àOn€April€19,€1996,€a€Jackson€County€jury€found€Appellant,€Robert€Farley,Ïguilty€of€two€counts€of€simple€assault,€upon€an€indictment€charging€him€withÏaggravated€rape,€aggravated€assault€by€use€of€a€deadly€weapon,€andÏaggravated€assault€by€causing€serious€bodily€injury.€After€a€sentencing€hearing,Ïthe€trial€court€sentenced€Appellant€to€eleven€months€and€twenty„nine€days,Ïninety€days€of€which€was€to€be€served€in€jail€and€the€remaining€time€to€beÏserved€on€supervised€probation.€Appellant€appeals€both€the€judgment€and€theÏsentence,€raising€several€issues:ÌÓÓà à1)€whether€the€State€presented€sufficient€evidence€at€trial€to€sustain€theÏconvictions€on€two€counts€of€simple€assault;Ìà à2)€whether€the€trial€court€erroneously€prevented€Appellant€from€presentingÏan€alibi€defense;€andÌà à3)€whether€the€trial€court€appropriately€sentenced€Appellant€to€ninetyÏdays€in€jail€followed€by€probation.ÌÓÓÌà àAfter€a€review€of€the€record,€we€affirm€the€judgment€of€the€trial€court.ÌÌÓ  Óò òFACTSó óÌÓ  ÓÌà àAccording€to€testimony€presented€at€trial,€Sharon€Raymer€and€RobertÏFarley€had€an€intimate€relationship€from€about€February€1994€until€July€1994.ÏThey€lived€together€in€her€trailer€in€Jackson€County€until€approximately€July€1994Ïafter€which€they€had€a€ð ðon€again,€off€againðð€relationship.€Ms.€Raymer€statedÍthat€by€March€of€1995,€Mr.€Farley€was€just€bothering€her€when€he€came€by€herÏhouse,€and€she€did€not€want€him€to€visit€her.ÌÌà àMs.€Raymer€testified€that€on€the€night€of€March€25,€1995,€Mr.€Farley€cameÏto€her€trailer,€drunk.€He€accused€her€of€having€affairs€with€several€men€in€theÏneighborhood.€Then€he,€ð ðthrew€me€on€the€ground€and€put€his€boot€on€my€throatÏand€kicked€me€in€the€head.€After€that€he€tore€my€clothes€off€and€raped€andÏsodomized€me.ðð€According€to€Ms.€Raymerððs€testimony,€Mr.€Farley€had€a€gun€inÏa€holster,€which€he€indicated€he€had€brought€with€him€in€order€to€kill€her.€AfterÏraping€her,€Mr.€Farley€left.ÌÌà àMs.€Raymer€stated€that€she€did€not€leave€her€trailer€at€all€the€followingÏday€out€of€fear€that€Mr.€Farley€would€kill€her.€She€stated€that€he€had€threatenedÏto€kill€her€if€she€told€anyone€of€the€preceding€nightððs€events.€A€neighbor,€BarbaraÏMcAvoy,€stopped€by€to€visit,€and€Ms.€Raymer€only€admitted€her€into€the€trailerÏafter€extracting€a€promise€that€she€would€not€call€the€police.€Ms.€McAvoyÏdescribed€that€Ms.€Raymer€ð ðhad€been€beat€up€or€bruised,€or€looked€that€sheððdÏbeen€beat€up,€bad.ððÌà àÌà àMs.€Raymer€testified€that€late€on€the€night€of€March€26,€Mr.€Farley€againÏcame€to€her€house.€He€damaged€a€sliding€glass€door€to€the€trailer,€and€thenÍwent€to€the€front€door€and€broke€through€that€door.€Mr.€Farley€dragged€Ms.ÏRaymer€from€bed€by€the€hair,€pulled€her€arms,€slapping,€kicking€and€punchingÏher.€According€to€Ms.€Raymer,€after€beating€her,€he€again€tore€off€her€clothesÏand€raped€and€sodomized€her.ÌÌà àMs.€Raymer€further€testified€that€on€the€afternoon€of€March€27,€Mr.€FarleyÏreturned€to€her€residence€a€third€time.€Ms.€Raymer€admitted€that€she€had€drunk€aÏnumber€of€beers€that€afternoon,€so€that€when€he€hurt€her€again€she€would€notÏfeel€anything.€According€to€Ms.