OnJune25,1976,Petitionerwaivedajurytrialandpledguiltytofourcountsofrobberywithadeadlyweaponandonecountofgrandlarceny.Hewassentencedtofivefiveyearsentenceswhichranconcurrently.ThesepriorconvictionsapparentlywereusedtoenhancehispunishmentforsubsequentfederaloffensesforwhichheisnowincarceratedattheFederalCorrectionalInstitutioninMemphis,Tennessee.OnDecember21,1995,Petitionerfiledaprosepetitionseekingpostconvictionrelief.Thetrialcourtsubsequentlydismissedthepetitionasbeingbarredbythethreeyearstatuteoflimitations. Therecordsupportsthetrialcourtsfindingthatthepetitionistimebarred.InJuly1986,theTennesseeLegislatureenactedathreeyearstatuteoflimitationsonpostconvictionpetitions.Tenn.CodeAnn.4030102(repealed1995);seealsoPassarellav.State,891S.W.2d619,624(Tenn.Crim.App.),perm.toappealdenied,(Tenn.Nov.28,1994).PetitionersconvictionsandsentenceswereeffectiveonJune25,1976,andhedidnotappealanyoftheconvictions.Underthe1986statute,Petitionerhad3yearsfromJuly1,1986tofileacognizableclaimforpostconvictionreliefofthe1976convictions.Tenn.CodeAnn.4030102(repealed1995).Therefore,inordertoprevail,PetitionermusthavefiledapetitionbyJuly1,1989,totolltherunningofthestatute.ThepetitionintheinstantcasewasfiledonDecember21,1995,wellpastthethreeyearstatuteoflimitations.Thus,thePetitionerisbarredfromseekingpostconvictionrelief. EventhoughtheinstantpetitionwasfiledaftertheeffectivedateofthenewAct,theapplicablethreeyearstatuteoflimitationsinthe1986ActbarredthePetitionerspostconvictionreliefpriortoMay10,1995.PetitionersuggeststhatthisprovisionprovideseverypersonconvictedofanoffenseinTennesseeanotheropportunitytoattackhisconviction.IfPetitionerhadanyclaimshewishedtopresentinapostconvictioncauseofaction,theyexpiredonJuly1,1989,forthe1976convictions.Afterthatdate,Petitionernolongerhadaclaimundereithertheoldorthenewact.Undertheauthoritycitedabove,the1995Actwillnotreviveaclaimwhichisalreadytimebarred.
