Ð110€(1997).€€This€means€that€ð ða€trial€court€must€instruct€the€jury€on€all€lesser„included€offenses€if€theÐ $X" Ðevidence€introduced€at€trial€is€legally€sufficient€to€support€a€conviction€for€a€lesser€offense.ðð€€òòStateÐ ô$D # Ðv.€Burns,€óó6€S.W.3d€453,€464,€(Tenn.€1999);€citing€òòState€v.€Langford,€óó994€S.W.2d€126,€128€(Tenn.Ð à%0!$ Ð1999).€€This€mandate€to€charge€lesser„included€offenses€applies€whether€or€not€a€Defendant€requestsÐ Ì&"% Ðsuch€an€instruction.€€òòId.€€óóÐ ¸'#& ÐÌà  àIn€this€case,€the€trial€court€instructed€the€jury,€that€to€find€Defendant€guilty€of€rape€of€a€child,Ð )à$( Ðthe€State€must€prove€beyond€a€reasonable€doubt€that:€(1)€the€Defendant€had€unlawful€sexualÐ |*Ì%) Ðpenetration€of€the€alleged€victim;€(2)€AJ€was€less€than€13€years€of€age;€and€(3)€the€Defendant€actedÐ h+¸&* Ðintentionally,€knowingly,€or€recklessly.€€The€trial€court€further€instructed€the€jury,€should€they€findÐ ° ÐDefendant€not€guilty€of€this€offense,€that€they€were€to€consider€the€lesser„included€offense€ofÐ œì Ðaggravated€sexual€battery.€€The€jury€was€instructed€that€Ô_ÔinÔ_Ô€order€to€find€Defendant€guilty€ofÐ ˆØ Ðaggravated€sexual€battery,€the€State€must€prove€beyond€a€reasonable€doubt:€(1)€that€the€DefendantÐ tÄ Ðhad€unlawful€sexual€contact€with€the€alleged€victim€in€which€Defendant€intentionally€touched€theÐ `° Ðalleged€victimððs€intimate€parts,€or€the€clothing€covering€the€immediate€area€of€the€alleged€victimððsÐ L œ Ðintimate€parts;€(2)€the€alleged€victim€was€less€than€13€years€of€age;€and€(3)€the€Defendant€actedÐ 8 ˆ Ðintentionally,€knowingly,€or€recklessly.€€Furthermore,€the€trial€court€instructed€the€jury€that€if€theyÐ $ t Ðfound€Defendant€not€guilty€of€aggravated€sexual€battery,€they€were€to€consider€the€lesser„includedÐ  ` Ðoffense€of€assault.€€The€trial€court€defined€Ô_Ôassault:Ð ü L  ÐÔ_ÔÌà8  àÔ_Ô(1)Ô_Ô€à8` Ð Ð àthe€Defendant€caused€physical€contact€with€another;€ÐÔ$ ` x` x ÐÌà8  à(2)€à8` Ð Ð àthat€a€reasonable€person€would€regard€the€contact€as€extremelyÐ ¬ü  Ðoffensive€or€provocative;€andИè ` x` x ÐÌà8  à(3)€à8` Ð Ð àthe€Defendant€acted€intentionally€or€knowingly.ÐpÀ` x` x ÐÌÔ_ÔÔ_ÔÔ_ÔÔ_ÔÔ_ÔÔ_Ôà  àFollowing€these€instructions,€the€jury€concluded,€beyond€a€reasonable€doubt,€that€DefendantÐ H˜ Ðcommitted€aggravated€sexual€battery.€Ð 4„ ÐÌà  àÔ_ÔòòóóAÔ_Ô€lesser„included€offense€is€defined€as€an€offense€ð ðnecessarily€included€in€another€if€theÐ  \ Ðelements€of€the€greater€offense,€as€those€elements€are€set€forth€in€the€indictment,€include,€but€are€notÐ øH Ðcongruent€with,€all€the€elements€of€the€lesser.ðð€€òòId.óó;òò€Howard€v.€State,€óó578€S.W.2d€83,€85€(Tenn.Ð ä4 Ð1979).€Our€Supreme€Court,€in€òòState€v.€Burns,€óó6€S.W.3d€453€(Tenn.€1999),€established€a€two„part€testÐ Ð  Ðfor€determining€when€an€offense€is€a€lesser„included€offense.€€However,€in€this€case,€Ô_ÔchildÔ_Ô€abuse€isÐ ¼  Ða€lesser„included€offense€of€rape€of€a€child€only€because€the€legislature€has€so€provided€in€Tenn.Ð ¨ø ÐCode€Ann.€ðð€39„15„401(d).€€€Tennessee€Code€Annotated€ðð€39„15„401(a)€defines€child€abuse:€AnyÐ ”ä Ðperson€who€knowingly,€other€than€by€accidental€means,€treats€a€child€under€eighteen€(18)€years€ofÐ €Ð Ðage€in€such€a€manner€as€to€inflict€injury€or€neglects€such€a€child€so€as€to€adversely€affect€the€childððsÐ l¼ Ðhealth€and€welfare€commits€a€Class€A€misdemeanor.€€Furthermore,€subsection€(d)€states:€ð ða€violationÐ X ¨ Ðof€this€section€may€be€a€lesser„included€offense€of€any€kind€of€homicide,€statutory€assault,€or€sexualÐ D!” Ðoffense,€if€the€victim€is€a€child€and€the€evidence€supports€a€charge€under€this€section.€€In€any€caseÐ 0"€  Ðin€which€conduct€violating€this€section€also€constitutes€assault,€the€conduct€may€be€prosecuted€underÐ #l! Ðthis€section€òòoróó€under€ðð€39„13„101.ðð€€Tenn.€Code€Ann.