Ðinstructions€from€investigators€to€keep€her€daughter€away€from€the€appellant,€APððs€mother€permittedÐ <#Œ" Ðher€daughter€to€resume€her€visits€to€the€Ellis€home.Ð "$r# ÐÌà  àà ` àAt€this€point,€the€appellantððs€relationship€with€his€wife€deteriorated,€and,€in€early€JuneÐ î%>!% Ð1997,€Ms.€Ellis€temporarily€left€the€Ellisesðð€trailer€and€resided€for€several€days€with€her€ex„husbandÐ Ô&$"& Ðand€his€mother.€€On€June€3,€Ms.€Ellis€returned€to€the€trailer,€intending€to€remain€in€the€trailer€andÐ º' #' Ðrestore€her€marriage.€€Upon€her€return,€she€learned€that€two€of€the€Ellisesðð€friends€were€visiting€forÐ  (ð#( Ðseveral€days€and€that€AP€was€also€present.€€Ms.€Ellis€asked€the€appellant€why€AP€was€present€in€theirÐ †)Ö$) Ðhome,€and€the€appellant€responded,€ð ðBecause€I€want€her€here.ðð€€Ms.€Ellis€offered€to€drive€AP€homeÐ l*¼%* Ðen€route€to€work.€€However,€the€appellant€responded€that€he€would€kill€Ms.€Ellis€if€she€attempted€toÐ R+¢&+ Ðremove€AP€from€their€home.€€Accordingly,€Ms.€Ellis€departed€for€work€alone.Ð 8,ˆ', Їà  àà ` àPrior€to€departing€for€work,€Ms.€Ellis€spoke€with€the€friends€who€were€currentlyÐ ° Ðvisiting€the€Ellisesðð€trailer.€€As€a€result€of€this€conversation,€Ms.€Ellis€left€work€early€on€June€4€andÐ –æ Ðdrove€to€the€Ellisesðð€trailer€at€approximately€5:45€a.m.€€When€she€arrived€at€the€trailer,€the€visitingÐ |Ì Ðfriends€passed€the€Ellisesðð€children€to€Ms.€Ellis€through€a€window€of€the€trailer.€€Ms.€Ellis€then€droveÐ b² Ðher€children€to€a€location€in€Lebanon€before€returning€to€Gallatin€and€visiting€the€Gallatin€PoliceÐ H˜ ÐDepartment.€€At€the€police€department,€Ms.€Ellis€informed€Detective€Morrow€that€the€appellant€andÐ . ~ ÐAP€were€currently€inside€the€Ellisesðð€trailer.€€Additionally,€she€gave€to€the€detective€the€key€to€theÐ  d Ðtrailer€and€permission€to€search€the€trailer.Ð ú J ÐÌà  àà ` àMorrow,€accompanied€by€Lieutenant€Dennis€Thrasher€of€the€Gallatin€PoliceÐ Æ   ÐDepartment,€immediately€drove€to€the€Ellisesðð€trailer.€€When€they€arrived,€they€knocked€on€the€frontÐ ¬ ü  Ðdoor€but€received€no€response.€€Accordingly,€Morrow€used€the€key€provided€by€Ms.€Ellis€to€unlockÐ ’â  Ðthe€door.€€As€the€officers€entered€the€trailer,€they€continued€to€announce€their€presence.€€When€theyÐ xÈ  Ðapproached€the€master€bedroom,€Morrow€observed€the€appellant€through€the€open€bedroom€door.€Ð ^®  ÐShe€recalled€that€the€appellant€was€partially€on€the€bed,€hisÐ D”  Ðà8  àà8` Ð Ð àhead€and€upper€torso€.€.€.€[were]€underneath€the€covers,€and€he€wasÐ *z  Ðscooting€out€backwards.€€His€feet€were€on€the€floor€and€at€the€sameÐ ` Ðtime€he€was€bent€over,€and€he€was€pulling€his€pants€up€over€his€hipsÐ öF Ðat€the€same€time€he€was€pulling€his€upper€torso€out€from€under€theÐ Ü, Ðcovers.ÐÂ` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ ¨ø Ðà8  àà8` Ð Ð àAt€that€point,€I€observed€.€.€.€[AP]€in€the€bed.€€When€I€walked€into€theÐ ŽÞ Ðroom,€she€immediately€started€crying.€€ÐtÄ` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ Zª Ðà8  àà8` Ð Ð àI€asked€her€if€Mr.€Ellis€had€done€anything,€and€she€told€me€that€heÐ @ Ðwas€trying€to€make€her€come.Ð&v` x` x ÐAccording€to€Morrow,€AP€was€wearing€a€t„shirt€but€was€nude€below€the€waist.