€Raymer,€Mr.€Farley€again€accused€her€of€beingÏwith€other€men,€beat€her,€ripped€her€clothes€off€and€ð ðhad€his€wayðð€with€her,Ïraping€and€sodomizing€her.€She€also€stated€that€he€was€armed,€and€that€heÏpatted€the€gun€and€said,€ð ðdonððt€forget€I€got€this.ððÌÌà àMs.€Raymer€stated€that€after€the€assault,€Mr.€Farley€went€across€theÏstreet€to€Tommy€Mansellððs€house.€He€returned,€bleeding€from€a€stab€wound.ÏMs.€Raymer€ran€across€the€street€and€asked€Mr.€Callahan,€a€neighbor,€to€callÏan€ambulance.ÌÌà àKenneth€Bean,€an€officer€at€the€Jackson€county€Sheriffððs€Department,Ïwent€to€the€scene€of€the€stabbing€on€March€27,€1995.€He€found€Mr.€Farley€atÏMr.€Callahanððs€house,€bleeding€from€a€wound€in€his€arm.€Officer€Bean€learnedÍthat€Mr.€Farley€had€possessed€a€gun,€and€searched€for€the€gun,€checking€theÏsite€of€the€stabbing€and€following€a€trail€of€Mr.€Farleyððs€blood€back€to€Ms.ÏRaymerððs€trailer.€The€gun€was€never€found.€Officer€Bean€observed€Ms.€RaymerÏat€her€house€and€noted€that€she€appeared€to€be€intoxicated€or€on€medication.ÏHe€further€observed€that€she€appeared€to€have€several€bruises€and€scratches.ÏMs.€Raymer€began€to€have€seizures€and€an€ambulance€was€called.€ÌÌà àA€registered€nurse€from€Jackson€County€Hospital€testified€that€he€treatedÏMs.€Raymer€when€she€arrived€at€the€hospital€on€March€27.€He€had€treated€herÏfor€seizures€on€two€or€three€other€occasions.€The€nurse€noted€that€Ms.€RaymerÏsuffered€bruising€on€her€arms€and€face€and€had€an€open€wound€on€her€face.ÏShe€also€had€ð ðone€fairly€large€bruise€noted€to€the€right€lateral€hip,€just€above€theÏbelt.ðð€He€opined€that,€judging€from€the€coloration€of€the€bruises,€some€were€twoÏto€three€days€old,€while€others€were€more€recent.€The€nurse€testified€that€on€theÏprevious€occasions€when€he€had€treated€Ms.€Raymer€for€seizures€she€had€notÏhad€such€injuries.ÌÌà àDonna€Wisehart€testified€that€she€was€a€good€friend€of€Mr.€Farleyððs€andÏremembered€that€he€was€with€her€at€her€work€until€pretty€late€in€the€evening€ofÏMarch€the€27th.€The€defense€was€prevented€from€developing€her€testimony€byÏa€ruling€of€the€trial€court€excluding€alibi€testimony.€The€trial€court€stated€on€theÍrecord€that€attorneys€in€his€court€did€not€follow€the€Rules€of€Criminal€Procedure,€ð ðIÏknow€what€the€notice€says,€and€in€this€district€youððve€always€said€youððve€gotÏopen€files€with€the€district€attorney€and€that€the€formal€rules€didnððt€apply€in€thisÏdistrict.€Now,€if€you€all€want€to€go€back€to€the€formal€rules€and€want€to€practiceÏunder€the€formal€rules,€then€weððll€do€that.ðð€The€trial€court€stated€that€he€refused€toÏadmit€testimony€regarding€where€Appellant€was€on€the€nights€of€the€allegedÏincidents€as€alibi,€because€the€defense€counsel€had€not€provided€the€State€withÏnotice€that€it€intended€to€rely€upon€an€alibi,€stating€that€the€State€did€not€have€toÏrequest€notice€of€such€an€intent.ÌÌÌÓ  Óò òI.€Sufficiency€of€the€Evidenceó óÌÓ  ÓÌà àAppellant€contends€that€the€evidence€introduced€at€trial€was€insufficient€toÏconvict€Appellant€of€assault,€arguing€that€the€jury€obviously€did€not€accredit€theÏtestimony€of€the€alleged€victim€and€other€than€her€testimony€there€is€no€evidenceÏplacing€him€at€the€scene€of€the€incident.