€ðð€39„15„401(d)(emphasis€added).€€In€analyzingÐ $X" ÐTenn.€Code€Ann.€ðð€39„15„401(a)(d),€the€legislature€provided€that€one€can€be€prosecuted€for€assaultÐ ô$D # Ðòòoróó€child€abuse€under€an€appropriate€set€of€facts,€but€not€implicitly€prosecuted€for€both€offenses.€InÐ à%0!$ Ðthis€case,€Defendantððs€conduct€was€prosecuted€under€the€lesser„included€offense€of€assault,€asÐ Ì&"% Ðopposed€to€the€lesser„included€offense€of€child€abuse,€in€accordance€with€Tenn.€Code€Ann.€ðð€39„14„Ð ¸'#& Ð401(d).€€The€trial€court€instructed€the€jury€that€Class€B€misdemeanor€assault€was€a€lesser„includedÐ ¤(ô#' Ðoffense€of€rape€of€a€child€and€aggravated€sexual€battery.€Because€the€jury€was€instructed€on€the€lesserÐ )à$( Ðoffense€of€assault,€the€need€for€an€instruction€on€child€abuse€was€eliminated.Ð |*Ì%) Ðà  àÐ h+¸&* Ðà  àThe€evidence€in€this€case€is€a€classic€jury€determination.€€There€is€no€forensic€or€physicalÐ ° Ðevidence€to€corroborate€AJ's€allegation€of€this€sexual€offense.€€AJ€told€the€jury€that€DefendantÐ œì Ðsexually€molested€her.€€In€support€of€this€evidence,€Anna€Whary€testified€that€she€rememberedÐ ˆØ Ðbruises€on€the€child€and€knew€AJ€wanted€desperately€to€return€to€Michigan.€€AJ's€mother,€JannetteÐ tÄ ÐDennis,€testified€of€her€child's€demeanor€upon€her€return€to€Michigan€and€the€yellow€bruises€she€sawÐ `° Ðon€her€body.€€The€child's€only€reason€for€those€injuries€was€her€explanation€that€ð ðFrank€hit€me.ðð€€TheÐ L œ Ðdefense€contradicted€this€evidence€by€having€Linda€Elkins,€daughter€of€Defendant,€testify€that€noneÐ 8 ˆ Ðof€AJ's€testimony€was€true.€€Also,€defense€proof€advised€the€jury€that€the€bruises€occurred€duringÐ $ t Ðwrestling€and€horseplay€between€the€two€girls.€€€After€hearing€the€evidence€presented€at€trial,€the€juryÐ  ` Ðresolved,€beyond€a€reasonable€doubt,€the€credibility€of€all€witnesses€in€favor€of€the€State€by€findingÐ ü L  ÐDefendant€guilty€of€aggravated€sexual€battery.€Ð è 8  Ðà  àÌà  àWe€find€no€merit€to€this€issue.Ð À  Ðà  àà ` àà ¸ àà  àÌÔ_ÔÔ_Ôà8  àÔ_ÔÔ_Ôà@  ìÐ Ð àTENNESSEE€RULES€OF€EVIDENCE€412ˆÐ ˜è  ÐÌà  àDefendant€complains€that€he€was€denied€the€right€to€cross„examine€AJ€about€her€knowledgeÐ pÀ Ðof€sexual€matters€and€where€she€obtained€such€knowledge.€€In€a€preliminary€hearing,€the€trial€courtÐ \¬ Ðdenied€Defendantððs€motion€which€sought€permission€to€cross„examine€AJ€about€sexual€matters.€Ð H˜ ÐDefendant€contends€that€AJ€had€engaged€in€sexual€relations€in€January€of€2000.€€The€State€contendsÐ 4„ Ðthat€Defendant€raised€nothing€more€than€vague€allegations€of€sexual€activity€which€were€notÐ  p Ðsupported€by€the€evidence€and€further€failed€to€comply€with€the€mandatory€provisions€of€Tenn.€R.Ð  \ ÐEvid.€412(d)(1),€that€motions€must€be€filed€ten€(10)€days€prior€to€trial.€€Because€the€motion€was€filedÐ øH Ðone€day€prior€to€trial,€the€issue€is€waived€and€the€trial€court€properly€denied€the€motion.€€Nonetheless,Ð ä4 Ðwe€elect€to€address€the€trial€courtððs€ruling.€Ð Ð  ÐÌà  à€Prior€to€trial,€Defendant€filed€a€motion€to€offer€evidence€of€AJððs€alleged€sexual€behaviorÐ ¨ø Ðpursuant€to€Rule€412,€Tenn.€R.€Evid.€€Defendant€alleges€that€AJ€had€and€currently€has€a€longÐ ”ä Ðstanding€sexual€relationship€with€another€male.€€The€motion€further€contends€that€the€alleged€victimÐ €Ð Ðcommitted€such€conduct€in€the€state€of€Michigan€at,€before€and/or€after€the€time€of€the€allegedÐ l¼ Ðincident€herein.€€At€the€hearing€on€the€motion,€Linda,€daughter€of€Defendant,€testified€that€she€andÐ X ¨ ÐAJ€were€friends€from€kindergarten.€€She€stated€that€she€and€AJ€had€come€to€Tennessee€from€Owosso,Ð D!” ÐMichigan,€in€the€summer€of€1998.€€After€AJ€returned€to€Michigan,€Linda€remained€in€Tennessee,€butÐ 0"€  Ðeventually€returned€to€Michigan€as€well.€€Linda€still€saw€AJ€from€time€to€time€and,€on€one€occasion,Ð #l!