€€AP€asked€if€sheÐ  \ Ðcould€dress€herself€and,€upon€receiving€permission,€obtained€a€pair€of€underwear€and€a€pair€of€shortsÐ òB Ðfrom€a€pile€of€discarded€clothing€beside€the€bed.€€The€police€additionally€recovered€a€bottle€of€suntanÐ Ø( Ðoil€from€the€bed€and€a€pair€of€ð ð[l]ittle€girlððs€Hanesðð€underwear€from€one€of€the€bathrooms.Ð ¾ ÐÌà  àà ` àAP€was€immediately€transported€to€Our€Kids€Center,€a€division€of€the€MetropolitanÐ Š Ú ÐNashville€General€Hospital.€€Lisa€Dupree,€an€employee€of€the€Center,€conducted€the€initial€medicalÐ p!À  Ðinterview€of€AP.€According€to€Dupree,€the€victimÐ V"¦! Ðà8  àà8` Ð Ð àreported€that€she€had€been€touched€on€her€front€private.€€At€that€point,Ð <#Œ" Ðshe€pointed€to€her€vaginal€area.€€Said€she€had€been€touched€with€aÐ "$r# Ðhand€and€with€a€private€and€that€it€happened€more€than€one€time.€€SheÐ %X $ Ðalso€reported,€and€I€did€ask€her€specifically€about€the€time€frame,Ð î%>!% Ðparticularly€that€day,€she€reported€that€on€that€day€she€had€beenÐ Ô&$"& Ðtouched€on€her€front€private€with€a€hand€and€a€private€and€that€sheÐ º' #' Ðwas€afraid€she€had€done€something€wrong€and€she€was€in€trouble€andÐ  (ð#( Ðgoing€to€be€taken€away€from€her€mother.€€Ð†)Ö$)` x` x Ðà@  'ìàò ò*€*€*€ó óˆÐ l*¼%* Ðà8  àà8` Ð Ð àSaid€that€the€person€that€had€done€this€told€her€that€he€wanted€her€toÐ R+¢&+ Ðhelp€him€come.€€She€reported€that€she€did€not€know€what€that€meantÐ 8,ˆ', Ðwhen€that€was€said€to€her,€that€that€was€just€what€she€was€always€toldÐ ° Ðhappened.Жæ` x` x ÐÌà  àà ` àFollowing€the€initial€medical€interview,€Julie€Rosof„Williams,€a€family€nurseÐ b² Ðpractitioner,€performed€the€physical€examination€of€AP.€€At€trial,€Rosof„Williams€described€theÐ H˜ Ðresults€of€her€examination:Ð . ~ Ðà8  àà8` Ð Ð à[The€victim]€was€a€healthy€child.€€Her€non„genital€and€anal€portion€„€„Ð  d Ðeye,€ears,€nose€part€„€„€she€is€a€healthy€child.€€When€I€examined€theÐ ú J Ðgenital€area,€she€was€cooperative.€.€.€.€[S]he€had€a€healthy€external,Ð à 0 Ðnormal€looking€genitalia.€€When€I€separated€the€labia€majora,€I€wasÐ Æ   Ðable€to€see€further€inside€and€checked€the€general€structures.€€One€ofÐ ¬ ü  Ðthese€structures€is€the€hymen.€€If€you€think€of€the€vagina€as€a€pocketÐ ’â  Ðwhere€tampons€go,€that€is€actually€the€vagina.€€The€hymen€is€justÐ xÈ  Ðinside€the€vagina,€and€that€partially€covers€the€opening.€€She€had€twoÐ ^®  Ðtears€in€the€opening.€€ÐD” ` x` x ÐRosof„Williams€opined€that€the€tears€in€APððs€hymen€had€occurred€at€least€three€to€six€days€prior€toÐ *z  Ðthe€examination.€€However,€she€affirmed€that€the€tears€reflected€penetration€of€the€childððs€vagina€atÐ ` Ðsometime€in€the€past.Ð öF ÐÌà  àà ` àThe€nurse€practitioner€also€testified€that€the€victim€had€previously€been€examined€by€Ð  Ðthe€Center€in€1992€for€evidence€of€sexual€abuse€by€a€suspect€other€than€the€appellant.€€At€that€time,Ð ¨ø Ðthere€were€similar€tears€in€APððs€hymen.€€Rosof„Williams€opined€that€the€injuries€she€observed€onÐ ŽÞ ÐJune€4,€1997,€could€have€been€the€same€as€those€observed€in€1992.€€She€also€noted€that,€becauseÐ tÄ ÐAPððs€hymen€was€torn€in€1992,€subsequent€penetration€would€be€less€likely€to€cause€injury.€€Indeed,Ð Zª Ðduring€the€1997€examination,€AP€denied€any€injuries€causing€bleeding.