€When€an€appellant€challenges€theÏsufficiency€of€the€evidence,€this€Court€is€obliged€to€review€that€challengeÏaccording€to€certain€well„settled€principles.€A€verdict€of€guilty€by€the€jury,Ïapproved€by€the€trial€judge,€accredits€the€testimony€of€the€Stateððs€witnessesÏand€resolves€all€conflicts€in€the€testimony€in€favor€of€the€State.€òòState€v.€Cazesóó,Í875€S.W.2d€253,€259€(Tenn.€1994);€òòState€v.€Harris,óó€839€S.W.2d€54,€75€(Tenn.Ï1992).€Although€an€accused€is€originally€cloaked€with€a€presumption€ofÏinnocence,€a€jury€verdict€removes€this€presumption€and€replaces€it€with€one€ofÏguilt.€òòState€v.€Tuggleóó,€639€S.W.2d€913,€914€(Tenn.€1982).€Hence,€on€appeal,€theÏburden€of€proof€rests€with€Appellant€to€demonstrate€the€insufficiency€of€theÏconvicting€evidence.€òòId.óó€On€appeal,€ð ðthe€[S]tate€is€entitled€to€the€strongestÏlegitimate€view€of€the€evidence€as€well€as€all€reasonable€and€legitimateÏinferences€that€may€be€drawn€therefrom.ððòò€Idóó.€(òòcitingóó€òòState€v.€Cabbageóó,€571ÏS.W.2d€832,€835€(Tenn.€1978)).€Where€the€sufficiency€of€the€evidence€isÏcontested€on€appeal,€the€relevant€question€for€the€reviewing€court€is€whetherÏany€rational€trier€of€fact€could€have€found€the€accused€guilty€of€every€element€ofÏthe€offense€beyond€a€reasonable€doubt.€òòHarrisóó,€839€S.W.2d€54,€75;€òòJackson€v.ÏVirginiaóó,€443€U.S.€307,€319,€99€S.Ct.€2781,€2789,€61€L.Ed.2d€560€(1979).€InÏconducting€our€evaluation€of€the€convicting€evidence,€this€Court€is€precluded€fromÏreweighing€or€reconsidering€the€evidence.€òòState€v.€Morganóó,€929€S.W.2d€380,€383Ï(Tenn.€Crim.€App.€1996);€òòState€v.€Mathewsóó,€805€S.W.2d€776,€779€(Tenn.€Crim.ÏApp.€1990).€Moreover,€this€Court€may€not€substitute€its€own€inferences€ð ðforÏthose€drawn€by€the€trier€of€fact€from€circumstantial€evidence.ðð€òòId.óó€at€779.€Finally,Ïthe€Tennessee€Rules€of€Appellate€Procedure,€Rule€13(e)€provides,€ð ðfindings€ofÏguilt€in€criminal€actions€whether€by€the€trial€court€or€jury€shall€be€set€aside€if€theÍevidence€is€insufficient€to€support€the€findings€by€the€trier€of€fact€beyond€aÏreasonable€doubt.ðð€òòSee€alsoóó€òòState€v.€Mathewsóó,€805€S.W.2d€at€780.ÌÌà àIn€the€matter€òòsubóó€òòjudiceóó,€the€jury€convicted€Appellant€of€simple€assault,Ïcrediting€the€victimððs€testimony€to€some€degree.€The€fact€that€the€jury€apparentlyÏdid€not€credit€her€testimony€regarding€the€rape€does€not€entitle€this€Court€toÏinvade€the€province€of€the€jury€in€making€these€distinctions.€The€weight€andÏcredibility€of€the€witnessesðð€testimony€are€matters€entrusted€exclusively€to€theÏjury€as€triers€of€fact.€òòState€v.€Sheffieldóó,€676€S.W.2d€542€(Tenn.€1984);€òòByrge€v.ÏStateóó,€575€S.W.2d€292€(Tenn.€Crim.€App.€1978).€There€is€no€requirement€inÏTennessee€that€jury€verdicts€be€consistent.€òòState€v.€Densonóó,€710€S.W.2d€524Ï(Tenn.€Crim.€App.€1985)€(òòcitingóó€òòWiggins€v.€Stateóó,€498€S.W.2d€92,€93€(Tenn.Ï1973)).€It€was€entirely€proper€for€the€jury€to€exonerate€Appellant€as€to€the€rapeÏcharges€and€yet€credit€the€victimððs€testimony€regarding€the€assault.€This€issue€isÏwithout€merit.ÌÌÓ  Óò òII.