(    AfterathoroughreviewoftherecordinthiscaseweareoftheopinionthatthedecisionofthetrialcourtmustbereversedandthiscaseremandedforreconsiderationofAppellantseligibilityforacommunitycorrectionsplacement. TennesseeCodeAnnotatedSection4036106(1995Supp.)establishestheeligibilityrequirementsforcriminaldefendantsseekingaplacementinacommunitycorrectionsprogram.Section4036106(a)(6)providesthatoffenderswho demonstrateapatternofcommittingviolentoffensesarenoteligibleforsuchaprogram.TherecordinthiscasereflectsthatAppellanthasarecordofconvictionsonfourcountsofassault.Thus,theStatearguesAppellantshistoryofassaultoffensesrendershimineligibleforaplacementinacommunitycorrectionsprogram,andthatthetrialcourtsorderplacingAppellantinsuchaprogramiserroneousandshouldbereversed.AppellantarguesthatdespitehisrecordofcommittingviolentoffensesheisneverthelesseligibleforcommunitycorrectionsunderTennesseeCodeAnnotatedSection4036106(c)whichprovides:8 8 Felonyoffendersnototherwiseeligibleundersubsection(a),andwhowouldbeusuallyconsideredunfitforprobationduetohistoriesofchronicalcohol,drugabuse,ormentalhealthproblems,butwhosespecialneedsaretreatableandcouldbeservedbestinthecommunityratherthaninacorrectionalinstitution,maybeconsideredeligibleforpunishmentinthecommunityundertheprovisionsofthischapter. WeagreewithAppellantthatifhemeetsthecriteriaofsubsection(c)hewouldbeeligibleforcommunitycorrectionsdespitehishistoryofassaultconvictions.However,therecordinthiscaseisinsufficientforthisCourttodetermineAppellantseligibilityforcommunitycorrectionsundersubsection(c).InStatev.RobertBoston,No.03C019505CR00154(Tenn.Crim.App.atKnoxville,May14,1996),thisCourtspecifiedthatinplacinganoffenderoncommunitycorrectionspursuanttosubsection(c)thetrialcourtmustmakethefollowingfindingsoffact:8 8 (1)theoffenderhasahistoryofchronicalcoholordrugabuse,ormentalhealthproblems,8 8 (2)thesefactorswerereasonablyrelatedtoandcontributedtotheoffenderscriminalconduct,8 8 (3)theidentifiablespecialneed(orneeds)aretreatable,and8 8 (4)thetreatmentofthespecialneedcouldbeservedbestinthecommunityratherthaninacorrectioninstitution.Id.at4.InthepresentcasethetrialjudgeinsentencingAppellanttocommunitycorrectionsnotedonlythatAppellantscriminalrecordincludedanumberofpublicintoxicationoffenses.ThefindingsoffactrequiredbyBostonarenotpresentinthisrecord.
