldistrictcourtopinioninRickmanv.Dutton,864F.Supp.686(M.D.Tenn.1994).Tenn.CodeAnn.4030217(a)(1)specificallysetsouttheonlytwocourtsthatmayestablishnewconstitutionalrightscognizableinamotiontoreopen:thehigheststateappellatecourtortheUnitedStatesSupremeCourt.Afederaldistrictcourtisnotincluded. Furthermore,thechallenged reasonabledoubtinstructionisthesameinstructionthathasconsistentlybeenheldtobeconstitutionalbytheappellatecourtsinthisState.SeeStatev.Nichols,877S.W.2d722,734(Tenn.1994);Statev.Sexton,917S.W.2d263,266(Tenn.Crim.App.1995);Pettyjohnv.State,885S.W.2d364,366(Tenn.Crim.App.1994);Statev.Hallock,875S.W.2d285,294(Tenn.Crim.App.1993).