€Notice€of€Alibió óÌÓ  ÓÌà àAppellant€argues€that€the€trial€court€improperly€refused€to€allow€alibiÏtestimony€and€misapplied€Tennessee€Rules€of€Criminal€Procedure€Rule€12.1Ïwhen€it€enforced€an€unwritten€local€custom€of€requiring€the€defense€to€give€theÍState€notice€of€intent€to€use€an€alibi€even€without€a€demand€by€the€districtÏattorney.€We€agree.€When€Appellant€attempted€to€elicit€testimony€from€defenseÏwitness€Donna€Wisehart€regarding€Appellantððs€whereabouts€the€night€of€theÏalleged€crime,€the€trial€court,€sua€sponte,€interrupted€the€questioning€to€askÏwhether€the€defense€had€filed€a€notice€of€alibi.€The€defense€counsel€asked€if€theÏmatter€could€be€discussed€outside€the€presence€of€the€jury,€a€request€the€trialÏcourt€denied.€The€trial€judge€stated€in€the€presence€of€the€jury€that€he€wouldÏadmit€the€evidence,€ð ðexcept€Iððm€not€going€to€let€it€in€for€alibi.ðð€After€the€witnessesððÏtestimony€the€defense€attempted€to€create€a€record€as€to€what€the€rule€ofÏprocedure€regarding€alibi€provides.€€Defense€counsel€said,€ð ðYour€honor,€now€weÏwould€at€this€time€request€again,€if€I€could€for€the€record,€You€honor„ðð€The€trialÏcourt€again€interrupted,€berating€the€defense€counsel€for€his€reliance€on€theÏRules€of€Criminal€Procedure.€The€diatribe€culminated€with€defense€counselÏattempting€to€point€out€that€the€rule€specifies€that€notice€need€be€given€onlyÏupon€written€request€and€the€trial€court€interrupting€ð ðNo,€sir,€You€hush.€Hush.ÏNow,€weððre€not€going€to€get€into€that.€Iððve€ruled,€and€if€itððs€in€error,€theyððll€reverseÏit.€But€if€Iððm€not€in€error,€theyððll€let€it€go.ððÌÌà àTennessee€Rules€of€Criminal€Procedure,€Rule€12.1€states:ÌÌÒ ` ÒÒ ` ÒÓÓUpon€written€demand€of€the€district€attorney€generalÏstating€the€time,€date,€and€place€at€which€the€allegedÏoffense€was€committed,€the€defendant€shall€serve€withinÏten€days,€or€at€such€different€time€as€the€court€may€direct,Ïupon€the€district€attorney€general€a€written€notice€of€anÏintention€to€offer€a€defense€of€alibi.€Such€notice€by€theÏdefendant€shall€state€the€specific€place€or€places€atÏwhich€the€defendant€claims€to€have€been€at€the€time€ofÏthe€alleged€offense€and€the€names€and€addresses€of€theÏwitnesses€upon€whom€the€defendant€intends€to€rely€toÏestablish€such€alibi.ÌÓÓÌÒ  ÒÒ „ ÒThe€rule€further€provides€for€the€State€to€disclose,€within€ten€days€of€receiving€theÏdefense€notice,€the€names€and€addresses€of€the€witnesses€upon€whom€theÏState€intends€to€rely€to€establish€the€defendantððs€presence€at€the€scene€andÏany€witnesses€upon€whom€the€State€will€rely€to€rebut€the€defendantððs€alibi.ÏTenn.€R.€Crim.€P.€12.1(b).€ÌÌà àTenn.€R.€Crim.€P.€12.1(e)€allows€the€trial€court,€for€good€cause€shown,€toÏgrant€an€exception€to€any€of€the€requirements€of€Rule€12.1.€€However,€here€itÏappears€that€the€trial€court€was€attempting€to€enforce€an€unwritten€local€customÏof€wide€open€discovery€on€the€part€of€all€parties€in€a€criminal€case€rather€thanÏrelying€on€Rule€12.1(e).€€Indeed,€the€State€in€this€appeal€does€not€contest€theÏerroneous€nature€of€the€trial€courtððs€ruling,€but€argues€that€the€error€wasÏharmless.€€ÌÌà àWe€agree€that€the€error€was,€in€fact,€harmless.