€€Finally,€Rosof„WilliamsÐ @ Ðrecalled€that,€in€1997,€the€victim€did€have€a€small€amount€of€pubic€hair.Ð &v ÐÌà  àà ` àShelley€Betts,€a€forensic€scientist€with€the€Tennessee€Bureau€of€Investigation€and€anÐ òB Ðexpert€in€serology€and€DNA€analysis,€examined€vaginal€and€rectal€swabs€obtained€from€AP€duringÐ Ø( Ðher€examination€by€Rosof„Williams.€€Although€Betts€was€unable€to€find€any€semen€on€the€rectalÐ ¾ Ðswabs,€she€did€identify€the€presence€of€sperm€cells€on€the€vaginal€swabs.€€However,€there€was€anÐ ¤ô Ðinsufficient€quantity€of€sperm€cells€to€perform€a€DNA€analysis.€€The€agent€also€examined€the€HanesÐ Š Ú Ðunderwear€seized€by€the€police€from€the€bathroom€in€the€Ellisesðð€trailer.€€She€identified€the€presenceÐ p!À  Ðof€semen€and€other€bodily€fluids€on€the€underwear.€€A€DNA€analysis€of€the€semen€revealed€a€DNAÐ V"¦! Ðprofile€consistent€with€the€appellantððs€DNA€profile.€€The€agent€noted€that€one€in€every€twentyÐ <#Œ" Ðthousand€Caucasians€would€possess€the€appellantððs€DNA€profile.€€A€DNA€analysis€of€the€remainingÐ "$r# Ðbodily€fluids€on€the€underwear€revealed€a€profile€consistent€with€APððs€profile.Ð %X $ ÐÌà  àà ` àDetective€Morrow€interviewed€the€appellant€on€June€4,€1997,€the€day€of€his€arrest.€Ð Ô&$"& ÐThe€detective€recalled€that,€initially,€the€appellant€was€extremely€agitated€and€demanded€to€knowÐ º' #' Ðwho€had€submitted€a€complaint€to€the€police.€€Additionally,€he€denied€engaging€in€any€sexualÐ  (ð#( Ðactivity€with€AP.€€Indeed,€the€appellant€denied€that€the€police€had€found€him€in€bed€with€AP.€Ð †)Ö$) ÐSubsequently,€however,€the€appellant€made€the€following€admissions:Ð l*¼%* Ðà8  àà8` Ð Ð àHe€admitted€to€having€sex€with€.€.€.€[AP].€€He€stated€that€he€hadÐ R+¢&+ Ðdigitally€penetrated€her€with€his€finger,€that€he€was€„€„€loved€her,€andÐ 8,ˆ', Ðthat€he€did€what€she€wanted€him€to€do.€€She€did€this€willingly,€that€heÐ ° Ðdid€not€rape€her.€€To€him,€raping€was€actually€putting€his€penis€insideÐ –æ Ðher€vagina.€€He€says€that€he€would€take€the€oil€and€he€would€rub€it€onÐ |Ì Ðhis€penis,€and€then€he€would€get€in€between€.€.€.€[APððs]€legs€and€rubÐ b² Ðup€and€down.€€He€said€he€would€do€this€also€to€„€„€in€between€herÐ H˜ Ðbuttocks€in€the€same€fashion€as€he€did€in€the€front.Ð. ~` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ  d Ðà8  àà8` Ð Ð àHe€said€he€did€this€about€20€to€30€times.Ðú J` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ à 0 Ðà8  àà8` Ð Ð àHe€said€he€was€unhappy€in€his€marriage€and€that€he€cared€for€.€.€.Ð Æ   Ð[AP].Ь ü ` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ ’â  Ðà8  àà8` Ð Ð àHe€stated€that€[AP]€had€performed€oral€sex€and€that€„€„€on€him€andÐ xÈ  Ðthat€he€would€perform€oral€sex€on€her€as€well.Ð^® ` x` x Ðà@$$(ìàò ò*€*€*ó óˆÐ D”  Ðà8  àà8` Ð Ð àHe€said€she€would€wear€short€shorts,€that€she€would€get€up€in€his€lap,Ð *z  Ðand€that€she€would€scoot€around€on€his€groin€area€.€.€.€.Ð`` x` x ÐÌà  àà ` àFollowing€her€interview€with€the€appellant,€Morrow€instructed€Sergeant€GregoryÐ Ü, ÐAllen€Bunch€to€transport€the€appellant€to€Sumner€Regional€Medical€Center€for€a€blood€test.€€En€routeÐ Â Ðto€the€medical€center,€the€appellant€volunteered€several€statements€to€the€sergeant.