€€Appellant€stated€on€theÏrecord€he€wished€to€show€only€that€for€part€of€the€time€Ms.€Raymer€claimed€heÏassaulted€her,€Appellant€was€elsewhere.€€He€was€able€to€present€thisÏevidence€to€the€jury.€€Further,€Appellant€argued€in€his€closing€argument€that€theÏproof€showed€that€Appellant€was€elsewhere€for€part€of€the€time€the€offensesÏwere€alleged€to€have€occurred€and€would€not€have€had€time€to€commit€them€asÏMs.€Raymer€alleged.€€Finally,€nothing€in€this€record€or€Appellantððs€brief€allegesÏthat€he€had€other€evidence€of€alibi€he€was€prevented€from€presenting€to€the€jury.€ÏUnder€these€circumstances€we€find€the€trial€courtððs€ruling€to€be€harmless€and€thatÏreversal€is€not€required.€€Tenn.€R.€App.€P.€36(b).ÌÌÓ  Óò òIII.€Sentencingó óÌÓ  ÓÌà àAppellant€also€contends€that€the€trial€court€erred€in€sentencing€him€for€aÏperiod€of€€confinement€in€excess€of€the€minimum€time€within€the€applicableÏrange.€When€a€defendant€complains€of€his€or€her€sentence,€we€must€conduct€aÏòòde€novoóó€review€with€a€presumption€of€correctness.€Tenn.€Code€Ann.€ðð€40„35„401(d).€The€burden€of€showing€that€the€sentence€is€improper€is€upon€theÏappealing€party.€Tenn.€Code€Ann.€ðð€40„35„401(d)€Sentencing€CommissionÏComments.€This€presumption,€however,€is€conditioned€upon€an€affirmativeÏshowing€in€the€record€that€the€trial€court€considered€the€sentencing€principles€andÍall€the€relevant€facts€and€circumstances.€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169Ï(Tenn.€1991).ÌÌà àUnlike€felony€sentences,€a€misdemeanor€sentence€does€not€carry€with€itÏthe€presumption€of€a€minimum€sentence.€òòState€v.€Creasyóó,€885€S.W.2d€829,€832Ï(Tenn.€Crim.€App.€1994).€In€determining€the€portion€of€the€sentence€to€be€servedÏin€confinement,€the€trial€court€must€consider€the€enhancement€and€mitigatingÏfactors,€as€well€as€the€other€purposes€and€principles€of€the€Sentencing€ReformÍAct.€òòIdóó.€at€833.€The€weight€to€be€given€each€factor€is€left€to€the€discretion€of€theÏtrial€judge.€òòState€v.€Sheltonóó,€854€S.W.2d€116,€123€(Tenn.€Crim.€App.€1992).ÌÌà àThe€Sentencing€Reform€Act€also€provides€that€the€trial€court€shall€place€onÏthe€record€either€orally€or€in€writing€what€enhancement€or€mitigating€factors,€if€any,Ïit€found.€These€findings€are€crucial€for€review€of€the€trial€courtððs€decision€uponÏappeal.ÌÌà àIn€the€matter€òòsub€judiceóó,€Appellant€was€convicted€on€two€counts€ofÏsimple€assault,€a€Class€A€misdemeanor.€Tenn.€Code€Ann.€39„13„101(b).ÏAppellant€was€sentenced€to€an€11€month€and€29€day€sentence,€but€the€trialÏcourt€ordered€that€all€but€90€days€of€the€sentence€be€served€on€probation.€TheÏrecord€of€the€sentencing€hearing€demonstrates€that€the€trial€court€observed€theÏsentencing€principles€and€the€factors€and€circumstances€listed€in€TennesseeÏCode€Annotated€ðð€40„35„210(b),€accordingly€we€review€the€trial€courtððsÏsentence€with€a€presumption€of€correctness.€In€light€of€the€number€ofÏenhancement€factors€the€trial€court€found,€including€Appellantððs€prior€history€of€12Ïmisdemeanor€convictions,€we€find€that€the€trial€court€properly€imposed€aÏsentence€of€11€months€and€29€days.€This€issue€is€without€merit.ÌÌà