€€Specifically,€theÐ ¨ø Ðappellant€again€denied€the€use€of€any€force€in€pursuing€his€relationship€with€AP€and€also€denied€anyÐ ŽÞ Ðpenile€penetration€of€APððs€vagina,€commenting,€ð ðShe€couldnððt€handle€all€that€I€have.ðð€€He€admittedÐ tÄ Ðthat,€on€June€4,€he€had€fondled€APððs€genitals.€€He€further€admitted€that€he€and€AP€had€previouslyÐ Zª Ðengaged€in€oral€intercourse.€€He€specifically€noted€that€AP€had€previously€performed€oral€sex€uponÐ @ Ðhim.€€Finally,€the€appellant€attempted€to€explain€to€the€sergeant€why€he€had€initiated€a€sexualÐ &v Ðrelationship€with€AP:Ð  \ Ðà8  àà8` Ð Ð à[I]t€happened€one€night€on€the€couch.€€[AP]€came€over€and€wanted€meÐ òB Ðto€kiss€her€and€she,€we€were€laying€next€to€each€other€on€the€couchÐ Ø( Ðand€she€would€stick€her€butt€out€in€my€crotch,€you€know,€rub€upÐ ¾ Ðagainst€it€and€stuff€like.€€Of€course,€the€girlððs€got€a€pretty€body€andÐ ¤ô Ðeverything,€sheððs€not€a€woman€or€anything€but€sheððs€real€close€andÐ Š Ú Ðyou€know€like€they€say€a€hard€dick€has€no€fear€and€you€know,€thingsÐ p!À  Ðhappened.€€I€couldnððt€stop€it,€you€know€it€just€.€.€.€.ÐV"¦!` x` x ÐÌà  àà ` àSubsequently,€the€appellant€also€wrote€two€letters€to€his€wife€in€which€he€againÐ "$r# Ðeffectively€confessed€to€a€sexual€relationship€with€AP.€€For€example,€in€a€letter€dated€June€8,€1997,Ð %X $ Ðthe€appellant€wrote€to€his€wife€that€his€sister€ð ðwill€be€going€to€court€with€me€to€testify€how€.€.€.€[AP]Ð î%>!% Ðwas€all€over€me€all€the€time.€€She€came€on€to€me€and€she€knows€what€she€was€doing.€.€.€.€I€never€didÐ Ô&$"& Ðpenetrate€her€at€any€time,€I€swear.€€Please€be€on€my€side€in€court.ðð€€Moreover,€in€a€June€10,€1997Ð º' #' Ðletter€to€his€wife,€the€appellant€reiterated€the€account,€previously€communicated€to€Sergeant€Bunch,Ð  (ð#( Ðof€his€first€sexual€encounter€with€AP.€€In€the€same€letter,€the€appellant€described€the€following,Ð †)Ö$) Ðadditional€encounter:€ð ðOne€night€when€I€was€on€the€couch€with€a€blanket€over€me,€.€.€.€[AP]€gotÐ l*¼%* Ðunder€the€blanket€and€gave€me€a€blow€job.ððÐ R+¢&+ ÐÐ 8,ˆ', Ðà  àà ` àA€Sumner€County€Grand€Jury€returned€a€sixty„one„count€indictment€against€theÐ ° Ðappellant.€€On€April€13,€1999,€immediately€prior€to€the€appellantððs€trial,€the€State€requested€and€theÐ –æ Ðtrial€court€granted€the€entry€of€an€order€of€nolle€prosequi€for€all€but€four€counts€of€rape€of€a€child,Ð |Ì Ðone€count€of€attempted€rape€of€a€child,€and€two€counts€of€aggravated€sexual€battery.€€The€trial€courtÐ b² Ðfurther€dismissed€one€of€the€remaining€counts€of€rape€of€a€child€before€submitting€the€charges€to€theÐ H˜ Ðjury€for€deliberation.€€In€defense€against€those€charges,€the€appellant€testified€on€his€own€behalf€atÐ . ~ Ðtrial.€€Specifically,€he€recanted€both€his€statements€to€the€police€and€to€his€wife€and€denied€anyÐ  d Ðsexual€or€otherwise€inappropriate€relationship€with€AP.€€At€the€conclusion€of€the€trial,€the€juryÐ ú J Ðacquitted€the€appellant€of€one€count€of€rape€of€a€child,€and€returned€verdicts€of€guilt€of€one€count€ofÐ à 0 Ðrape€of€a€child,€two€counts€of€aggravated€sexual€battery,€and€two€counts€of€assault.€€The€trial€courtÐ Æ   Ðimposed€a€sentence€of€twenty„five€(25)€years€incarceration€in€the€Tennessee€Department€ofÐ ¬ ü  ÐCorrection€for€the€offense€of€rape€of€a€child,€ten€(10)€years€incarceration€in€the€Department€for€eachÐ ’â
